IRS, FBI, DOJ, and Senate Judiciary,

Stephen Gianelli has relentlessly targeted me, my sons, sister, brother-in-law, elderly parents, every witness who has submitted a declaration (all signed by the declarants personally) to numerous courts, the Scientist, Paulette Brandt, and others.  This conduct has been ongoing since Gianelli heard from Kory & Rice in May 2009.  The conduct extends to a campaign of harassment, slander, libel, and defamation taking place on the internet and in emails to third parties.  Gianelli represents and defends Leonard Cohen's legal interests.  He has worked in tandem with Michelle Blaine and Cohen's fan, Susanne Walsh, who may have affiliations with a jihadist sympathizer.  Gianelli clearly uses monikers such as Kelly Green, Mongochili, 14th Sheepdog, and 17th Shitzu.  He targeted my son Ray as a minor and the emails, which Rice was copied on, made my son physically ill.  Rutger and Ray have both provided declarations, signed by them personally, to numerous courts of laws.

Paulette Brandt has submitted numerous declarations to LA Superior Court, and others, addressing the ongoing criminal harassment.  She has contacted LAPD's TMU, spoke to Investigator William Frayeh, and spoke to LAPD detectives about this outrageous situation.  Other people, including Eric Salter, have filed complaints with law enforcement.  Michael Ingrassia felt he was being criminally harassed.  This man also attempts to infiltrate matters and that includes Phil Spector's case and issues with IRS and U.S. Treasury.  Gianelli routinely lies to IRS, FBI, DOJ, Treasury, and others.  He called Bruce Cutler in an attempt to infiltrate Spector's legal team - NOT to discuss me.  That was an excuse that he has used repeatedly.  Gianelli also infests matters with extraneous materials and that seemed to be by design.  He has written that he worked with the City Attorney to falsely arrest me on two occasions.  Streeter permitted this criminal to terrorize my family and friends while harassing us.  She then retaliated but based on her "performance" during my trial it was and remains predictable.  Gianelli has information that "Pat Dixon," who prosecuted Spector, was behind the insane Boulder PD incident at Deneuve Construction.  That would explain it effectively.  

These people are completely out of control.  That includes Leonard Cohen, his lawyers, and the operatives targeting me and others.  It is nothing other than criminal witness tampering, criminal witness intimidation, dissuasion, interference with many matters including federal tax matters, and a sordid variety of other blatantly criminal conduct.  

So what?  We shall see "so what."

Michelle Rice and Robert Kory,

The Operative continues to defend and argue Leonard Cohen's legal positions while attempting to elicit information.  This conduct is quite blatant and you and the operative have been advised to cease and desist regardless of your position that his harassment/provocation makes you "rich."

The use of fraud, perjury, and litigation misconduct to obtain judgments, verdicts, and orders misleads jurors.  That's factual and if a judge doesn't understand that, they should resign and stop wasting taxpayer dollars.  The prosecutor lied repeatedly throughout my alleged trial.  I do not have the IRS required tax and corporate information.  Neither does IRS or FTB.  I will now sue for that information and I do not believe I should have been forced to request it more than one time - let alone for over ten years.  The City Attorney does not have jurisiction to argue federal tax matters let alone lie about them.  There is no domestic violence order.  There is fraud and I have requested DOJ and Senate Judiciary to investigate the VAWA funding fraud, DMV sentencing, and the attempt to extort fines/fees from me for domestic violence.  This is a federal matter as the Colorado order, issued without findings, was fraudulently registered as a domestic violence order in California when it was not one.  I have no idea who is star struck or not and it's not a legal issue other than the celebrity justice program being run out of LA Confidential.  

The cases are not over.  There is an appellate process.  We shall see what happens with the Appellate Division but these matters will not end there.  The Tax Court matter is now before the 9th Circuit.  This situation is far from over.  

I am suing the City and County over the trial and probation retaliation.  We shall see what happens there.  I am also submitting the trial transcript to Senate Judiciary re. the tax matters and domestic violence and VAWA funding fraud.

