IRS, FBI, and DOJ,

These are some of my earliest posts.  I want a federal court to see what I have posted and how I was targeted and attacked over my blog posts.  That would include, but is not limited to, Phil Spector.  I have, of course, captured Gianelli's blog posts, articles, and slanderous publications about me that he has now removed.  The Vogue article that was written for Cohen's September 2015 birthday will be used to show ongoing slander.  And then there's this insane piece about me and Spector that Cohen personally participated in.  According to the nut journalist, this was "legalled."  It's also very telling:  Phil Spector and I are two of Cohen's great tragedies although neither incident ever occurred.  It's right up there with CIA's MKULTRA, Bay of Pigs, Yom Kippur War, Janis Joplin and the rest of Cohen's bullshit stories and fabricated narratives.  Maybe the quid pro quo also involved Cohen trashing Phillip in the press.  This interview took place around February 2014.  Every article about Cohen mentions Spector and a gun.  And now me and the fraudulent "misappropriation" and witness tampering "domestic violence" fraud.  I think a federal court will understand what has gone on here unless they're stupid.  Everyone else does.  And, the court can speak to witnesses such as Rutger, Paulette, and so forth.  We'll see what happens with any motion to dismiss.  Of course, I am writing a book so what unfolds in federal court will be documented in my book that is tentative called:  "Merry Christmas to all the Dangerous Clowns in LA Confidential.  Love, Kelley"

Report details prosecutorial misconduct, pushes for transparency
The Northern California Innocence Project finds 102 California cases, and 31 from Los Angeles County, in which prosecutors engaged in misconduct. The group, based at the Santa Clara University School of Law, is advocating more transparency in how misconduct is addressed.

California courts last year found that Los Angeles County prosecutors withheld evidence, intentionally misled jurors or committed other types of misconduct in 31 criminal cases, according to an Innocence Project report released last week.

The decisions involved convictions dating back as far as 1984 and were among 102 California cases in which the group found that courts identified prosecutorial misconduct.

In 26 of the cases — nine in Los Angeles County — the courts cited the misconduct in decisions to order a new trial, set aside a sentence or bar evidence, according to the Northern California Innocence Project, which is based at the
 Santa Clara University School of Law.

Los Angeles County accounts for about a quarter of the state's felony criminal filings and one-third of felony trials.

The study is part of an effort by the Innocence Project to highlight the scope and effects of prosecutorial misconduct, which the group says has led to wrongful convictions and costly retrials. In a study released in October, the Innocence Project listed more than 700 California cases in which state and federal courts identified prosecutorial misconduct in rulings from 1997 to 2009.

The Innocence Project has called for greater transparency in how local and state agencies respond to such cases and has urged the State Bar of California, which investigates claims of attorney wrongdoing, to examine all prosecutorial misconduct findings. Courts are not required to report cases to the state bar if they decide the misconduct was harmless.

"What we want is scrutiny," said Maurice Possley, one of the authors of both reports and a visiting fellow at the Innocence Project. "If they're not getting the cases or looking at the cases, that sends a message that this sort of behavior is tolerated or acceptable."

Some prosecutors have accused the Innocence Project of exaggerating the problem. Legal experts — and courts — often disagree on what rises to the level of prosecutorial misconduct. And courts often do not distinguish between intentional and unintentional misconduct.

Appellate courts reject most claims of prosecutorial wrongdoing. The Innocence Project's October study showed that courts that identified prosecutorial misconduct usually determined that the actions did not undermine a defendant's right to a fair trial.

Nevertheless, the state bar has taken note.

After reviewing last year's study, agency officials discovered that some of the cases cited by the Innocence Project had never been reported to the bar. Attorneys and courts are legally required to notify the state bar if a conviction is reversed or modified as a result of misconduct.

"We need to improve the reporting of misconduct … by both
 lawyers and courts," said Jim Towery, the state bar's chief trial counsel. "It is beneficial that the Northern California Innocence Project is focusing public attention on a very significant issue."

Towery said his agency plans to investigate or reinvestigate "a modest number" of cases cited in the study to determine whether prosecutors should face discipline. He declined to give an exact number or to name the cases, saying that the bar's investigations are confidential.

The state bar, he said, is also extending efforts to educate prosecutors on how to avoid misconduct and what their responsibilities are when it does occur. He said some district attorney's offices, including Los Angeles County's, have invited bar officials to provide prosecutors with additional training.

One of the cases cited in last week's report was that of Eric Hester, who was convicted of rape and sodomy in 2009. A state court of appeals reversed his conviction in September, concluding that L.A. County Deputy Dist. Atty. Robert Hight made numerous improper arguments during the trial.

The court faulted Hight for arguing that Hester had a key to enter the victim's apartment when no such evidence was presented. In discussing the key issue, the appellate court found that "there is every reason to believe that Hight made these arguments with the intention of misleading the jury."

Hight did not respond to calls seeking comment.

Dist. Atty.
 Steve Cooley said in a recent letter to county supervisors that he reviewed the case and found "no indication that the deputy district attorney acted in bad faith or with actual malice."

The letter said the state bar has launched an inquiry into the allegation, and Cooley asked the board to approve legal representation for the prosecutor. The board has yet to vote on it.

District attorney's spokeswoman Sandi Gibbons said her office reviews all findings of prosecutorial misconduct and "offers extensive and ongoing ethics training" for prosecutors. She declined to comment on the Hester case or the other court findings, saying that they involve personnel matters. She said Hester is being retried.

In its report, the Innocence Project said it had identified 107 prosecutors with more than one finding of misconduct. Among those named in the study was retired L.A. County Deputy Dist. Atty. Sterling Norris.

Last year, a panel of the U.S. 9th Circuit Court of Appeals overturned one of Norris' cases, the 1984 murder conviction of Bobby Joe Maxwell, who was called the "skid row stabber."

The panel concluded that an infamous jailhouse informant falsely testified against Maxwell and that the prosecution failed to turn over multiple pieces of critical evidence that could have been used to undermine the witness' credibility.

The Innocence Project noted another murder case in which a federal judge concluded in 2006 that Norris failed to disclose important evidence to the defense during a 1992 trial.

Norris denied failing to turn over evidence in either case and said it was unfair for the federal appeals panel to accuse him of misconduct 26 years later, after the state Supreme Court had rejected previous attempts to overturn Maxwell's conviction.

"That opinion is a joke," Norris said.

Maxwell's attorney has filed a complaint with the state bar about Norris' role in the case.

Blogonaut continues to trash you. This is where it has ended up. I get dragged into Phillip's deranged trials and you end up being trashed. Both of my children have been 
relentlessly attacked by Blogonaut. Bruce Cutler called Donna Clarkson a money grubber. Five experts testified that she shot herself and Gianelli himself has said all five 
would not lie. You have to question Donna Clarkson's motive. And you have to look at the trash on the internet. The top two contenders for the most vile are Michelle Blaine and Sprocket - who is apparently Donna Clarkson's mouthpiece. That tells me all I need to know about Donna Clarkson. Also, they are cyber-terrorists and bullies. 


Blogonaut is not responsible for the email of mine he posted. That means he's responsible for everything he's posted about me. He has to call Bruce Cutler to the witness stand to testify to what Blogoat has attributed to him. 


In any event, Roman Polanski has now replaced me as the featured article. The Appeal's Court said n investigation was urgent, seemed disturbed by the DA, and is playing 
hot potatoe (sic). I will have to write Roman Polanski a thank you note for shifting Blogonaut's obsession away from me for a moment. 

It's pure California, pure Los Angeles. It's the favorite past time. They are never held accountable for their actions or so they think. 

Please do a puja. I'll continue to document the slander about you. 

This Blog and the comments will absolutely be addressed in my Motion to Vacate and Complaint against Gianelli. He has you in his sights - he's now raised "Mick Brown" as an issue. I think he's out of his league. In fact, I think they all are.

NOTE: Phil Spector and his legal team have been advised that I would like Bruce Cutler to take the stand with respect to these allegations. I would also like Bruce Cutler to address his views on why a man who would slander the Sharmapa; infer that his dog shits/pukes religious ceremonies on carpets, has a right to be using Mr. Cutler to defend himself. The notion is absurd and preposterous.

This was no “note” to your son that you sent us; it was a mass distributed written communiqué curiously emailed to your son Rutger (whom you live with—therefore rendering emails to him a little silly to begin with) and 
copied to the IRS, the FBI, the National Enquirer, and dozens of others on your spam list. 

In fact, you have copied EVERY email that you have sent to two sons to this office (as well as your huge spam distribution list that includes
 the IRS). 

We think it plain and beyond disputing that it is YOU and only you that has attempted to embroil your children and family in your own unique brand of over-the-top, manufactured drama. 

Last, the only emails that Rutger sent to us were quite respectful, did not assert that we had “threatened” him, and instead apologized for your distressing conduct that he is quite powerless to control and wishes you would stop. And, of course, Rutger does not copy his emails to 
the IRS, the FBI, the National Enquirer and dozens of others; YOU are the only one who does that. 

The only person that BOTH of your son’s have asked to “cease and desist” is YOU.
Bald faced lie about both of my sons. 

”People” think that I am a part of Leonard Cohen’s legal team? The only person demented enough to think that is YOU.

I don't have a drinking problem or anything wrong with my liver. It's called - malicious slander. Are you working for Donna Clarkson? Perhaps an investigator could find that out for certain. I am not immoral because Lana Clarkson shot herself at Phil Spector's. Sorry. You yourself have said that all five major experts would not lie on the witness stand. Your Blog doesn't really seem to favor Phil Spector. 

I don't have an alcohol-sloshed brain but I am wondering if you are on drugs. If [redacted] thinks I'm drinking that's because his father's a pathological liar who likes to destroy his children. His lawyer is also a pathological liar who probably should start thinking about "Robert Kory's" declaration in [redacted] custody matter. "God," does deranged Kelly Green hate to think what my brain is like? Then why is she/he/it so obsessed with me? Is it Alan Jackson? Donna Clarkson? Michelle Blaine? - all rolled into one. I thought Scott Rabb's article nailed Blaine nicely. Was she projectile vomiting also?

No, the Karmapa Controversy does not relate to a "national security issue with India". Rather, it refers to the controversy surrounding the recognition of the Seventeenth Karmapa, the head of the Karma Kagyu sect of Tibetan Buddhism. 

Two candidates have been put forward: 

Ogyen Trinley Dorje (also spelled Urgyen Trinley Dorje) and Trinley Thaye Dorje 

Both have already been enthroned as 17th Karmapa, and both independently have been performing ceremonial duties in the role of a Karmapa. 

This controversy has existed since the death of the 16th Karmpa in 1981. 

WE did not bring this issue up--you did. WE did not bring up the 14th Shamarpa's unseemly tiff with Mick Brown in 2005 3in part over an alleged $24,000 contribution--you did. 

Nor have we conflated the two issues.

Shamar Rinpoche a/k/a The 14th Sharmapa, along with a MINORITY of monasteries and lamas, has not accepted Urgyen Trinley as Karmapa. 

That is (we think) what you alluded to when you wrote to Shamar Rinpoche (copy to the IRS and the national media of course) and said “hopefully Blogonaut will not weigh in on the Karmapa controversy.”—thus raising the issue with us in the first instance. 

Perhaps our very own 14th Sheepdog will have something to say about this later.

RE: Default judgment WAS NOT based on a “preliminary analysis” 

The Complaint, at paragraph 3, does allege that a “preliminary analysis” shows that Lynch had siphoned off at least $5,000,000 more than she was entitled to, and that when confronted she admitted that she had taken “millions” because she had “gotten in over her head”.
No forensic accounting was done. The assets were not valued. I never admitted that I had taken anything. Cohen, as always, is not only a thief who has stolen from me, Phil Spector, Marty Machat, Steven Machat, and possibly Bob Johnston, he is also a bald-faced liar who should stick to fiction. I never said I had "gotten in over" my head or anything else. The preliminary analysis is evidence of fraud and my personal management fee is NOT the only thing to be taken into consideration. Furthermore, regardless of where Cohen deposited the various streams of royalty income - I was entitled to a 15% commission. Naturally, the thief is attempting to steal back my hard-earned commissions. He cannot stop himself. He cannot stop lying. He cannot properly compensate people. He evidently cannot stop stealing. And his tax fraud has clearly caught up with him. I have brought it to the attention of a Canadian government Minister as well. 

However, fast forward to the DEFINITIVE analysis performed by forensic accountant Kevin L. Prins, as reflected in his declaration filed in support of the default judgment on May 9, 2006, which shows that the amounts that Kelley Lynch paid herself in excess of the 15% management fee to which she was entitled was far in excess of $5,000,000--$7,159,413 to be exact.
As Cohen knows, and this was attached to my Motion to Quash in Boulder, my accountant met with Kevin Prins (who appears to have committed fraud and perjured himself in his declaration) and Prins advised him that he did not have the back-up documentation re. all the entities to do a forensic accounting. This is a ledger and fraudulent. I didn't pay myself in excess of anything and my 15% management fee is NOT the only thing that needs to be addressed. Cohen's lawyer already confirmed for mine that I am entitled to a 15% personal management fee and own 15% of all intellectual property. The $5 million is a bogus amount Cohen requested from the Court. Evidently the balance of that is damages disguised as interest. The prayed for amount was NOT reduced by the amount Richard Westin (who only represented Cohen) paid as part of his settlement in this amount. The entire lawsuit is fraud; the lies are inconceivable; and no one understands who would like like this in legal documents when the IRS is in possession of evidence and all facts point to this - I was used horrendously; I consistently attempted to determine what was going on; Cohen was wrapped in attorney/client privilege with HIS tax lawyer and HIS financial adviser; etc. 

