Hello IRS,

I am reviewing an email Robert Kory sent DiMascio, Berardo, and Dale Burgess on January 11, 2005 re. mediation

Dianne, David and Dale:

To follow-up on our meeting last Friday, I spoke with Ira Reiner and obtained his concurrence that mediation would be a reasonable first step in attempting to resolve the above matter.  He also supported David's suggestion that we exchange information in an effort to develop an agreed set of facts.  While he understood the theory of proposing arbitration and then going to mediation, Ira thought that the mediation step would nt be necessary.  Rather, he suggested that we propose the mediation as "pre-filing mediation."  He thoughts that properly framed letters to Greenberg and to Westin would cause their insurance companies to show up.  I am prepared to write those letters.  

I would like to suggest a conference call among all of us to discuss next steps, and a meeting in the DiMascio & Berardo office on Friday the 14th with Ira Reiner.  I would hope that we could exchange more information prior to that date, and that we would be prepared to set a schedule and process to get to a mediation.

It is important to note that on December 15, 2004, Kory wrote Diane DiMascio and stated;  "I want to re-emphasize my position that I am willing to work with you as part of a settlement between Mr. Cohen and Ms. Lynch in going after Westin's and Greenberg's insurers ... I will review that four page document in detail with you momentarily.  Obviously, Ira Reiner's role here demands an investigation.