I am aware that the operative is attempting to "dissuade" me.  I will be filing my federal RICO suit and have submitted a draft of that document to IRS, FBI, and DOJ.  It will relate to federal tax matters.  Res judicata will not apply to federal tax matters not before "LA Superior Court."

I know the lengths your client has gone to slander, defame, libel, and target me.  And a federal court is about to find out.  The judgment is evidence of theft, self-dealing, money laundering, extortion, and embezzlement.

If Cohen wants to go after any money I inherit or am paid for a book, I'll see the desperate loser in court.  That's probably why he renewed the judgment.  I think it goes to motive.  He's very lucky he's in bed with half the local government of LA and was witnessed lunching with Cooley's DA [investigator] while testifying about Spector and a gun.  I have no doubt that Spector is just delighted that Cohen now has three versions of his bullshit Spector gun story before LA Superior Court.

If you want to discuss these issues, hit reply all.  Otherwise, respond to my RICO suit.  You will have ample time to come up with additional lies, fraud, and perjured statements.  And, I will have the opportunity to address fraud upon the court properly since California condones the tampering with the administration of justice and doesn't follow Hazel Atlas.  I just think that's par for the course.

Gianelli remembers what I used to say about the situation in Colorado.  That situation demands an investigation and that includes the fact that the Sheriff's Department, who attempted to serve the owner of Juanita's, was told he no longer works there.  More liars in the justice system.  The jurors were misled and they wanted to know when "trespassing" charges were brought.  Eight months after I attempted to report the situation to the police  (with respect to a man who exposed himself in front of a child) and two days before the hearing.  The City Attorney told me I should have run out on the bill which I find outrageous but predictable.  There was no trespassing.  I asked the manager to call the police and they advised me that I could wait.  I know what the owner thinks to some degree.  I was friendly with his niece whose boyfriend I tutored.  The entire situation with Boulder PD and me demands an investigation and that includes Gianelli's statement that "Pat Dixon" was behind the Deneuve Construction roll-by.  I won the trial on the only issue I was falsely arrested over and the jurors didn't believe Boulder PD which is the good news.  

Leonard Cohen failed to serve me; filed fraudulent tax returns; and obtained fraudulent tax refunds using his fabricated and fraudulent complaint narrative.  The judgement cannot transfer the property of suspended corporations and a legal judgment is not an instrument with which to commit theft, extortion, or embezzle corporate assets.  Leonard Cohen has obligations towards me and the entities themselves.  He has now stolen from me, Machat & Machat, and probably Phil Spector whose masters (according to Machat) Cohen sold to Sony.  

Judge Babcock is wrong and I was clear with him - I refuse to participate in tax fraud or any attempt to cover up criminal tax fraud, etc.  Gianelli has relentlessly harassed me over the fact that there was no order filed re. Hess' 2014 order so what was there to appeal?  Four matters before LA Superior Court are under appeal.  That includes the fraudulent domestic violence order which clearly implicates VAWA funding fraud.  I didn't file a motion to reconsider.  That's a Cali catch-all.  I filed a motion addressing egregious fraud upon the court.  The intrinsic fraud issues relate to Cohen's legal pleadings filed in response to my motion to vacate.  California seems to think that fraud, perjury, etc. are acceptable means by which to plead one's case and someone should just sit there and not confront the fraudulent allegations.  Kory's declaration was related to federal tax matters so that's clearly at issue.  There was and remains no order to reconsider and these issues are being taken to the U.S. Supreme Court since LA Superior Court has no jurisdiction over me.  

Gianelli is using this email in an attempt to elicit information as well.  He must be on a working vacation while continuing to defend and represent Leonard Cohen's legal issues.  Nothing in Cohen's Complaint is true and that was transmitted to IRS.  Federal tax matters are not issues LA Superior Court has the authority to hear.