This DEFINITIVE ANALYSIS finished SEVEN MONTHS AFTER THE COMPLAINT WAS FILED is based on canceled checks and account statements and proves that Lynch took checks made out to Leonard Cohen and deposited them in her own accounts (personal account and Stranger Management) to the tune of $229,500; transferred funds from accounts in Cohen’s name to the tune of $3,968,899; and transferred funds from Traditional Holdings (a Cohen owned entity) in excess of her agreed $20,000 a year + % to the tune of $2,961,014. Total $7,159,413 EXACTLY AND DEFINITIVELY.
Traditional Holdings was not Cohen's entity. The corporate books and records prove that. Blue Mist Touring was not Cohen's entity. The corporate books and records prove that. The agreed amount, per TH, was $20,000 per month and $20,000 per year. See management agreement prepared by Cohen's tax lawyer - for his sole benefit. There were other distributions as well - per the corporate books and records. Cohen should review the Indemnity Agreement he had his lawyer prepare on my behalf. Cohen refuses to repay the millions in loans he took from TH which caused his lawyer and financial adviser to conclude that his level of borrowing from TH was "dangerous" to the structure. Cohen cannot "sneak" two entities into a default judgment that are not parties to a lawsuit. I wasn't served. The proof of service is clearly fraudulent. The judge has no jurisdiction over me either. He now has jurisdiction over THEFT, wrongful conversion, fraud, intentional torts, the illegal altering of my federal tax returns, what I believe is a criminal cover up and obstruction of justice, etc. 

The prejudgment interest on these siphoned finds totaled $2,341,345.
I view this as damages disguised as interest - which would be illegal. 

The total loss to Leonard Cohen as a result of the funds wrongly siphoned from Cohen over a number of years was (with prejudgment interest) a whopping $9,500,758. (See Prins Dec., Summary, page 10, paragraph 30,http://www.scribd.com/doc/29620593/Cohen-vs-Kelley-Lynch-Prins-Dec.)
I have asked the IRS Commissioner's Staff to undertake the complete forensic accounting. As they, the FBI, DOJ, Treasury, and Phil Spector's attorney Dennis Riordan, just saw - Cohen's lawyers threatened me (again) with arrest over this information and other information I need for my federal tax returns which must be amended for the years 2001-2010. Prins ledger should be slam dunked into the trash can and the proper forensic accounting should include a valuation of all assets; a valuation of all assignments dating back to 1967; etc. Cohen has also stolen Steven Machat's 15% share of intellectual property. He has stolen Phil Spector's master tapes and sold them to Sony. He appears to be on a crime spree that is taking place in broad daylight. 

Therefore, Kelley Lynch has won the minor point about the phrase “preliminary analysis” being in the Complaint (we don’t know why the Adobe word search failed to find it), but has lost the argument.
Jihad Gianelli appears to be representing Leonard Cohen. 

Which brings us to the question of why—if Cohen established $7,159,413 in actual damages, was the award of actual damages by the trial court limited to $5,000,000 at the time the default judgment was entered on May 9, 2009?
Cohen didn't establish anything. He committed fraud upon the court and his perjury is inconceivable. 

The answer is simple and straightforward: When entering a default judgment, the court is limited to the amount of the damages prayed for in the complaint. This is because a complaint that only seeks (for example) $15,000 might not motivate a defendant to appear and defend the case, so from a notice/due process standpoint, it is not fair to enter a default judgment for more.
Well then, I wonder why the court didn't reduce the prayed for damages by the settlement amount Richard Westin paid Leonard Cohen. Being served a lawsuit and being made aware of hearing dates, etc., might have served to motivate me to appear in court - although, as I have said, I do not participate in fraud and will not participate in what I view as a cover up of criminal tax fraud ... that includes "ILLEGAL MEDIATIONS." 

See Code of Civ. Pro. Sec. 585; see also e.g., Greenup v. Rodman (1986) 42 Cal.3d 822, 826 [“the Courts of Appeal have consistently read the code to mean that a default judgment greater than the amount specifically demanded is void as beyond the court's jurisdiction”] and Traci & Marx Co. v. Legal Options, Inc. (2005) 126 Cal.App.4th 155, 160.) 

In this case the prayer of the Complaint sought $5,000,0000 damages for Kelley Lynch’s siphoning of funds, so the trial court “reduced” the compensatory damages being sought, and which were proved up by the Prins Declaration ($7,159,413 ) to a round $5,000,000—the dollar figure stated in the prayer of the complaint. 

In other words, Kelley Lynch benefited from what a layperson would call a “technicality” in the law, limiting the damages awarded by the court in a default hearing to the amount of actual damages requested in the prayer.
I benefited from nothing. I turned down Cohen's offer of 50% community property; etc. 

Therefore, we have also answered the question of why, if Cohen was seeking $7,159,413 ($9,500,758 with prejudgment interest) the trial court reduced the default judgment to $5,000,000 ($7,300,000 with prejudgment interest). 

Class dismissed.
Hopefully, certain federal agencies can find a way to put this stark raving lunatic who appears to work for Leonard Cohen and may have found a sympathetic ear in Alan Jackson (Phil Spector's prosecutor) in prison.

Shamar Rinpoche Files Defamation Suit against Controversial Karmapa Book 

Author Lea Terhune accused in spreading false information solely to harm Tibetan Buddhist leader and lineage

This month saw the release of a new book on the Karmapa, Wrestling the Dragon: In Search of the Boy Lama Who Defied China (Random House, 2004). Written by novelist and Tibet activist Gaby Naher, the new book is the fourth title published on the Karmapa since 2003.
In the wake of the publication of Naher's book, the International Karma Kagyu Buddhist Organization is announcing that Shamar Rinpoche has filed a defamation suit against the author of an earlier book of the Karmapa, Lea Terhune. Her book, Karmapa: the Politics of Reincarnation, was published earlier this year by Wisdom Publications, also a defendant in the suit.
Shamar Rinpoche, the complainant in the case, filed the suit on June 23, 2004 in the High Court of New Delhi. The suit claims that Terhune's book was “written with the sole intention of maligning the reputation of the Complainant along with undermining the sanctity of his position as the second most respected person in the Karma Kagyu Sect of Tibetan Buddhism.”
“Though I am filing this case in my own name, as a Buddhist teacher I am not primarily concerned with my own personal reputation,” Shamar said: “Instead, I have filed this suit to protect the Karma Kagyu lineage, defend the others criticized in this book, and set the historical record straight for future generations.”
The current suit makes several complaints against Terhune's book. In addition to intentionally harming Shamar Rinpoche and the Karma Kagyu lineage, the book casts ungrounded aspersions against Karmapa Thaye Dorje and falsely projects Ogyen Trinley as the true Karmapa; makes unsupported insinuations against the Indian government and Indian officials; passes “loose remarks” about Shamar Rinpoche's parents and relatives; and promotes factionalism within the Karma Kagyu school.
In particular, the suit singles out six chapters in Terhune's book containing significant errors. Shamar Rinpoche has asked the court to require author Terhune to prove the allegations she repeats against him and his family, that:
1.               Shamar Rinpoche was behind the death of Jamgon Kongtrul Rinpoche in an automobile accident in 1992;
2.               Along with Topga Rinpoche, Shamarpa sold off a monastery of the 16th Karmapa in Bhutan, Tashi Choling;
3.               He illegally appropriated for himself the Karmapa International Buddhist Institute in New Delhi;
4.               He tried to install a prince of Bhutan as the Karmapa;
5.               He bribed the Indian government to stop Ogyen Trinley from going to Sikkim;
6.               And, his father was an alcoholic and his step-father a CIA spy.
Based on these charges, the suit claims that Terhune's book has done irreparable damage in India and around the world to the reputations of those she has attacked. Accordingly, if she cannot prove the truth of her allegations, the suit requests that the court order that Terhune's book be removed from sale in India; that Terhune make a formal apology for her defamatory remarks; and that she pay financial compensation for the loss of reputation that she has caused.
“Given her background, it is not surprising that Terhune would write such a book,” said Lama Karma Wangchuk, secretary of the IKKBO in New Delhi. “She is not an objective journalist, as her book implies, but a close confidante of a major partisan in the Karmapa controversy.” Since 1983, Terhune has been the personal secretary of the chief supporter of Ogyen Trinley, Tai Situ Rinpoche.
In addition, there are numerous other erroneous allegations against Shamar Rinpoche and other Karma Kagyu lamas that are not detailed in this lawsuit but that mar Terhune's text. The IKKBO has already answered many of Terhune's charges in our recent series of Internet articles on her book. Here, we will only discuss one particularly egregious error in Terhune's text, an inaccurate account of a conflict between the Dalai Lama's Gelupga school and the Karma Kagyu school of the Karmapas and Shamar Rinpoches that occurred in the 16th century. Terhune's retelling of this story appears to try to disparage the current Shamarpa by misrepresenting his predecessors.
A Story from Old Tibet, Badly Re-told
It is an error to believe the Shangri-La myth that Old Tibet was an exception to the history of nations, an exceptional land where leaders and citizenry alike followed the law of karma and eschewed conflict as a means to political power. Serious students of Tibetan history know that this former nation, like any country, had its share of power struggles that sometimes erupted into violence. And since religion was so strong in Tibet, it is natural that monasteries, lamas and leaders of the different schools of Tibetan Buddhism each played a prominent role in the politics of their day.
In addition, many people, especially in Western countries, may think that the Dalai Lamas always ruled over Tibet. This is not the case. The rule of the Dalai Lamas only began in the 17th century, when the Great Fifth Dalai Lama assumed the throne of Tibet. Immediately before that time, the country was under the rule of well loved kings who followed lamas of the Karma Kagyu, the school of the Karmapas. Under the rule of these kings, a conflict arose between the three main monasteries of the Dalai Lama's school and the royal government.
The 4th Dalai Lama and the 6th Shamar Rinpoche, Karma Chokyi Wangchuk (also called the “Red Hat Karmapa” and the 6th Garwang Tulku) tried to arrange a meeting to solve the misunderstanding between the monasteries and the government—in essence, a conflict between the Dalai Lama's Gelugpa school and the Karma Kagyu school that provided the gurus to the royal house. However, some of the Dalai Lama's officials successfully plotted to prevent this meeting, to further their own interests. Thus, the conflict continued, with increasingly acrimonious relations between the Dalai Lama's school and the royal government, ultimately leading to the overthrow of the Tibetan king. Later, historians, scholars and even the 5th Dalai Lama himself would criticize the self-serving officials who killed this chance for a peaceful resolution to this conflict.
The best known history of Tibet in English, Tibet: a Political History by Tsepon Shakabpa, an official of the Dalai Lama's government until 1959, describes these events. Shakabpa even refers to Shamar Rinpoche by the name “Red Hat Karmapa,” a traditional term indicating his close alliance with the Karmapa.
Lea Terhune recounts these events as well and takes her version from Shakabpa. However, she makes one crucial change. Instead of mentioning Shamar Rinpoche as the peacemaker in this conflict, she names the Karmapa. She also omits Shakabpa's reference to Shamar Rinpoche as the “Red Hat Karmapa,” apparently embarrassed that Tibetan history placed Shamarpa and Karmapa so close together. Elsewhere, Terhune even claims that the 6th Shamarpa and the 10th Karmapa fought against each other, an allegation that has no basis in the written history of Tibet. Indeed, historians consistently mention these two lamas as the archetype of a close relationship between teacher and disciple.
A Frenzy of Publishing
Terhune's book represents the second of four volumes published since 2003 about the Karma Kagyu lineage and its chief lama, the Karmapa:
·                Music in the Sky: the Life, Art and Teachings of the 17th Karmapa Ogyen Trinley Dorje (Snow Lion, 2003) by long-time disciple Michelle Martin is a biography of Orgyen Trinley;
·                Karmapa: the Politics of Reincarnation (Wisdom, 2004), Terhune's book, presents the Karmapa controversy from the viewpoint of a partisan of Orgyen Trinley;
·                Mick Brown's The Dance of 17 Lives: the Incredible True Story of Tibet's 17th Karmapa (Bloomsbury, 2004) came out after Terhune's volume, and deals as Terhune's does with the controversy;
·                Wrestling the Dragon: In Search of the Boy Lama Who Defied China(Random House, 2004) by Gaby Naher is a combination of personal memoir, biography of Ogyen Trinley and history of Tibet and the Karmapa controversy.
The authors of all four of these books support the candidacy of Ogyen Trinley for the title of 17th Karmapa. Ogyen Trinley has also been recognized by the Chinese government and by the Dalai Lama. Shamar Rinpoche opposes the recognition of Ogyen Trinley and supports his own contender chosen according to religious tradition, Thaye Dorje.
“Supporters of Ogyen Trinley have been involved in a frenzy of publishing recently,” said IKKBO Secretary Wangchuk. “We are not certain whether this is merely a trend or part of a coordinated publicity plan. Either way, they must be publishing so much or encouraging others to publish now because they are trying to win in the court of public opinion what they have been losing in the courts of law.”
Since 1993, supporters of Ogyen Trinley have been defendants in several legal actions brought against them in Indian courts by supporters of Thaye Dorje. Concerning the major action, a dispute over possession of the monastic seat of the 16th Karmapa, Rumtek Monastery in India's northeastern Sikkim state, three levels of the Indian court system have found against the supporters of Ogyen Trinley. In the most recent decision, on July 5, 2004, the Indian Supreme Court found that supporters of Ogyen Trinley have no jurisdiction over the monastery. Followers of Ogyen Trinley have also been convicted of criminal offenses, in particular inciting violence at the enthronement ceremony of Thaye Dorje held in 1994 in New Delhi.
“In my opinion, if someone sues another person only for revenge or to realize some financial gain, then this is wrong action according to Buddhist ethics or any ethics that I am familiar with,” Wangchuk said.“By contrast, if it will prevent some harm, then it is proper to defend oneself. And in a civilized society, the way to defend oneself is through legal channels.”
The first hearing in the case over Terhune's book took place at the High Court in New Delhi in July, 2004. At that time, the court ordered Terhune to appear at the next hearing scheduled for October. The 14th Sharmapa Questions Mick Brown's Ethics

I cannot understand the value or nature of your professional ethics: that you have obligation to a questionable source but not to me, the entire subject of your story. Would that mean I had to accept your verdicts – just because you are a journalist?

Justice is the basis of ethics, and rights always equal responsibility. But somehow your journalistic practice looks the other way so that a journalist is able to exercise many rights over his subjects but zero moral responsibility toward them. That makes your position insensitive to say the least.

In my periodic visits to Dept 106 of the Clara Shortridge Foltz Criminal Justice Center, Los Angeles, where Phil Spector is presently on trial, Spector and I have done our best to ignore each other. Well, to be more accurate he has done his best to ignore me. Spector, I'm told, is "unhappy" with the book I have written about him, and on the rare occasions when I have caught his eye across the courtroom he has fixed me with a basilisk stare.

In court last week, I decided to bite the bullet (an unfortunate choice of phrase, perhaps, in the circumstances). Coming face to face with him in the hallway outside I greeted him with a cheery "hello, Mr Spector". The basilisk stare auto-reflexed into something that might have been a smile and he rasped back "hello".

Perhaps it wasn't the best thing for me to attempt to continue the conversation by asking "how are you doing?". The smile died on his face, and his three minders hurried him on his way. 

One of the enduring fascinations of the trial has been Spector's changing wardrobe. Over the past four months he has modelled a bewildering number of frock-coated suits in a variety of fabrics and colours. These initially suggested a certain rakish, devil-may-care attitude - powder blues and dove greys, worn with big-collar, open-neck shirts in pastel colours - more Disco Inferno than murder trial. 

But as the trial enters its critical, closing phase, a certain sobriety of mood seems to have come over Spector. He has now taken to wearing a tie, the better to impress on the jury perhaps that, really, he is taking this seriously; and the blonde bob wig, which lent him a creepily andronygous appearance, has been jettisoned in favour of a more conservative chestnut brown nest of curls. 

Spector's coiffure is apparently supervised by his 26-year-old wife Rachelle, who recently ticked off a reporter for daring to suggest that her husband wears wigs. Rachelle's role in the trial is to arrive each day at the court clinging to Spector's arm, and then sit through the testimony - which has often been of teeth-grinding tedium - wearing an expression of saintly devotion. 

advertisementIt is a touching display of marital loyalty and intimacy. But if she honestly thinks that's his real hair, you have to ask how intimate she and Spector really are. 

Rachelle has been a source of constant speculation, and no little sniping, among the various trial-watchers and bloggers attending the proceedings, to the point that last week Spector's defense attorney Roger Rosen complained to the judge that disparaging remarks had been made about Mrs Spector's wardrobe in earshot of the jury.

While the trial has not captured television ratings in the way it was expected - Court-TV has long since relegated its live coverage to a web-broadcast - it has spawned a vigorous debate in the blogosphere. Two blogs in particular stand out. Betsy Ross is a seamstress, who writes under the by-line 'Sprocket' (the name of her cat). 

A pleasant-looking, bespectacled woman, who describes her main interest as "criminal psychology, specifically serial rapists and murderers", Mrs Ross, who is to be found in court most days, writes a lively and discursive diary which makes the trial seem like a cross between the Perry Mason and the Archers and the 3AM girls - whos eating with who, Rachelle's wardrobe, sickness.

But the most thorough, and entertaining, reporting on the case is provided by a 44-year-old housewife in the Adirondacks named Kim Pulley, who writes on a blog called 'The Darwin Exception' ("because it's not always survival of the fittest - sometimes the idiots get through"). 

Mrs Pulley describes herself as "an inveterate trial watcher and knitter", and as well as regular trial reports her site also offers free knitting patterns. Struggling to find some common link between "Fuzzy hat and mittens" and the Grand Guignol spectacle that is the Spector trial I e-mailed Mrs Pulley. There are, she informs me, "tons of parallels" between the law and knitting. 

"Both are very structured and very precise with rules and natural consequences for outcomes that depend on following set instructions - and they are both fluid and a skilled practioner can bend and adapt the set instructions to come up with something completely different yet strikingly dependent on the starting point. They both rely on logic and creativity."

In her spare moments between covering the Spector proceedings, Mrs Pulley has managed to complete "a little striped button down sweater and matching pants", a sweater that won grand prize at her local fair, and a baby's layette set. 

"Now I am making a hoodie sweater that I started with Michael Baden's testimony and have just a sleeve left to complete. If they call many more experts I can clothe an African village full of children." At least something good has come out of all this. 

Virtually all of the bloggers covering the trial seem to have made up their minds that Spector is guilty, but there is one web-page that remains indefatigable in its support for him - the 'Official Team Spector' page on MySpace. Its latest posting launches a scalding attack on Judge Fidler for allowing a fifth woman, Spector's former assistant and lover Devra Robitaille to testify that Spector once threatened her with a gun. Robitaille is expected to take the stand next week. 

"I think it's pretty clear that Fidler is placing his bets on the prosecution," the posting reads, "especially when he has denied the defense to bring many valuable witnesses, denied them every motion made, censored important facts about the case. Fidler is showing a bias like we've never seen before!" So who is this staunch supporter for the defense? The web-page identifies them as a 67-year-old male, married, birthsign Capricorn, resident in Alhambra, California. Ah, that would be Phil Spector then.... 

One moment of high drama in the court-room last week not reported in 'The Darwin Exception' (the television cameras were turned off) was the fleeting appearance of the defendant in Judge Fidler's next case. Bailifs instructed everybody in court, including Spector, to move to one side of the room as they were "quarantining" the area between the door and the well of the court. 

Quarantining? All became clear when a man was brought into the room, handcuffed and chained to a wheelchair. He was wearing orange prison fatigues, a large gag over his mouth and his head was encased in a fine-mesh hood, like a bee-keeper's bonnet. 

This was Benjamin Pedro Gonzales, aka 'The Savage', who is presently serving time for the murder of at least three women and two fellow inmates, and whom one judge has described as "one of the most dangerous inmates in California history". 

Gonzales is HIV positive and uses every opportunity to bite or spit saliva or blood at anybody who comes near. He has attacked prison guards and almost stabbed his own lawyer to death with a pencil. He was accompanied by seven armed deputies, all of whom were wearing protective gloves, and his lawyer, who looked as if he'd rather be representing anybody on earth but his client. 

Gonzales was in the court for no longer than five minutes, while the judge scheduled a mental competency hearing, before being wheeled out leaving a stunned silence in his wake. No-one seemed more stunned than Phil Spector, who had been staring at 'The Savage' with naked fascination - mindful, perhaps, that for once his own starring role as the most bizarre spectacle in Department 106 had been emphatically eclipsed.

Although Leonard Cohen has retreated to a Zen center to write music and poetry, a tribute album being released this week could bring new fans.

It's hard to imagine being startled in a setting as peaceful as the Zen Center on the edge of the tiny resort village of Mount Baldy, but that's the likely reaction when you discover that one of the most respected songwriters of the modern pop era lives on the center grounds in a cabin no larger than a budget motel room.
Leonard Cohen has spoken for years about his interest in Zen. But who ever figured that this pop icon, whose classic tales of restless longing include "Bird on a Wire" and "Suzanne," would make such a spartan spot his permanent home and would trade in his finely tailored suits for modest robes?
"They have been very kind to me here," Cohen says matter-of-factly about his change of lifestyle as he sits on a narrow cot that would look at home in an Army barracks. "This was originally two cabins, but they broke through [the wall] and made it one cabin to give me a bit more room.
"I stay here and do my work and help look after Roshi, who is the old teacher. He's 88, and three or four of us are charged with doing that. Cooking is my contribution."
The 61-year-old songwriter and poet hasn't turned his back on the world. He frequently heads down the mountain to Los Angeles in his four-wheel-drive vehicle, either to visit an affiliated Zen center, to visit his daughter in the Mid-Wilshire area or meet with Kelley Lynch, his manager.
But this two-room cabin has been home for two years for Cohen, who hasn't toured since 1993 or recorded a studio album since 1992. The cabin is where he rises at 3 each morning to begin preparing the day's first meal.
"Please stay for lunch," he says warmly. "I've made some lovely vegetable soup for today."


Cohen's graceful, confessional songs--described as "elegant, bittersweet mood music for the dark nights of the soul" in the latest edition of the Rolling Stone Album Guide--have had a major impact on a wide range of rock, country and pop musicians.
The reason he is accepting a visitor today is to talk about the tribute album that will be released Tuesday by A&M Records ( see review, Page 90 ). The collection, titled "Tower of Song: The Songs of Leonard Cohen," features versions of his works by such artists as Bono of U2, Peter Gabriel, Elton John, Willie Nelson, Sting, Billy Joel, Aaron Neville, Tori Amos and Trisha Yearwood.
The gracious, soft-spoken songwriter is delighted with the collection.
"I have had a good following in Europe and Canada, but I felt my position on the pop landscape in America was getting smaller and smaller until I kind of disappeared from view on the pop scene for about 10 years--say, 1975 to 1985," he says.
"But things started to change. My daughter [in her teens at the time] pointed out a few years ago that her friends were listening to my music, and that pleased me. People used to say my music was too difficult or too obscure, and I never set out to be difficult or obscure. I just set out to write what I felt as honestly as I could, and I am delighted when other people feel a part of themselves in the music."
Cohen was a late starter in the pop world. Born to a well-to-do couple in Montreal, he grew up in a house that was filled with music. As he got older, he enjoyed a wide range of musical styles, from commercial country and folk to synagogue music.
Inspired by the songwriting of Hank Williams and other Nashville heroes, Cohen was in a country group, the Buckskin Boys, briefly during his teens.
While a student at McGill University in Montreal, he gravitated toward poetry and prose, eventually gaining acclaim in Canada for his poems and two novels. But the books didn't sell well, and he turned to his first love--songwriting--in hopes of making some money.
He was quickly rewarded when Judy Collins recorded one of his songs, "Suzanne," for her "In My Life" album in 1966. The song became a staple of her live show and is still strongly identified with her.
Although Cohen had planned to simply write songs, John Hammond, the legendary Columbia Records executive who signed artists ranging from Bob Dylan to Billie Holiday, was so impressed by Cohen's own versions of his songs that he signed him to a record contract.
Cohen's debut album, 1968's "Songs of Leonard Cohen," contained some of his most memorable compositions, including "Suzanne," "Sisters of Mercy" and "Hey, That's No Way to Say Goodbye." Sales were modest, but critics and other songwriters hailed the collection. One fan, Robert Altman, even used it as the background score to his film "McCabe and Mrs. Miller."
While Cohen was frequently written about in the context of the New York folk movement, he stood apart in several ways. Cohen was in his 30s by the time his first album came out, and he favored expensive suits rather than blue jeans and work shirts. He also didn't share the movement's interest in left-wing or radical politics. He preferred to concentrate on themes of loneliness and desire.
"I grew up wearing suits," he says. "I wasn't trying to make a statement or set myself apart. I was never into blue jeans. I was older. I wasn't ashamed of my education. I didn't pretend that I came out of the country. I wasn't trying to be Paul Bunyan. My name was Leonard Cohen. My father was a clothing manufacturer. I wrote books. I went to college."
Cohen doesn't answer so quickly when asked why his music seemed so relentlessly stark and revealing--characterized by such lines as these from "Sisters of Mercy":
You who must leave everything
That you cannot control
It begins with your family
But soon it comes round to your soul.
"It was all I could write about," he says finally, rubbing his shaved head as if trying to stimulate thought. "You have to dig down for that true voice, which you've heard in others--a Billie Holiday or a Hank Williams--and you try to find it in your music. It's a way of proving you deserve to be here. . . . You deserve to get a girl or deserve to walk out on the street.
"I know this is a very poverty-stricken view of things, but that's the way it was. I never had the luxury of standing in front of a buffet table saying, 'I'll write this kind of song today and that kind tomorrow.' It was like: 'Can I scrape some words together and write anything? . . . Can I dig deep enough inside to say something that matters?'"
So how did Cohen get to the Zen Center?
"I was never interested in Buddhism," he says later, leaving his cabin and heading to a larger building where he does most of his cooking. "I was never looking for a new religion. The religion I had was fine as far as I was concerned, but this particular kind of training interested me. I have been studying with this old teacher, who happens to be a Zen master."
At the main cabin, he takes off his sandals and steps into the kitchen to test the soup that's heating on the stove.
Cohen began his embrace with Zen in the early '70s, during a period of deep depression.
"It's the same thing that happens to lots of people," he says after sampling the soup. "You don't do anything [to help yourself] unless you are in trouble. I got into a bit of trouble myself, and I noticed a friend from Greece seemed to have a much calmer life than mine. I had done a couple of records by then and done a tour of Europe. I had made a little money, but I was very lonely and dissatisfied. So, I phoned up my friend and he introduced me to this old teacher.
"There was something very intriguing about the Zen training. It was very rigorous. We were like the Marines of the spiritual world, and I enjoyed that. But after a while, I thought, 'This is crazy,' and I went over the wall.
"Yet something had touched me, and I started coming back here from time to time. It became integrated into the rest of my life, my songwriting, my touring, my duties to my family. As events in my life allowed it, I began spending more and more time until I just moved in."
Cohen gazes across the room, at the trees through the window, when asked about the fulfillment he receives at the center.
"I think finally it is the freedom from questions like 'What is life? Why are we here?' This is the study of the self--your relationship to this entity that we call the self. One of the things that appealed to me about this particular [discipline] is that they don't demand an answer."
On this afternoon, Cohen is making plans to accompany Roshi on a tour of Zen locales on the East Coast. "You might say I'm the road manager of the tour," he says, smiling at his joke.
"I have done this type of trip before. Sometimes people recognize me at airports, but the people at the centers are used to me taking Roshi around for many, many years, and it's no big deal. Besides, there are other people at the centers who have distinguished careers."
An outsider might interpret Cohen's decision to live in a Zen center as akin to dropping out of society, but Cohen objects.
"This is the very contrary of dropping out," he says. "Most people can't wait to get home to their house or apartment and shut that door and turn on the TV. To me, that's dropping out. There is a saying: 'Like pebbles in a bag, the monks polish each other.' You are continually involved with people here in a way you are never involved [on the outside]. You wake up with it and you go to sleep with it. There is this community. Any tendency toward dropping out is immediately spotted in a community like this."
Cohen has plenty of time here to devote to his writing. At present, he's working on an illustrated book of poems and songs for a future album. His workroom contains a primitive Macintosh computer and a synthesizer, tools for his music and his graphic art. There is also a radio in the room but no CD or cassette player. He has to go out to his vehicle to play a CD.
Though he has a daughter, Lorca, 21, and a son, Adam, 23, Cohen has never been married. He was engaged for a while to actress Rebecca De Mornay, but that relationship has ended.
"I've never felt myself as a civilian," he says when asked about relationships. "This kind of life suits me. I tried domestic life. I did my best. I had a good relationship with the mother of my children and my children, but I never felt I was any good at it."
Cohen finishes eating his soup and carries the bowl over to the sink. He puts on his sandals and then leads his guest back across the dirt trail to the parking lot.
He pauses at the car to answer a final question--whether he plans to tour if the response to the tribute album suggests there is a big U.S. audience to hear his songs again.
"Well, you know, the devil laughs when we make plans," he says. "I wouldn't want to say never, but I'm not waiting for the phone to ring."