These criminals are quite arrogant.  Cohen is the party who has wasted court assets.  The man cannot stop lying, stealing, or slandering me.  The stakes must be high.  I will address Agent Tejeda's so-called exoneration of Cohen in federal court as well.  I don't think Cohen should have thanked the taxpayers so soon.

Senate Judiciary,

Leonard Cohen, a Canadian, clearly understands that this system support and condones criminal conduct that includes perjury, fraud, self-dealing, money laundering, theft, extortion, embezzlement, witness tampering, and so forth.  If his lawyers of record, Kory & Rice, want to discuss any of the matters under appeal, or my forthcoming RICO suit, they should hit reply all and discuss it.  

Leonard Cohen has filed fraudulent tax returns and obtained fraudulent tax refunds by falsely accusing me.  He has managed to steal my shares of corporate entities and other properties.  Given the fact that Leonard Cohen did not own the $1 million prepayment on the TH deal, how do you personally believe Tax Court obtained original jurisdiction?  LA Superior Court has no jurisdiction over me and Cohen's ongoing lies about service won't change that fact.  There is no domestic violence order.  There is fraud, wire fraud, VAWA funding fraud, and government corruption.

This situation is far from over.  Leonard Cohen prefers to be unopposed.  In that way, his fabricated narratives and perjured statements remain unchallenged.  And, Kory & Rice get rich.  Rice was clear about that in her email to Gianelli.  That goes to motive.  

Gianelli wants to talk about "Bruce Cutler" because this email is also an attempt to elicit information and he used me in order to contact Cutler originally.  I can assure you that Spector doesn't appreciate Gianelli's attempts to infiltrate his defense or legal team.  He also doesn't appreciate Cohen's three versions of his bullshit gun story before LA Superior Court.

I have requested opinions from IRS and I believe they should provide them to me.  That would include with respect to Kory's January 2005 memorandum confirming that Cohen and his representatives failed to report $8 million in income and Cohen's loans/expenditures from TH totaling approximately $6.7 million.  Cohen's sense of entitlement is extraordinary.  And, he has lawyers and government actors willing to lie through their teeth for him.

You used to say that about Bruce Cutler (2006 through April of 2012) remember?

You also used to write that you were "waiting for written opinions from the IRS and the State of Kentucky (2007 through 2014) before "filing suit in federal court".

You have been waiting, and ignored, for over a decade now.

It is a shame that you lack the minimum level of common sense to allow you to reasonably conclude that your dispute with Leonard Cohen ended more than a decade ago when you failed to respond to his lawsuit against you in court - after being advised of the date, time and place of the court hearing and replying that you would not be attending - and the court entered judgment against you in May of 2006.

It's over. It's been over for sometime now - as multiple legal proceedings in 2012, 2014, and 2015 have confirmed.

You cannot use federal or state court filings as a vehicle to travel back in time and do things differently. If it happened 10-years ago, it cannot even be addressed.

Anyone with just a little common sense could see that.

I filed my Notice of Appeal re. the Tax Court matter.  I will wait to hear from the 9th Circuit - not this criminal.

Leonard Cohen prefers to be unopposed because his fraud, perjury, litigation misconduct, abusive tactics, theft, extortion, embezzlement, money laundering, libel, etc. works.  The Canadian, who cannot live in Canada due to tax and residence problems, is proving that the system works beautifully for criminals willing to lie on the stand and under oath - particularly if you willfully fail to serve someone.  I don't think that's a great achievement.  The clown stalker is perfect for Cohen.  I have no doubt he personally approves of his conduct.  That's how Cohen operates.

In any event, the Notice of Appeal re. the 9th Circuit has now been filed.  I've also uploaded my declaration signature page as I advised the Court that I would.

You brought me into your affairs through YOUR behaviors, and no amount of additional emails will ever change that.

Mr. Fabian,

The criminal proxy operative is harassing Paulette Brandt over Leonard Cohen matters.  Cohen lied - she didn't materially change her testimony.  She provided details as Hess refused to permit my witnesses to testify.