Unlike most folk or pop compositions, the songs in the Cohen canon ask the singer to submit. They aren't vehicles for a personality or smooth seals awaiting a stamp, and they reveal their many layers most fully when touched most gently.
On this uneven tribute album, Trisha Yearwood's solid, mainstream- country "Comin' Back to You," Suzanne Vega's direct "Story of Isaac" and Willie Nelson's courtly "Bird on a Wire" best exemplify the virtues of modesty.
That doesn't mean the songs can't be wrestled into some kind of distinctive shape. Bono's "Hallelujah" challenges the original's hymn- like form with a minimalist, ambient-techno track and deadpan spoken lyrics, yet remains fascinatingly faithful to its spirit.
Then there are the selections that merely call attention to the arrangement or to the vocals: Don Jovi's, er, Henley's histrionic "Everybody Knows," Sting and the Chieftains' rushed "Sisters of Mercy," Tori Amos' tremulous "Famous Blue Raincoat."
About the time Elton John is thumping "I'm Your Man" into dance- floor submission, you might start to wonder what the point is. From Collins to Cocker to Concrete Blonde, there's never been a shortage of Cohen coverage, so "Tower" doesn't really fill a void.
And after all, there are always his own albums. Cohen is often dismissed as a non-singer, but if it does anything, "Tower of Song" should create new appreciation for the Master's monotone.
New albums are rated on a scale of one star (poor) to four (excellent).


Scores of today's most acclaimed musical figures, from U2's Bono and Willie Nelson to Courtney Love and Trent Reznor, have spoken with awe about the music of Leonard Cohen, frequently asking how anyone was able to write in such a deeply personal, unguarded style.
But Cohen himself speaks with disarming ease about the songs that have made him such a respected force for the last quarter-century. Here, he gives his feelings about my 10 favorite Cohen songs, listed in chronological order:
"Suzanne" (1966)
"I was very excited when I finished it because it had all the qualities of the kind of song I loved myself. It sounded a little like a folk song, but it had a modern feel."
"Hey, That's No Way to Say Goodbye" (1967)
"It's hard to be honest when I talk about this song because the song is connected with somebody and I don't feel like disclosing the name. I was leaving one woman and courting another, and I wasn't quite sure what I was feeling at the time. I think both of these songs would be in my own top 10. I've revived them for every tour."
"Sisters of Mercy" (1967)
"This was inspired by two young women that I met in a snowstorm in Edmonton. I was on tour, singing in college towns just by myself, and we were in the same doorway.
"They didn't have any hotel and I had one, so we all went back and they fell asleep on the double bed and I sat in the armchair. They were so lovely, just sleeping. You have to remember I was someone who had always struggled with this problem of loneliness, and I was always hoping to meet women on the road. . . .
"I was awake with my pen and pad, and I remember the moonlight shining on the ice of the river and thinking it was like as good as it was going to get."
"Bird on a Wire" (1968)
"I wrote it on this island in Greece, right after they put up electrical wires for the first time. They were stretched right across my window, and I was very disturbed for a long time because they obstructed this lovely view. Then, one morning I saw a bird on a wire and the bird made me see everything in a new light--the bird who didn't distinguish between this wire and the branch of the almond tree. Somehow, the wires became quite beautiful to me."
"Famous Blue Raincoat" (1971)
"That's also a song that perplexes me because I thought there was something unclear about it. I like hard edges and very, very clear imagery, and I wasn't ready to accept that I had written an impressionistic song. I worried that I was asking the listener to make certain leaps, and I still don't know if that's legitimate."

"I wrote it about Janis Joplin, and it wasn't very gallant of me to tell people I wrote it about her, because there's an intimacy described in it. I regret doing that. "I wanted to write something in the tradition of the hallelujah choruses but from a different point of view. I think the other song that is closely related to that is 'Anthem.' It's the notion that there is no perfection--that this is a broken world and we live with broken hearts and broken lives but still that is no alibi for anything. On the contrary, you have to stand up and say hallelujah under those circumstances."

Leonard Cohen Working On Mt. Baldy
Cohen’s cabin with his Technics KN 3000 synthesizer and computers are shown, and he sings his new song A thousand kisses deep. He also recites three unpublished poems, two telling about Roshi (one titled Roshi at 89) . The third was titled Too Old.
The camera also visits the office of Stranger Management: Cohen demonstrates his archives (lots of boxes full of notebooks, he shows a poster of his first book Let Us Compare Mythologies and a painting made by Suzanne, the mother of his children). Later a studio session is going on, he is working with Raffi Hakopian (violin) and Leanne Ungar (his sound engineer). Afterwards Cohen and Brusq dine at Canter’s.
In this documentary Cohen tells about his life, his memories, why he lives at the Zen Center. He suggests that some kind of a circle has been closed and now he can do something else (see footnote)
The film ends with (I was) Never Any Good (at loving you), a new song written for his next album. He goes to his car and listens to a demo sung by Billy Valentine.

Jihad Gianelli - Blogonaut Targets Me After Hearing From Cohen's Legal Representatives & Possibly Finding A Sympathetic Ear With DDA Alan Jackson
NOTE: After hearing from Leonard Cohen's representatives, Jihad Gianelli had a so-called "journalist" (Joff Belark) target me. The following piece of slander (one long lie based on Cohen's fraud, perjury, etc.) was then posted on his website. All facts addressed with Joff Belark in emails were willfully overlooked. Jihad Gianelli, a so-called lawyer in the Bay Area (who may be affiliated with Cohen, the DA's office in the Phil Spector matter, the Clarkson family, Sprocket, Michelle Blaine, and others) then proceeded to harass me, my family, sons, friends, business associates, and others, relentlessly. The U.S. Postal Inspector advised me that they have opened a criminal investigation into "Stephen Gianelli" based on my complaint to them. I have also informed the IRS, FBI, DOJ, and Treasury - repeatedly - that I view Gianelli's activities as criminal witness tampering, criminal witness intimidation, an attempt to obstruction, etc. I stand by my position in this matter and continue to maintain that he should be fully investigated - including as his activities relate to what is obviously a coordinated campaign to discredit me, undermine my credibility, slander me, etc. He is the perfect accomplice for a man like Leonard Cohen who does indeed employ people to target others he views as threats to his carefully crafted reputation. Ann Diamond was also targeted and slandered by Stephen Gianelli and others on Blogonaut's Law Blog. My sister and her husband were victims of what appeared to be an all-out blackmail attempt meant to silence me. All of this will be addressed in my book "River Deep, Mountain High." See desperate and pathetic article and tactics relating to Cohen's response to my reporting his tax fraud that I was told is criminal. The lengths this man has gone, and continues to go (latest threats issued February 14, 2011 by his rotten lying lawyers)are deranged. As I was not served Cohen's lawsuit, and the proof of service is fraudulent and perjured, I was only able to read the Complaint, his declaration, and other documents, when Jihad Gianelli posted them to Scribd. This same type of internet campaign was launched with respect to Phil Spector. That campaign included the following Blogs: Sprocket's Trial & Tribulations, Michelle Blaine's utterly vile and repulsive blog, the Darwin Exception, and other sites. Mick Brown/UK Telegraph (who benefited by writing a slanderous book about Phil Spector before the verdicts were rendered)aligned himself with these shameless sites. Stephen Gianelli appears to have a crucial role in the Phil Spector trials - setting up personal doubt theories on the internet allowing them to be refuted by some of the trashiest people I have ever encountered in my entire life.

LEONARD COHEN HARASSER UNDETERRED BY $7.9 MILLION JUDGMENT, RESTRAINING ORDERS [UPDATED 6-3-2009]

At age 72 music legend Leonard Cohen was on the verge of enjoying a comfortable retirement funded by what he thought was a generous nest egg,
only to find out that what he assumed was a retirement account balance of some $9 million had dwindled to a sum less than a hundred thousand dollars.

Granted,
 Cohen was not exactly “hands-on” with his finances during the period leading up to this unfortunate epiphany—he spent the 4 years preceding this Suzy-Orman-esque moment on an extended spiritual retreat, and had delegated unfettered control over his financial affairsto what Cohen viewed as a close friend, former lover, and trusted advisor.

After some initial reluctance—but
 after being advised that the tax consequences of inaction (owing taxes on money someone else allegedly made off with) might be less-than-appealing, Cohen, through his Beverly Hills attorneys, sued his former business manager Kelley Lynch, winning a $7.9 million California state court judgment against her in an uncontested default proceeding.

For the record, Lynch now claims that she either was never properly served with the suit or that the multi-million dollar money judgment entered against her “incriminates” Cohen in a scheme that she describes in her frequent blog posts and Cohen discussion board comments as Cohen’s “fraudulent” attempt to cover up his multi-million dollar theft from her.
 NOTE: to cover up what I was told is criminal tax fraud.

In any event,
 Lynch has no intention of attempting to set the judgment aside—preferring to characterize the judgment as Cohen falling into her tactical trap. (As Lynch recently stated about this reporter in an email copied to the IRS, The Justice Department, several high profile criminal defense attorneys who do not represent her, the governor of Colorado and a laundry list of other government and law enforcement officials too numerous to mention here: “What is it about I have no intention of setting the [$7.9 million] judgment aside that [Joff Belark] does not understand?”)NOTE: I intend to sue for theft, wrongful conversion, illegally altering my federal tax fraud via a problematic default judgment, slander, transmitting illegal/criminal K1s to the IRS in my name, etc. I have addressed Jihad Gianelli and others threats to have me arrested when I publicly noted that I was filing a Motion to Vacate Cohen's absolutely fraudulent and utterly perjured lawsuit, declaration, etc.

What the May 12, 2006 judgment does, though, is legally establish the basic truth of Cohen’s core allegations against his former manager: That his financial losses were due in substantial part to Lynch breaching her fiduciary duties to Cohen by, among other things, siphoning off his retirement funds for her own use and mismanaging his estate to generate commissions for herself. (For example, Cohen has alleged that even though he did not need the money, Lynch engineered the sale of all of the rights to Cohen’s songs—generating her a $1 million commission instead of the $100,000+ annual commission she typically earned as Cohen’s manager—which proceeds she then siphoned off for her own use while the singer song-writer was off meditating.)

NOTE: Greg McBowman has confirmed that he flew into Los Angeles to meet with me and Cohen over these asset sales. He personally advised Cohen NOT to sell these assets. Cohen insisted - noting that downloading and the internet were affecting record sales. See Cohen's Declaration in the failed CAK bond deal. He knew precisely what these assets generated. Cohen has willfully committed fraud upon the Court, and others, by attempting to pretend that my intellectual property, ownership interest in numerous entities, etc., were my personal management commission. That is a bald-faced lie and he has now proven that he views himself as the alter-ego of those entities and intentionally defrauded me.

The judgment also contains a finding that every dime previously held by Lynch through several Cohen related legal entities was held in trust for Leonard Cohen, as well as an injunction prohibiting Lynch from exercising any further dominion or control over those assets.

In the words of a Colorado federal judge who last year returned to Cohen $154,000 paid into court by a third party fiduciary in the face of Kelley Lynch’s conflicting claim for the money:

“On May 12, 2006, the Superior Court of California, County of Los Angeles, ruled on the issue of ownership of the funds, and entered default judgment in favor of Cohen and against Lynch in the amount of 7.3 million in damages and interest…In rendering judgment, the California court declared Lynch was ‘not the owner of any assets in Traditional Holdings, LLC’ and any interest Lynch had in ‘any other entity related to Cohen ... she [held] as trustee for Cohen's equitable title.’ The California court enjoined Lynch from interfering with Cohen's right to receive any such funds or property or in any other way exercising control over any funds or property related to Cohen. The California court ruling was not appealed and is now final. [Par.] The final judgment of the California court settles the dispute between Lynch and Cohen over ownership of the [$154,000].”


That settled it, right? Not exactly, in Lynch’s mind at least.

Lynch, undeterred, embarked on an alleged campaign to harass Cohen, as primarily evinced by a restraining order issued in favor of Cohen and against Lynch by a Los Angeles County Superior Court judge.

NOTE: I have documented, since approximately 2005, for the IRS Commissioner's Staff and others, precisely what I have endured since reporting Cohen's tax fraud to the IRS. I have copied in many other parties - such as the DOJ, Treasury, FBI, Phil Spector's attorneys, the news media, and others. This was not a campaign of harassment (unlike Cohen, Gianelli's etc. with respect to me, my family, and others). This was and remains a record of the facts, the truth, the tactics, and the rotten shameless tactics Cohen - and others - have used against me. I have asked the IRS, FBI, DOJ, and Treasury to investigate Cohen's fraudulent lawsuit, the coordinated custody matter, Neal Greenberg's companion piece, the fraudulent and utterly abused TROs, and all issues related to my reporting Cohen's tax fraud to the IRS and being dragged into Phil Spector's sham trials.

At some point along the way, Lynch has stated in various internet posts that she was “kidnapped” by Los Angeles police officers and taken against her will to a Los Angeles County psychiatric facility where Lynch claims she was involuntarily held and drugged pursuant to a conspiracy on the part of Cohen, his lawyers, the Los Angeles County District Attorneys Office, the LAPD, and others to discredit Lynch (who claims to have been a defense witness for Phil Spector in his murder case) and to protect Cohen from Lynch’s allegations that Cohen [allegedly] perjured himself in a “secret grand jury” proceeding in the Phil Spector matter--and that the psychiatric file, as well as the relevant police reports were later altered or substituted by police in furtherance of the alleged conspiracy against her.

I have asked the IRS, FBI, DOJ, Treasury, Phil Spector, his legal team, and others, to investigate why I was taken to Killer King, questioned about Phil Spector, who falsified the entire Killer King file, whether or not Cohen, Lindsey, Kory, Superfon, and possibly others, conspired to have me falsely arrested that day, etc. I have never stated that the psychiatric file as well as police reports were "later altered or substituted by the police in furtherance of the alleged conspiracy against" me. I have stated that I believe the Los Angeles District Attorney had the power and motive to have me taken to Killer King and questioned about Phil Spector.

In approximately 2007, Kelley Lynch moved to Boulder, Colorado
 where she has off and on reportedly been homeless. In addition, as Lynch stated today, and Blogonaut has independently confirmed, Lynch has in her words been “frequently arrested” by the Boulder Police Department (see booking photo, above). [Ed. Note--Lynch denies being homeless in Boulder, see below update, and stresses that a jury acquited her.]

After witnessing a man with his penis out in front of a child (which was and remains my perspective), I was arrested for "obstructing a peace officer" for reasons I cannot fathom. I prevailed on that issue at trial. It was the only charge I was arrested on and therefore the arrest was wrongful, false, etc. This will be addressed fully in my book and it will be litigated.

To be sure, Lynch attributes her arrests in Boulder to the continuing conspiracy to silence her, as she claims in various internet posts—
including an email to the Department of Justice that Lynch published today requesting that the DOJ investigate why she has been "arrested with such frequency" in Boulder.

In 2008, Cohen again took Kelley Lynch to court, this time in Boulder, alleging—as with the earlier issued California restraining order—that Lynch was harassing him.

Cohen appeared absolutely desperate after Ann Diamond posted her draft article for Rolling Stone on her Blog. He legally threatened Ann Diamond at that time and, since then, Jihad Gianelli and others have slandered Ann Diamond.

For the record, Lynch has repeatedly stated that the September 2, 2008 restraining order was “fraudulently issued” after Cohen failed to have Lynch properly served with the petition—even though the official transcript of the hearing reflects that Lynch appeared at the hearing (and after initially asking for a contested hearing and spending a few minutes on the witness stand being gently grilled by Cohen’s Colorado attorney) and requested herself that the court grant to Cohen the restraining order. In fact, the transcript reflects that Lynch told the judge that she "very much" wanted the order to be issued, and that Lynch thanked the judge "very much" after she granted Cohen the restraining order.

Correct. I asked the judge to make the TRO permanent. Cohen presented no evidence; witnesses were not called; and it is impossible that the judge could have ruled for Cohen in that matter. I did indeed thank the judge "very much." After the hearing, I reviewed the file and noted that the process server perjured himself in his proof of service and Cohen perjured himself in his declaration. I addressed all of this in my Motion to Quash.

Lynch--who was contacted by this reporter for comment --also asserted that the hearing transcript is inaccurate, that the court reporter who certified it should "look for another job" and that Lynch would be reviewing the transcript of the hearing "with Bruce Cutler".

"Joff Belark" contacted me and I gave him the facts; directed him to evidence; and he proceeded to write what is one long lie about me - after hearing from Cohen's legal representatives. 

Lynch has also blogged that the Colorado judge who presided over that hearing had no jurisdiction over her because Lynch previously reported Cohen to the IRS for [alleged] "tax fraud”, thereby (presumably) converting all pending and future legal matters initiated by Cohen into “IRS matters”.

I continue to maintain that the judge didn't have jurisdiction over me for a number of reasons: the proof of service is perjured and, as my emails leading up to the fraud TRO prove, I was writing Cohen's representatives requesting a forensic accounting, etc. - all of which relates to my tax returns that must be amended for the years 2001-2010 based on the fact that Cohen illegally altered my federal tax returns in a state court. It seems impossible that a state court would have jurisdiction to alter federal tax returns. I have asked the IRS, FBI, DOJ, and Treasury to fully investigate this matter and have asked the IRS for legal opinions on various matters.

Indeed, Lynch has gone so far as to assert that the judge who issued the restraining order “lied” about Cohen’s routine civil harassment petition not being an “IRS matter”, and that she (the judge) was complicit with Cohen in the overarching conspiracy against Lynch and aided Cohen's [alleged] "fraud". Lynch has also stated the intention to sue the judge--along with other judges in California and Colorado who have ruled in favor of Cohen and against her.

I intend to consult attorneys with respect to the various legal matters I intend to bring. Jihad Gianelli does not speak for me and is in no position to state publicly, or otherwise, what I do or do not intend to do. This situation is also fluid so nothing is set in stone.

That brings this reporter to another key assertion that has frustrated the multitude of internet discussion board commenters who have encountered Lynch on virtually every public on-line forum discussing either Cohen or Phil Spector: Beginning approximately two years ago, when Lynch was first asked by a reporter for comment on the $7.9 million California judgment against her—Lynch’s stock line has been that she is waiting to hear from her attorney of choice Bruce Cutler, and when she has had a chance to talk to Bruce Cutler, she will respond in due course.

I have advised Phil Spector that I would like to call Bruce Cutler to the witness stand. I think that ends this discussion.

The (to many) dubious assertion that a broke and homeless Kelley Lynch has any chance of enlisting a high profile New York City lawyer of Cutler’s stature to sue Leonard Cohen and a host of other declared enemies (including the four judges who to date have ruled against her) and other alleged co-conspirators—including the Boulder Police Department—for alleged violations of the Racketeer and Crime Corrupt Organizations Act (RICO) (and other claims)--has led to serial derision by the message board commenting masses—which derision typically and predictably prompts Lynch to observe that the commenters on this or that blog, or this or that discussion group are all “insane” and/or are “cyber-stalking” her, at which point Lynch typically fires off another email to the IRS and/or the Justice Department—cc to governors, reporters, many of Phil Spector’s attorneys and former attorneys, and dozens of others—demanding that this or that blog or discussion group commenter be “investigated” for claiming that Bruce Cutler will never call her back. (Which, let's face it, after two+ years with no call back is not an unreasonable assertion.)

Jihad Gianelli appears to have contacted Bruce Cutler in an attempt to determine if he continued to represent Phil Spector and in what appeared to be an attempt to infiltrate Phil Spector's defense.

Indeed, just several Cohen fan comments into a discussion formed around a critic's favorable review of a recent Leonard Cohen performance published in the on-line version of the Hartford Currant, Kelley Lynch managed to hijack the discussion on May 13, 2009 by posting her usual scurrilous panoply of unsupported and presumed false accusations against Cohen (e.g., tax fraud, liar, stole millions from me, ruined my life, pervert, perjurer, plagiarist etc. etc. etc.)—resulting in a raging discussion spanning two weeks and over 160 comments—through today. (See link here.) (EDITOR'S. NOTE, ON 6/6/2009, the Hartford Currant, topix.com administrators shut down the discussion board and deleted the posts, it is presumed due to reader complaints about Lynch's postings there.)

I "hijacked" nothing. Jihad Gianelli has confirmed that he heard from Cohen's legal representatives. After that, he relentlessly targeted me, my sons, my elderly parents, my sister and her husband (who hired an attorney to speak with him), my friends, business associates, and others. I asked the Hartford Currant to pull down the slanderous discussion board.

For Cohen's loyal fans, as well as the casual observer, this is almost to much to bear—as many of the passionate foils to Lynch’s provocative and apparently libelous comments about Leonard Cohen demonstrate. Certainly, Lynch’s habit of, when challenged with specifics, accusing the commenter or blog host of “harassing”, "cyber-stalking" or “libeling” her, threatening to sue, then posting a copy of an email to the "Commissioner of IRS" or the "Justice Department" demanding an “investigation” of the commenter or blog—cc to high profile attorneys, governors, DA’s, police departments and reporters—
does little to bolster Lynch’s credibility.

Nothing I have stated about Cohen is libelous. It's the truth. I have also provided the IRS, DOJ, Treasury, FBI, Phil Spector, his legal team, and others, with ample evidence to prove that Cohen has committed tax fraud, etc. 

In addition, the very frequency of Lynch’s email rants to
 the IRS or Justice Department alone (sometimes three or more in a single day), in combination with her eccentric distribution list to many high profile government officials and attorneys (who must have better things to do with their time than investigate the identity of the guy who is posting as “anonymous” on this blog or that comment group or why (in a recent complaint) this reporter questioned why Lynch has been waiting for over two years to “hear from Bruce Cutler”) arguably suggests, if it does not scream, “nutcase”. Not to mention the fact that Lynch has demanded that the Justice Department "arrest" Phil Spector prosecutor Alan Jackson, and has also threatened the entire Boulder Police Department with criminal prosecution as well as a civil action under the RICO statute.

NOTE: I haven't "threatened" the Boulder Police Department. I have informed the BPD that I intend to litigate certain issues. I am not a DA and cannot criminally prosecute anyone and the notion is absurd.

In the interest of full disclosure, the editor of this site recently banned Lynch from commenting here (as have several other websites) after its editor returned from a month long hiatus in Europe to find that this blog’s comments sections following several Phil Spector retrial posts had been similarly hijacked by Lynch through scores of posts—including many that Leonard Cohen’s California attorneys brought to Blogonaut’s attention as libelous per se (meaning Lynch accused Cohen of various alleged crimes without substantiation).

Jihad Gianelli is absolutely obsessed with the Phil Spector trial. I haven't accused Cohen of various alleged crimes without substantiation. I was advised that Cohen committed criminal tax fraud. I know for a fact that Cohen has stolen from me. Steven Machat knows for a fact that Cohen stole from him and his father. I know for a fact Cohen has lied, perjured himself, committed fraud, illegally altered my federal tax returns, issued illegal/criminal K1s to me that were transmitted to the IRS, State of Kentucky, and engaged in other conduct that definitely appears to be criminal and absolutely crosses many state borders. Nothing I've said about Cohen is "libelous per se." It is fact and it is the truth.

This banning led Lynch to, predictably, email the IRS and the Justice Department (cc to the usual multitude of household name Kelley Lynch rant email recipients) and to demand the investigation of this site. Lynch also threatened to sue Blogonaut for disparaging her—an allegation Blogonaut denies.

I absolutely intend to litigate these matters with Jihad Gianelli.

But in fairness to Kelley Lynch, and in aid of you, the internet going public, making up your own mind, we refer you to Kelley Lynch’s blog--where she republishes her rant emails to the IRS, Justice Department, Doron Weinberg, Bruce Cutler, as well as governors, police departments, prosecutors, and others daily—and were her scathing rebuttals to this post are sure to follow. (See here for Kelley Lynch's blog.)

I have never emailed Bruce Cutler. 

As for Leonard Cohen, we observe that he has apparently decided to get on with his life, embarking earlier this year on a critically acclaimed and wildly successful world tour--choosing to stay above he fray of Lynch's ubiquitous, daily allegations with not a single blog comment of his own disparaging Lynch in reply. Class act, Cohen.

Cohen's thug lawyers threatened me, on his behalf, as of February 14, 2011. Why? Because I have attempted to request information I need to amend my federal tax returns for the years 2001-2010. For reasons I cannot understand, Cohen's representatives copied in the IRS, FBI, DOJ, Treasury, Dennis Riordan (who represents Phil Spector), and many others, on their email threats. Steven Machat has noted that Robert Kory is "scum." I have noted that Michelle Rice is, from my perspective, a liar and thug. Leonard Cohen is NOT a class act. He is a lying con artist, fraud, and thief. Cohen hides behind others. He employs others to target people on his behalf. I know. I worked with him for approximately 20 years and have studied him carefully. That will be thoroughly addressed in my book River Deep, Mountain High.

In keeping with her status on this site, we will not publish any of them in the comments section here. (As expected, she has vowed to publish all five comments on her blog, and we expect her to submit additional comments as she stews over this post.)

EDITOR’S NOTE—Cohen has never been accused by anyone, except Kelley Lynch, of “tax fraud” and we note that despite Lynch’s hundreds of communications over several years to the IRS reiterating that assertion, Cohen has never been arrested, indicted, or charged by any agency with any crime. Not only wasn't I served Cohen's lawsuit; did not read the allegations until April 2010 when Gianelli posted them on-line; I was clear with Cohen and his legal representatives - I do not participate in fraud and I do not participate in what I believed to be an attempt to cover up criminal tax fraud or to obstruct justice. 

“The jury found that I did not obstruct a peace officer so draw your own conclusions. That is what I was charged with. Apart from that-it is none of your business...I have never been homeless in Boulder..."

The participants in the organized campaign of slander, witness tampering, cyber-terrorism, cyber-bullying, etc. now proceed to further slander me, defame and libel me, attempt to discredit me, and generally engage in conduct that has played out across the internet with respect to me, Phil Spector, members of my family, Rachelle Spector, Phil Spector's legal representatives and experts, and others. I do not have any psychiatric problems. I do not have an alcohol problem. I do not do any drugs - whatsoever. And yet, absolute strangers have taken to the internet to lie about me. I think their motive is overwhelmingly obvious.

Where was Cohen's attorney during all this?? Reminds me of Paul Stanley (of the rock band Kiss) being taken to the cleaners by his psychiatrist - as was Brian Wilson of the Beach Boys - and let's not even go into Elvis and the Colonel, or Britney Spears and Osama Lufti.

Of course a Judge cannot be sued for his/her ruling, but what is really scary is that Ms. Lynch thinks she can, and that there is this huge law enforcement conspiracy trying to destroy her - when there is not exactly a mutual meeting of the minds philosophically, politically, or artistically between Leonard Cohen and law enforcement.

Ms. Lynch, with the deepest of respect for your intelligence and accomplishments, you will see wonderful results at the University of Colorado's school of medicine's psychiatric division. It is among the best in the nation for treating people. My sincerest best.

She fumed for weeks when she was banned from this site in May--and we never identified her by name at the time. (She then identified herself in a half dozen blog posts as the banned commenter.)

We also expect to be "reported", again, to the Commissioner of the IRS, The Justice Department, the Governor of Colorado, Bruce Cutler etc. etc. etc.

I suspect they've tried already, and it didn't work. Any AA members here? It seems what we're dealing with here, aside from any of many possible psychiatric profiles, is the typical mind of an alcoholic. I.e., as in living in a certain famous river in Egypt. Resentful, keen on everyone else's faults, blind to her own, has lost everything -- home, job, family. I've heard this story told a thousand times at meetings.

At this point the options are basically:

(i) the nut house
(ii) more visits to jail
(iii) death,
(iv) *voluntary* recovery. There is no such thing as involuntary or accidental or self-willed recovery BTW.

One alcohoic's opinion, for whatever it is worth.

I have to say that yesterday when I saw the picture of Leonard Cohen and your glowing tribute to him, I figured that the Lynchness monster was going to really rear her ugly head and take over the blog as she did while you were vacationing. I am glad to hear that you have blocked her. It seems strange though if she stole all that money why is she not in prison, did she get arrested for any of the alleged thefts of Mr. Cohen's money?

She can't stand other blogging sites as we can tell from her psychotic rants. She hates being outted for all her lies even more. She has the overblown sense of self. Narcissist much?

She can copy and paste all she lies. Doesn't scare me. She's all talk and lies.