Paulette Brandt advised this criminal to cease and desist ages ago.  After her former roommate contacted Kory (in response to Paulette Brandt's rental arrears demand letter), the woman ended up represented by Gianelli.  They proceeded, by lying to Small Claims court, to defraud Paulette Brandt of $6,700.  

The situation is unconscionable.  Gianelli, Kory & Rice have been advised to cease and desist.  He is clearly Cohen's proxy operative and this has been going on since he heard from Kory & Rice in May 2009.  Rice encouraged this criminal to harass and provoke me. She was copied on emails terrorizing my sons.  Their declarations speak for themselves.  The criminal does not.

This criminal continues to harass me over Leonard Cohen and federal tax matters.  That would include the Tax Court case that I will now appeal to the 9th Circuit.  I just got off the phone with the 9th Circuit and will file the Notice of Appeal with Tax Court.  Clearly, the 9th Circuit understands that Tax Court has jurisdiction over fraud upon the court.

As the order of the tax court issued to day made crystal clear - and as I have also informed you - a "notice of determination" issued to the PETITIONER (which hMr. as been called "the taxpayer's ticket to the tax court") is a necessary prerequisite to tax court jurisdiction.

No notice, no jurisdiction. No jurisdiction, petition dismissed - and along with it all of your collateral claims of "harassment", "blog tampering", "witness intimidation", "monikers", "operatives" and conspiracies.

No amount of additional emails, blog posts, or "appeals to the 9th Circuit" are going to change the fundamental facts that the tax court enjoys limited jurisdiction, that the tax court has no statutory jurisdiction over the issues referenced in your tax court filings, and lacks the power to entertain your petition even if it wanted to.

Last, give Mr. Fabian a break. Now that your petition has been dismissed he will be closing his file. If and when you file an "appeal" it will be handled elsewhere.

You are only succeeding in making a nuisance of yourself.

Hi IRS,

What federal tax matter with Cohen is time barred?   Clearly, not his fraudulent tax refunds; the transmittal of fraudulent documents to IRS; or the fact that he refuses to provide me with IRS required tax and corporate information.  

The operative is so obsessed that he cannot uphold his own decision not to contact me until March.  Leonard Cohen uses operatives.  That would include, but is not limited to, Gianelli, Walsh, et al.

In any event, my RICO suit should be filed within the next two weeks and we shall see what happens with federal court.  There are also four appeals and these will not end with the Appellate Division.  LA Superior Court does not have jurisdiction over me in any of the Cohen-related matters.  That includes the fraud domestic violence prosecution.  I will ask the federal court to refer this matter to the DOJ for an investigation into VAWA funding fraud.  I won't be going to the Grand Jury of Los Angeles since they are controlled by the District Attorney.

Here's a video of Michelle Blaine who worked in tandem with Stephen Gianelli to target my blogs, email accounts, etc.  This is the woman who stole $1 million from Phil Spector and then went on a rampage destroying his reputation.  She was posting on Gianelli's Law Blog and he on her vile and vulgar blog.  Michelle Blaine is the female Leonard Cohen - a bald faced liar and thief.  I don't know if she was obsessed with Phil Spector but she was obsessed with his wealth.  That's entirely clear.  This woman moved in on Phillip and got rid of Paulette Brandt, Jay Romaine, and Morgan Martin.  Where did she find the new driver, DeSouza, who has now been awarded with a green card after perjuring himself four time in immigration documents.  Obviously, that proves he will lie.

I would like you to review one of Gianelli's responses to my declaration.  He has sent me others, including with respect to Phil Spector and Cohen's insane gun stories, which I have forwarded (per my appellate attorney who views my trial as a "federal tax case" related to Leonard Cohen) to IRS, FBI, and DOJ.

I have advised Gianelli, Kory & Rice that this conduct should cease and desist.  I would like to remind you of how extensively my sons were targeted  That's completely acceptable to the powers that be who targeted me over Cohen's own conduct.  I personally believe these people are amused with themselves and seem to believe they will get away with the lies and abusive conduct.  That includes the local government actors involved in this abject insanity.