Now the next step is to get her taken off the streets and the net for good. I have reported her to the Boulder PD and Cohen's attorney before it is too late for someone else.

Kelley Lynch has just tried to submit yet a sixth rambling comment on this site, claiming among other things that the comment posted by an alcoholic is a “death threat to her because Lynch is not an alcoholic and she therefore does not need to recover from that. (Even as she submitted the comment she inconsistently claimed (in the comment) that she had not tried to submit any comments—we have given up trying to follow Lynch’s logic.)

We disagree with her reading of the alcoholic’s comment as a “death threat”. We view it as sincerly expressed opinion and advice. (If unsolicited.)

We would add that we do not know whether Ms. Lynch does or does not have an alcohol problem, but would note that a source informed us that some of Lynch’s Boulder arrests were “alcohol related.”

In any event, Lynch has made it clear that she has no such problem and has publicly stated that her “frequent arrests” (her words) in Boulder were the result of a police “set-up” and nothing else—as was her “kidnapping” and transportation to a psychiatric facility in Los Angeles as was her second involuntary psychiatric hospitalization by Los
Angeles police described in an article that Lynch has often posted as a “good, basic version of events”.

I don't support Phil Spector, and although he doesn't get empathy out of me, after learning Ms. Lynch has harrassed Cohen and even Spector, I strangely feel very sorry for Spector and his team to have to endure all this nonsense. And of course, respectfully, Mr. Cohen and all his fans too.

Which leads me to my next question. If Ms. Lynch harrassses Mr. Cohen's fans, has she harrassed Phil Spector's fans too?
Anyone out there know?

Ms. Lynch, we will never post another comment by you on this site--you are wasting your time and ours.

NEWS FLASH: Doron Weinberg and Dennis Riordan are not interested in whether Blogonaut is lying when it is claimed that you persist in attempting to post here. If they were really reading your daily rants, they would have to bill Phil Spector several hundred dollars a day just to keep up with your prolific correspondence.

Doron Weinberg and Dennis Riordan have never publicly advised anyone that they were not interested in whether Blogonaut was lying, etc. They also have not privately advised me on that topic. Whether or not Phil Spector pays their bills to read my emails is no one's business - least of all Jihad Gianelli's since he doesn't know me or Phil Spector even though he is absolutely obsessed with us.


Trust me, that is not happening.

Nor are we anymore interested in your rant emails than Weinberg, Riordan, Cutler, the Commissioner of the IRS, the Justice Department, the Governor of Colorado, Alan Jackson, or the many other people you harass with your unsolicited emails several times daily.

The IRS, DOJ, Treasury, and FBI have not advised anyone publicly that I have harassed them. The FBI has contacted me, privately, on numerous occasions - including in emails which I refuse to post - and has not advised me that I am harassing them. I do, however, believe that Cohen and many others have wasted resources the federal government could better use elsewhere - for instance fighting corruption, terrorism, etc.

A driver, who rear ends her causing her to break her nose, takes off, and when she drives back up the hill to return home the same driver is standing in his driveway and calls out “we are watching you”?

But when she gets home the 911 operator is told that there has been a drug overdose and/or a domestic violence incident, and Lynch is carted off (again) to a psychiatric facility?

What is wrong with these perceptions?

Let's be honest, if the Lynchness Monster ever receives a bone (hell even a crumb) from Cutler, Whineberg, Riordan, DOJ, IRS... we'll all know about it. She won't be able to help herself--she'll copy the emails to her blog and transcribe (accurately?) any voicemail messages she gets from the people she thinks can help her.

She's totally deluded if she thinks any of Phils attornies or the Feds read her rants--the closest her rants get to the Feds are their spam filters.

We strongly agree that sincerely suggesting that someone might benefit from alcohol treatment and laying out some very unattractive alternatives to treatment is not a “death threat”. Naturally, though, Lynch is so resistant to the idea that she might need alcohol treatment she has written to the Department of Justice (or the IRS—who can keep track of her attempted posts + emails—more than a dozen yesterday) claiming that the commenter here has threatened her life and is trying to intimidate her as a “witness”.

OF COURSE, any theoretical utility Lynch might have had as a witness evaporated in the eyes of the IRS, US Attorneys Office (and everyone else) after her first few hundred rant emails, cc to the world. Several thousand rant emails later,
 she is useless to anyone as any kind of credible witness—including Phil Spector or the IRS. NOTE the recurring theme and motive.

OF COURSE, there has to be a proceeding pending in which you might testify to be considered a witness, and (apparently) the IRS never found enough credence in Lynch’s assertions of tax fraud to ever file a case against anyone. (Certainly if they have not done that in five years, it is not going to happen—much like whether Bruce Cutler is going to call.)

We have also received interesting and additional information in the last 24 hours that Lynch’s problems may be more related to chronic alcohol abuse than psychiatric in nature.

We have been informed that her ex-husband, Steve Lindsey, tried to get her into an alcohol treatment program before her life imploded—without success. Any alcohol counselor will tell you that if family members think you have a problem with alcohol, you probably do.

Similar to a source who told us that some of Lynch’s run-ins with Boulder police started as alcohol involved inter-personal confrontations, we have heard a story dating back to when Lynch lived in LA involving an alcohol fueled confrontation in a karaoke bar, where her friends extricated her just before the police were called by security guards. Our tipster, who wishes her well, told us “That is fairly typical alcoholic behavior, by the way.”

We do not mention this information to gossip about Kelley Lynch but only to point out that the genesis of her problems may be more complex than assumed by some, and may in fact stem from years of alcohol abuse and the self deception that goes along with that—rather than some major psychiatric condition—as the recovering alcoholic commenter pointed out yesterday. Sometimes it takes one to know one.

And, of course, even if her ex-husband was a jerk, and Cohen wrongly placed his financial issues at her feet, normally marriage and professional setbacks don’t result in serial psychiatric commitments and a transient life on the streets--absent other issues. Which history is also consistent with, as one source described, “drinking that was of the binge variety”.

One former friend told us: “[Lynch] has slowly destroyed whatever meaningful relationships remained in her life, one drunken tirade or one big deception at a time.”

By the way, the people who have contacted us from Lynch’s past life care about her, hate to see Lynch fighting her own problems by projecting them outward, and hate to see her being demonized in various internet chat rooms. Her friends just want her to get help for her addiction to alcohol but point out that she is very stubborn and believes that her spirituality—which they say is real—has convinced her that she is exempt from having a serious problems like alcohol.

It is hard to be compassionate in the face of Lynch’s slanderous invective—not to mention her sheer meanness (she once wrote on her blog that Lana Clarkson’s mother was “skanky”). But we do hope that Lynch gets the treatment that she obviously needs.

Lets all try not to demonize her and realize that she has some very real issues and problems.

I believe that KL is a very intelligent person that is misguided by her personal demons, we all know somebody like this, has everything and self implodes and makes everyone else miserable and frustrated. However, she did make some rational and compelling arguments that Phil Spector did not murder Lana Clarkson, based upon forensics and their size differences,that I agree with.
I'm sure that you have graciously e-mailed her and extended to her that her friends do care about her and that her time would be better spent taking care of her personal issues, rather than blogging incessantly about nonsensical minutia.

As a former substance abuse counselor and family counselor, I would have to agree that a lot of Kelley's behaviors suggest at least some kind of substance abuse - alcohol or something else. However, when assessing an alcohol/drug problem, one must look at all the presenting problems and decide which one is primary. Lots of times, an alcoholic's behaviors are more serious and dangerous than the alcoholism itself. That, I believe, is the case for Kelley. If she simply stopped drinking (if that is indeed a problem), her psychosis could become life-threatening, either to herself or to others. That's when an involuntary commitment would be appropriate. As for her current state of mind, any intervention would have to begin with ignoring her anti-social behaviors and refusing to give in to her demands for attention. There are any number of psych diagnoses that would fit her behaviors as shown on her web postings - schizophrenia, obsessive/compulsive, anti-social personality disorder, or borderline personality disorder. Based on what I have read about and by her, borderline personality disorder would seem to fit her best. This is not a diagnosis by any means, as making a diagnosis without first hand observation of an individual's behavior would be an injustice.

See, I knew she was watching this blog. Of course she won't admit it. She never admits to a thing. I have no sympathy for cyber terrorists which is exactly what she is. You can deny it all you want Kelley, at the end of the day you will have to pay the price for being a raging alcoholic, neglecting your children, harassing people every single day of your life, all your slander, all your lies about Phil and Lana, the judgement you refuse to pay back and for ripping off the tax payers. Did I leave anything out?

Might I suggest we not listen to Kelley anymore. Ignore her rants and raves. I have a theory that if we keep feeding her, she will not go away. She loves this attention and gets off on it.
It only fuels all that hatred she has living inside her.

Maybe we should just give Kelley a break and let her catch her breath and think or re-think her behaviour, we have not heard from her for a while, maybe she is reflecting??? I would really like to be kind to her, but it is VERY hard since she is so full of venom and hate. I can't help to think of the enormous difference between the affect she and Leonard Cohen have on people. When you have been in a room with Leonard Cohen for just a short while you walk away really feeling that you want to be a better person, when you have been in "cyberspace" with Kelley for a few minutes, you feel mean and nasty. How sad it must be for a person to always make others feel that way.

Sadly, we have heard from Kelley Lynch in response to our offer to help her get back in touch with former friends in Los Angeles and into rehab.

Here is her reply, verbatim:

“I'm in touch with my kids and know precisely how they feel. In fact, I've copied Rutger in on this email. I have no alcohol problem BUT if I was in a fucking bar brawl that doesn't change the fact that Cohen committed what I was told is criminal tax fraud, ripped me off for millions, illegally made me a partner on LC Investments, LLC, targeted my children, had his lawyer file a declaration in my son's custody matter, ripped off Marty Machat, probably perjured himself in Phil Spector's matter.

“I have no friends in Los Angeles. My friend there is Phil Spector. If you've been in touch with Superfon let her know that I will ask Bruce Cutler to address the fact that she was negotiating for me - without my consent, approval, or awareness - with Cohen. Peter/Jacob Falconey impersonated a federal agent - that is a crime from what I can tell. Steven Clark Lindsey has a gambling habit and was addicted to vicodin. He is also an abusive man, who took my gun, may have two strikes against him, and is a pathelogical liar who asked Rutger to go in and sign over/transfer/sell my house to Cohen/Kory while I was en route to Killer King being questioned about Phil Spector.

This is what makes legal entities nervous. I certainly hope the law offices of Weinberg; Riordan; and particularly Bruce Cutler have this photo posted for their receptionists to see.

It would also behoove each of these legal entities to have a specific plan of action if she were to enter their offices.

Some legal entities only allow entry upon recognition or validation of identity before a person is allowed to enter the premises.

We have asked an attorney to contact Bruce Cutler regarding Kelley Lynch’s threats to investigate and sue this blog thorough his office (and to concurrently sue Leonard Cohen, the LAPD, four state and federal judges, the Boulder PD, etc.).

As for whether Mr. Cutler is aware of some of Kelley Lynch’s creepier post about him (i.e. that she her fantasy is to have sex with him, and yesterday, that she wants to “marry” Cutler) we have no idea.

For obvious reasons, as well as some very specific information from a source, we very much doubt that Bruce Cutler has ever talked to Kelley Lynch, let alone agreed to represent her—but we will see if Mr. Cutler responds to our counsel.

We also do not believe that Kelley Lynch has ever spoken directly with Doron Weinberg or Spector appellate counsel Dennis Riordan (let alone secured their agreement to represent her).

Jihad Gianelli has no idea who I have spoken to and that includes Doron Weinberg and Dennis Riordan. He also has no idea who I have spoken to about representing me. Jihad Gianelli doesn't know me.

We would parenthetically note that if, as has been reported, Phil Spector is selling his Alhambra residence to fund his continuing legal fees, it is unlikely that Weinberg-Riordan have agreed to represent Kelley Lynch without cost to her or that they are billing Phil Spector a combined $1,000/hour to keep abreast of Lynch's prolific written communications to them and to others (cc’d to them).

It's now 2011 and Phil Spector hasn't sold his home in Alhambra.

Between the email account of the author of this post and attempted posts by Kelley Lynch yesterday on this blog (many of which were cc’d to Weinberg-Riordan—not to mention the IRS, the Justice Department etc.)—we counted over 40 written communications from Lynch since June 3, 2009.

Among them was a communication from Lynch stating “Tell my ex friends, many of whom were pathological liars, that I said rot in hell.”

I am sure that the former friend of Kelley Lynch who contacted this blog at 12:41 PM yesterday to relate that Kelley Lynch has a booze problem, that he hates to see her demonized by blog commenters, and that he hopes she can get into treatment will appreciate the sentiment.

Kelley Lynch writes in one of her many posts (I am losing track) that Leonard Cohen BRAGS about his use of prescription drugs. It is very true that Cohen has been public about his use of drugs for depression and also that he at times drank too much alcohol, that he had too many casual relationships and that he was not always as good a Father to his children as he should have been. All this was part of the reasons that he went to "Mount Baldy" to try to get some order into his life, and he certaintly did, I believe he has become the man he always wanted to be, maybe it just took a little time to get there, but he was NOT BRAGGING about his use of drugs, he was being honest to himself and to the world around him, trusting that people would still love him and WE DO.
Being honest to herself and the world about these problems is something Kelley can or will not face, and that stinks, most of all for Kelley, but also for people who know she could shine if she was just willing to let go of her stubborn hate.

To Phil Spector, while you may have met him through your ex-husband, you do not exist as any kind of person that is in any way significant to him. To Cutler, Weinberg, and Riordan you are just another nut case (although to be sure a persistent one) that high-profile cases and celebrity seem to bring out of the wood work.

I did NOT meet Phil Spector through my ex-husband. Actually, the DA's office received an anonymous tip about my friendship with Phil Spector. Many people, including Steven Cron (an attorney who represented me), are well aware that I did not want to be dragged into this sham nightmare. I also advised the DA's office, after they advised me that I was probably a witness, that I would take the 5th amendment based on their conduct towards me which was and remains unconscionable governmental conduct.

As has been said here: Your 15 minutes are up.

You may now return to drinking heavily, talking to imaginary people at the bar, and waiting for Bruce Cutler to call.

Bruce Cutler has been a NYC criminal attorney since day-one.

Raised in Flatbush, Bruce attended Poly Prep and Hamilton (where he wrestled and played football) before moving on to Brooklyn Law and starting out as a Brooklyn assistant district attorney. In 1981, Cutler switched sides and went to work for noted criminal defense attorney Barry Slotnick.

He went out on his own five years later and soon became a household name thanks to his role as John Gotti's defense attorney during the late 1980s and '90s. In all, Cutler won three acquittals for the Mafia don—it was largely thanks to Cutler that Gotti earned the moniker the "Teflon Don".

Cutler, aside from the his FORMER role as *lead* Phil Spector defense counsel, Cutler is not known to take cases outside of his native NYC, nor is he known for civil litigation work.

I am an attorney. On June 5, 2009, I faxed and telephoned Bruce Cutler to inquire about Kelley Lynch.

I just got off the phone with attorney Bruce Cutler.

He told me point blank that he does not represent Kelley Lynch, that he will never represent Kelley Lynch, and that Kelley Lynch leaves 10 to 15 unwanted voice messages a day on his office voice mail system—which he wishes she would stop doing.

Mr. Cutler passed on the request that Kelley Lynch stop contacting him and stated that this is the most egregious case of "phone stalking" he has been personally exposed to.

All Mr. Cutler wants is for Kelley Lynch to leave him alone.

We asked our attorney, Stephen Gianelli, to contact Bruce Cutler (who called our counsel today) and our attorney has also corresponded with Kelley Lynch directly to pass on Bruce Cutler’s request that she leave him alone.

Mr. Gianelli also informed Mr. Cutler about Ms. Lynch’s recent blog posts about him.

Mr. Cutler was not amused, and reiterated that he simply want Mrs. Lynch to STOP CALLING HIM.

(His office previously informed Mrs. Lynch’s (then) employer that if she continued sending Mr. Cutler unsolicited daily 40 page faxes then they “were going to have a problem”. The faxes stopped the unwanted, harassing voice messages did not.)

We reiterate, all Bruce Cutler wants is for Kelley Lynch to leave him alone.

My June 5, 2009, telephone conversation with Mr. Cutler was an extend one. I did inform Mr. Cutler that Ms. Lynch has posted on her blog that she wishes to have sex with Mr. Cutler and recently posted that she wants to marry him.

Cutler was appalled.

He sublets office space from a “beautiful law firm” who at one point called Kelley Lynch’s office to complain about the multiple 40+ page faxes she was sending every day to Cutler. (This must have been during a period of employment for KL.)

Cutler told me that the faxes stopped but she still “leaves me ten to fifteen lengthy voicemail messages every day”.

Cutler told me that “this is the worst case of telephone staking you could imagine.”

Mr. Cutler told me that he does not know Kelly Lynch and assumes that she is a “disturbed individual” and was completely unaware of what connection, if any, she may or may not have had to Phil Sector or as a witness. He made it clear that “I do not know this woman.”

He asked that I publish the fact that he does not represent Kelley Lynch, does not know Kelley Lynch, will never represent Kelley Lunch and wants Kelley Lynch to stop trying to contact him.

I did not insult Bruce Cutler by asking if he wanted to marry Kelley Lynch; it was made clear that he views her as a disturbed person who is a stranger to him and has been staking him.

Mr. Cutler just wants her to go away.

My conversation with Mr. Cutler was extremely cordial—although he is clearly distraught over Ms. Lynch’s long term harassment of him, which has gone on since he became Phil Spector’s first lead trial counsel over two years ago.

Kelley Lynch is under the impression that Mr. Cutler may still represent Phil Spector, but Mr. Cutler reminded me he withdrew as Spector’s counsel during the first trial and no longer represents him—and has not followed the case closely since withdrawing.)

By the way, I emailed Kelley Lynch to advise her that Mr. Cutler does not know her, is not going to represent her, and feels he is being harassed by her daily voice messages.

Kelley Lynch emailed back suggesting my account was “fraudulent” and said that until she listens to a tape recording of my telephone conversation with Mr. Cutler, she will never believe I talked to him. (We do not record our telephone conversations with other lawyers.)

Kelley also sent me 10 long email messages in half an hour, coupled with her inconsistent demand that I not contact her anymore. (My office has nothing more to say to Kelley Lynch anyway—and I am going to add Lynch to my blocked senders list.)

It would seem a matter of common courtesy and common sense that if an attorney does not know you and you have not retained him, that leaving 10 to 15 voice messages a day on his office message system for over two years (without a single call back) would be viewed as unwanted and harassing—even if Mr. Cutler had not so advised me.

Lynch’s recent demand that others inquire if Mr. Cutler wants to marry her is further proof that she crossed the line from persistent would be client to disturbed stalker a long time ago.

Signs and symptoms of paranoid schizophrenia may include:

Auditory hallucinations, such as hearing voices
Delusions, such as believing a co-worker wants to poison you
Anxiety
Anger
Aloofness
Violence
Verbal confrontations
Patronizing manner
Suicidal thoughts and behavior

She certainly displays most of these symptoms, if not all.

Based on unpublished comment from those who knew her in Los Angeles (and told us they hope she gets treatment), Kelley Lynch's bizarre behavior, hostility, meanness and delusions have their genesis more in long term alcohol abuse than mental illness.

Sources also tell us about fighting behavior that is alcohol related, including arrests in Boulder, Colorado.

But what ever the cause of her problems, it is also clear that Kelley Lynch knows very well what she is doing and (in Cohen's case) is motivated by anger and revenge for grievances (real or imagined).

Obviously, Lynch leaving 10 to 15 daily voice messages for Bruce Cutler (who she has never met) and also posting that she wants to have sex with him and to marry him is completely insane; Stalker stuff.

Maybe, but possibly also just alcohol-related. Late adult onset schizophrenia is rare, and to all evidence Ms. Lynch's mental illness is just a continuation of a personality disorder that was there all along. If that disorder was always paranoid schizophrenia it would probably have prevented her from having long-term career success.

All of the symptoms listed above are common enough amongst recalcitrant, formerly high-functioning alcoholics. Therefore alcoholism may be a crucial factor in addition to an underlying disorder.

Given the relative rarity of late-onset paranoid schizophrenia, a dual diagnosis that takes alcoholism into account might rather indicate bipolar schizoaffective disorder and/or antisocial personality disorder. The prognosis in those cases is better than that of full-blown schizophrenia, that is if the alcoholism is treatable first.

Kelley's hopes and dreams of a professional collabroration, sex and marriage with Bruce Cutler (the last two points may be a weird sense of humor) been chrushed, she has been banned from all her outlets for her hate, but knowing "our" Kelley, she is not going to stand for that. In any event, Leonard Cohen already has capable counsel based in Beverly Hills.

Point of clarification: Kelley Lynch is the one who has been purporting to have Bruce Cutler "investigate" and sue this blog in post after post.

We simply called her bluff and ascertained that Cutler had no intention of ever representing her.

This does not make us guilty of "obstruction of justice, witness tampering, terrorist threats, slander, libel, defamation, etc." as Ms. Lynch claimed yesterday in her one of several rant emails to "the IRS Commissioner's Staff, the Department of Justice, Agent Sopko, Mr. Weinberg, and Mr. Riordan", cc to others in law enforcement.

Nor does it mean that Bruce Cutler is taking sides in any of Ms. Lynch's controversies.

Famous forensic scientist Henry Lee sent an e-mail to the Times last night blasting accusations he kept evidence from prosecutors. "I have all the documentation and records pertaining to what I did and what I collected at the scene," he said. "If necessary, I can and will make it public to protect my good name and my professional reputation." Lee testified at a hearing before Judge Fidler ruled last week Lee did not turn over a fingernail-sized object to prosecutors. Deputy D.A. Patrick Dixon said the item was a piece of Lana Clarkson's fingernail, blown off by a bullet when she put her hand in front of her face to defend herself. It could show she did not shoot herself, Dixon said. Prior to sending the e-mail last night, Lee had not responded to requests for comment from the Times.

Text of statement from Dr Henry Lee: Dr. Henry Lee is currently traveling abroad on a lecture tour in Italy. He has made the following statement regarding the recent slanderous and incorrect news reports of him removing and withholding evidence related to the Spector case. “1. Numerous police officers, detectives, crime scene investigators and forensic scientists from The Los Angeles County Sheriff’s Department and L.A. Coroner’s Office conducted detailed searches of a small area in the foyer of Mr. Spector’s house on February 3rd and 4th, 2003, for about 38 hours. It is impossible for that large of a group to have missed a fingernail or a tooth. Dr. Michael Baden and I arrived at Mr. Spector’s house at approximately 9:00 pm on February 4, 2003, after the police had left and released the scene. 2. One prosecution witness, a former L.A. detective, accused me of finding a red-colored fingernail and putting that nail in my handkerchief. A second witness said Dr. Baden and Sara Caplan found a tooth and took it from the scene. Sara Caplan said that I found a white-colored object, similar to a fingernail-size object, and subsequently placed that object in a test tube. There are obvious and major discrepancies related to conflicting observations among the witnesses. In addition, there is no evidence that anyone involved in this case lost a fingernail. Lana Clarkson only has a small chip on one of her cream-colored, acrylic artificial fingernails. The minute size of a potential chip and the color of her actual nails are completely different than what the witness said about the alleged fingernail located at the scene. 3. As I stated several times before, I did not find a fingernail nor did I take any fingernail-like material from the scene. What I found was two small bundles of white thread-like fibers imbedded in blood. These two pieces of fiber were documented in my notes and photographed before and after collection. The materials were packaged, labeled and sealed in an evidence bag. Copies of my notes and photographs were sent and reviewed by four sets of defense lawyers and members of The Los Angeles District Attorney’s Office over the past four years. What I have collected, the so-called “evidence” from a “released scene” has also been turned over to The L.A. County Sheriff’s Crime Laboratory for examination. My original notes, photographs and even the negatives were all given to the L.A. District Attorney’s Office. There is no basis whatsoever for anyone to accuse me or Dr. Baden of concealing evidence in this case. 4. I do not know why my Chinese accent has become an issue in this case. I am proud of my heritage and certainly see no relevance between it and the matter at hand. I have always believed that our justice system is committed to seeking the truth and all of the relevant facts. The fact remains clear that there was no fingernail at the scene. It is clear the motive for this slanderous attack is a tactic to kill the messenger before the message is delivered. I have all the documentation and records pertaining to what I did and what I collected at the scene. If necessary, I can and will make it public to protect my good name and my professional reputation. I have also contacted my personal attorneys to look into the legal issues regarding these unjustified, slanderous, false accusations, and the damage that I will likely incur as a result of these unjust misrepresentations.”

A Times editorial on the credibility of defense experts wrongly assumes that scientists working for the other side operate without bias.

The Times' March 29 editorial, "Spector — and expert witnesses — on trial," in which you raise questions about the credibility of expert witnesses retained by criminal defendants, and particularly Phil Spector, is disturbing not only because its timing suggests an intention to influence public opinion while the Spector jury is deliberating, but more importantly because it betrays a misunderstanding of the real workings of the justice system. It also inexplicably ignores the findings reached by the National Academy of Sciences, the nation's most prestigious scientific organization, in a study of the dismal quality of work produced by crime labs throughout the United States -- a study on which The Times reported in February.

To begin, crime labs are organized and directed by law enforcement agencies, and the "experts," or scientists, they employ are paid law enforcement agents. The result, as the study found, is that scientific objectivity is routinely sacrificed to the perceived needs of law enforcement. The study supplies several hundred -- and the Spector case more than a dozen -- examples of crime lab scientists tailoring their findings, or even fabricating them, to fit the theories of police officers and prosecutors.

Yet juries are routinely convinced -- as apparently is The Times -- that these scientists are simply public servants doing their jobs without bias.

But the bias is pervasive. As the Spector record reveals, from the moment police officers and their scientist experts arrived at the scene, they alone determined what evidence was significant and what was not, what evidence should be tested and what should not, and what evidence should be seized and what should not. The seized evidence was then tested, retested, analyzed and reanalyzed in the Los Angeles County Sheriff's Department crime labs for 18 months.

As the prosecution "expert" witnesses admitted at trial, no expense was spared: Every test, experiment or analysis that was proposed was undertaken. The prosecution's DNA expert alone spent more than 800 hours in his efforts. The sheriff's chief criminalist could not estimate how many hours or public dollars she had spent, because no one had required her to keep any records, but she proudly asserted that she had spent months just on the examination of every square inch of clothing seized as evidence.

The L.A. County coroner admitted that in addition to undertaking every conceivable test and analysis, his office held meetings involving doctors, criminalists, sheriff's crime lab personnel, sheriff's investigators and representatives of the Los Angeles County district attorney's office to determine whether the death of Lana Clarkson could be declared a homicide even though the medical evidence could not support that determination.

Nonetheless, in September 2004, more than 19 months after the death, Spector was indicted. At that point, for the first time, Spector and his representatives were given access to the prosecution's "scientific evidence."

What is it that The Times suggests he should have done at that point? Is it your suggestion that law enforcement's scientific evidence is nonpartisan and should not be challenged? Is that what the presumption of innocence directs? If not, what alternative does a defendant who maintains his innocence in the face of arguably partisan forensic evidence have? The only choice is to find independent forensic experts to challenge that evidence.

Unlike the prosecution, a defendant retains experts and pays for their time and effort. But as soon as he or she does that, prosecutors such as those in the Spector trial, abetted by your editorial writers, discount those witnesses for the fact alone that they have been paid.

It is true that one of Spector's experts received about $181,000 for his work over four years and two trials. But there can be no doubt that several times this amount in public funds was spent just on the work and support of the prosecution's chief criminalist.

A fair, objective, evenhanded approach to this issue should not have identified retained defense experts as the problem. One doesn't have to be a member of the Spector defense team, as we are, to recognize that.

Leonard Cohen, who appeared to grow increasing disturbed by the truth - including over fact that I reported his criminal tax fraud to the IRS and over Freda Guttman's allegations that he molested his daughter, legally threatened Ann Diamond over a truthful accounting of the facts between the two of us (and as they relate to his shameless appearance in Phil Spector's matter). At this precise moment in time, he took the extraordinary step of flying into Boulder, Colorado - falsely accusing me of numerous things, which caused people to assume that he was insane. It certainly seemed that way to me. That's why I personally asked the judge to make the fraudulent restraining order permanent. I viewed it as just one more attempt, on Cohen's part, to prevent me from successfully communicating with him about the forensic accounting I've requested consistently since 2005 as well as amending my federal tax returns that he fraudulently and - no doubt - illegally altered with his fraud lawsuit, perjury, and highly problematic default judgment. I suppose that's why he then had to employ others to slander me on the internet, target me, my sons, family, attempt to blackmail my sister and her husband, and it goes on and on ad nauseum. His threats with respect to me continue as well.

Whatever Happened to Kelley Lynch?
 

Kelley Lynch is the woman accused in 2005 of skimming millions from singer Leonard Cohen’s retirement fund. I knew of her through friends of Leonard Cohen, and had heard her described in glowing terms as the agent who, singlehandedly, saved Cohen’s career in the 1990s.
 

In early May of this year, Lynch suddenly contacted me. She said she was mainly interested in my perceptions of Cohen as a former friend and next door neighbour in Montreal. At one time I also studied with his Zen Master in California, and had spent time with him on Hydra, Greece.

Not having heard her side of the story (I doubt that anyone has, apart from a circle of her closest friends), I was curious. Over the next few weeks, she shared several documents pertaining to the case including an affidavit written and signed by her older son, Rutger.

Together, they paint a picture very much at variance from the sketchy media image of Lynch as a reckless, delusional woman on the brink of a career meltdown. Lynch's own timeline also includes disturbing behind-the-scene dealings that suggest she may have been set up to take the blame for Cohen's tax situation.

The following account is based on what Lynch has sent me --

Since 2005 when she became the object of media gossip, little if anything has been heard from Kelley Lynch.

A single mother with two sons, Lynch was Leonard Cohen's personal manager from approximately 1988 to 2004, and was known for her skill, hard work, and dedication. Until 2004, Kelley lived and worked in Los Angeles where she still has many friends and acquaintances in the entertainment world including Phil Spector and Oliver Stone.

Her own account of the events that wrecked her career, varies widely from the media portrait of a reckless, delusional woman in the throes of a personal meltdown. The meltdown was real, however. By late December, 2005, Lynch had lost custody of one son and was homeless and living on the streets with her older son, Rutger, who witnessed the chain of bizarre events that had begun a year earlier.
 

In 2004, Lynch owned a house in Brentwood, and still worked for Cohen, who owed her money for royalties and other services, but was increasingly involved with his new girlfriend, Anjani Thomas, ex-wife of Cohen’s attorney, Robert Kory.
 

In retrospect, Lynch believes she was set up by Cohen’s lawyers and accountants to help cover up a tax situation which made the IRS “nervous.” In November 2004, Cohen’s attorney Kory told Lynch that a financial entity known as Traditional Holdings, LLC could be overturned by the IRS. Lynch, who had been selected as a partner on the entity, became uneasy and consulted a new accountant, who referred her to tax lawyers, who found irregularities in Cohen's tax history, both in the US and Canada where he has residences.

Rattled by what she was hearing – that she was being dragged into criminal tax fraud -- Lynch called the IRS in Washington and also contacted their website. An IRS collection agent advised her to call the Fraud Hotline, which she did.

Told that any further action on her part might implicate her in fraud, Lynch refused to meet with Cohen or turn over the corporate books. At that stage, Cohen’s advisers began claiming that certain payments, distributions, or advances made to her were actually "over-payments." Lynch says their accounting was incomplete and ignored her share of intellectual property, unpaid commissions and royalties, and share in Traditional Holdings, LLC. Apparently Lynch had also been issued K1 partnership tax documents and made a partner on another Cohen investment entity, LC Investments, LLC, without her permission or awareness.

Lynch says an increasingly nervous and desperate Cohen was pressuring her to agree to mediation and told a friend of hers that Lynch was "the love of his life." She and Cohen had had a brief affair in 1990, but Cohen now was offering her 50% of his "community property" as well as "palimony" through lawyer Robert Kory at a meeting attended by Lynch's legal representatives and her accountant, Dale Burgess. To Lynch, none of this made sense at the time.

Meanwhile, the Los Angeles District Attorney's office received an anonymous tip informing them that Lynch was a friend of producer Phil Spector, whom Lynch maintains is innocent. Cohen, on the other hand, had given an interview in which he described a gun-waving Spector who threatened him during recording sessions in 1977.
At around the same time he was offering her “millions”, Lynch says, Cohen was also circulating slanderous stories about her. She believes Cohen encouraged Los Angeles record producer Steve Lindsey, the father of her son Ray, to initiate a custody suit – on May 25, 2005, the same day a 25-man SWAT team from the LAPD, acting on a bogus 911 call, suddenly cordoned off her street and surrounded her home in response to a "hostage taking."

Earlier that morning, Lynch says, her 12 year old son Ray woke up not feeling well. She sent an email to his school informing them she was keeping him at home. When the boy's father found out Ray was home he became agitated and abusive over the phone to Lynch.

Lynch says she had young people who worked for her coming and going that day, and did not want Ray’s father coming to the house and attacking her, as he had in the past. She called her older son Rutger, who was visiting a friend nearby, and asked him to pick Ray up and take him down the hill where actress Cloris Leachman waited in her car. Leachman, a friend of Lindsey, took charge of Ray – just as seven LAPD squad cars came speeding up Mandeville Canyon Road in the direction of Lynch’s house. With them was Ray’s father, Steve Lindsey.

Lynch says she looked out the window and saw armed men on her lawn. Her son Rutger and his friends were telling police there was no hostage-taking, that they had spent the morning with Lynch, and that there must be some mistake. For reasons no one understands, LAPD/Inglewood PD decided to believe Steve Lindsey, who had left the scene.

Police later gave varying explanations about what led up to the incident. West LAPD said they responded to a report that someone heard "shots fired." But a company that oversees SWAT said Lynch would have to have a superior caliber weapon to warrant such a high risk entry. A member of the SWAT team claimed to have seen a note that Lynch’s sister had placed the call stating Lynch posed “a danger to herself and everyone around her.” Her sister denies this.

Lynch stayed inside her house and called her former custody lawyer, Lee Kanon Alpert. She also called Leonard Cohen, assuming he had played a role in the events unfolding on her lawn. Lynch says she knew Steve Lindsey had also been meeting with Cohen and his attorney, and had recently told their son Ray that Lynch was “going to jail,” upsetting the boy. She says Cohen taped the phone call later used in his successful court case against her – for which, Lynch says, she never received a summons.

Lynch says, “Police were on my hillside and crouching under my kitchen window.” She says the standoff on her lawn continued for several more hours, disrupting the neighbourhood. Members of Inglewood Police Department also participated in the operation.

Eventually, she decided to go into the back yard. Seeing her son Rutger acting as a “human shield and hostage negotiator,” Lynch ventured out front with her Akita on leash and joked to the cops: "Who am I supposed to be holding hostage? My dog?"

The police responded by telling her son they would only shoot Lynch and her dog if necessary.

“That was when I dove into the pool.”

SWAT team members searched her house. As they entered, Lynch's African Grey parrot, Lou, called out: "I see dead people!" – further alarming the nervous cops.

Offering her a hand out of the pool, one officer said they were only there to help her and not to hurt her.

“No one asked me if I was all right; no one questioned me about my well-being.” The Medical Examiners Office later wondered how the police had evaluated her. After stating they were not arresting her, they handcuffed Lynch, still in her bikini. On her way out the door, her son managed to hand her a brocade jacket.

Although she lived near UCLA Medical Center, she was taken in a squad car to King-Drew Medical Centre in Watts, 40 miles away and a three-hour drive in traffic. Known as one of America’s worst hospitals, King-Drew was recently closed down as a place where patients routinely die from neglect and medical errors. During the long ride through South Central Los Angeles, Lynch says she was questioned closely about her relationship with Phil Spector, who had been charged with first degree murder of Lana Clarkson. In the car, Lynch voiced concern over what awaited her at the hospital but was told by a woman cop: "This will be good for you."

“I felt I was being kidnapped”.

At Emergency, the admitting psychiatrist administered anti-psychotic drugs without authorization and left Lynch in the waiting area for hours, still in her bikini and brocade jacket, and handcuffed to a chair. A nurse advised her she would be transferred – but did not tell her where. Examining her file, the nurse noticed it listed her as 19 years old with wrong social security number, wrong date of birth, wrong religion, and her name misspelled as "Kelly Lynch" Lynch thinks it was the same file she had seen, several months earlier, in the hands of the Special Investigator who came to question her about Spector.

A second doctor told her to wait her turn to ensure no further harm would come to her, and assured her that nothing in the King Drew report could cause her to lose custody of her child. The following day, she was released after nearly 24 hours in the psych ward.

Back home, Lynch learned that while she was being held at the hospital her younger son's father, Steven Clark Lindsey, had filed for custody of her son Ray Charles Lindsey and obtained a restraining order denying her access to the boy. She says Lindsey attempted to convince doctors at King Drew that she was dangerous, in order to have her committed, She says Lindsey also threatened the psychiatrist who had her released.

On that same day, Cohen’s attorney Robert Kory filed a Declaration in the custody matter, as did Betsy Superfon (a friend of Cohen, Kory and Lindsey who had befriended Lynch a few months earlier ). Superfon later told Lynch she didn't realize what she was signing, and that Cohen had offered Lindsey money “or something else” to take Ray away from Lynch.

Her older son alleges Lindsey offered him money to go to Leonard Cohen's lawyer's office and transfer or sign over Lynch’s house to Cohen or his attorney Robert Kory. Rutger refused and phoned his own father, who advised him to contact a lawyer.

Two weeks later, in early June, as she drove down her street to buy dog food, a Mercedes sped out of a neighbouring driveway and rear-ended her car, Lynch was thrown forward, fracturing her nose against the steering well, and was knocked unconscious. Later, she says, as she drove back up the hill to her home, the same driver was standing in his driveway and called out: “We are watching you” as she passed.

Seeing his injured, bleeding mother enter the house, her older son again phoned his father, who may have called 911. Accounts vary as whether the call referred to an incident of "domestic violence" or a "drug overdose." Either way, police arrived at Lynch’s door for the second time in two weeks. Over the protests of her son, they entered while she was on the phone to a friend, Dr. Wendi Knaak who stayed on the phone talking with Rutger while police again handcuffed Lynch. This time they took her to UCLA hospital where her obvious head injuries were ignored. Instead, she was once again drugged and placed in the psychiatric unit where she remained for several days.

Lynch and her advisors maintain these events were coordinated by Cohen, Kory and Lindsey, with the help of former LA District Attorney Ira Reiner in a well- orchestrated plan to traumatize and discredit her – paving the way for media stories which accused her of skimming millions from Cohen’s retirement fund.

In the summer of 2005, as Lynch was struggling to save her home and protect her child from a father her friends describe as "viciously anti-social" and “violent”, reports of Leonard Cohen's financial troubles hit the press. They alleged the 70-something singer had been scammed by his personal manager, Kelley Lynch, who colluded with an advisor at the AGILE Group in Colorado to send him false financial statements while emptying his accounts of millions of dollars.

Although listed as the owner of Traditional Holdings, the entity in question, Lynch says she never received any statements from the AGILE Group -- who instead had been sending them to Cohen -- having changed her mailing address to Cohen's home in Los Angeles. She has since filed a complaint with the US Post Office for mail tampering.

She insists Cohen sued her because she went to the IRS about his tax situation. She says he is not, and never was, "broke" and that missing funds went to buy homes for his son Adam Cohen and girlfriend, singer Anjani Thomas, ex-wife of Robert Kory. Noting Cohen is famous for his financial largesse and once gave Zen Master Sasaki Roshi $500,000 as a gift, Lynch also cites hefty payments to advisers, various transaction fees, personal taxes, and other monies which may have been sent offshore.

While Cohen and Lindsey attempted to persuade others, including LA Superior Court, that she intended to flee to Tibet or another non-extradition country, Lynch was isolated and penniless and still in Los Angeles. Lynch was former personal secretary to the late Chogyam Trungpa Rinpoche, a flamboyant Tibetan spiritual teacher who founded Naropa Institute in Boulder, Colorado in the 1970s, and died in 1987. She says various Tibetan lamas are praying for her safety.

Journalists covering the story were either unable, or didn't bother, to track Lynch down, and most reported Cohen's statements as fact. The NY Times contacted Kelley for a quote which they never printed

By July 2005, Lynch had lost her custody battle and Ray went to live with his father. On December 28, she and Rutger were evicted from the house in Brentwood, and ended up homeless in Santa Monica, which has no resources for the homeless. The Police Department gave her no help and, she claims, laughed when she brought in evidence that she was being stalked by a known serial killer while she camped on the beach.

In 2006, Cohen was awarded a symbolic $9 million settlement in a civil suit against Lynch, who still does not have a lawyer representing her. Corporate books and other evidence of fraud appear to have been overlooked by Judge Ken Freeman in his judgment, Lynch says, although she admits she has not read the court documents and was never served a summons. At the time of the decision, she told reporters she lacked the money to make a phone call. That same year, her older son lost his fingers in an accident with a meat grinder while he was working at Whole Foods in Los Angeles and Lynch could not afford a bus ticket to visit him in hospital.

Lynch heard through a journalist that Cohen later testified for the District Attorney’s office in a secret grand jury relating to the Phil Spector case with former District Attorney Ira Reiner acting as his lawyer. Reiner is a personal friend of Cohen, and as D.A. presided over some high-profile cases including the “Night Stalker” serial killer and the McMartin Day Care scandal.

Recently, on June 17, 2008, Cohen's lawsuit against the Agile Group was thrown out of court for lack of evidence. In response the AGILE Group dropped its counter-suit accusing Cohen of defamation and fraud. AGILE still claims to be shocked that a singer of Leonard Cohen's talent and stature would engage in false accusations against his own representatives.
 

Lynch believes Cohen and AGILE colluded to defraud her. She continues to deny all allegations against her, and remains hopeful that Phil Spector's lawyer, Bruce Cutler, will represent her in recouping damages to her livelihood and reputation. She now lives in another state and recently learned her younger son, 15, whom she has not seen since July 2005, stopped attending school last January.

These days Cohen’s fans seem to have expended their rage at Kelley Lynch for driving their idol into bankruptcy. Some now say she unwittingly did them a service -- by forcing him to go on tour for the first time in nearly two decades.

At 74, singer-songwriter Leonard Cohen continues to ride a wave of sympathy, gathering wide support from the music world and even some British royalty. Unquestionably, his career and finances have benefited from news reports that he is too impoverished to retire.
