Daniel Bergman and Michelle Rice,

I do not appreciate the relentless harassment (that I and others continue to be subjected to) over Leonard Cohen by Bay Area lawyer Stephen Gianelli.   I believe this harassment, particularly as it relates to witnesses, is highly relevant and material.  I also believe one of you, or someone affiliated with you, advised Gianelli that I wrote IRS, FBI, and DOJ this afternoon and I did not write Gianelli.

I intend to appeal.  This is a void judgment and that means it can be appealed.  I will respond to your retaliatory Motion for Sanctions.  I am the individual being harassed.  My Motion for Terminating Sanctions addressed fraud upon the court and was NOT a motion for reconsideration.  The court seemed annoyed because I continue to state that I was not served.  I suppose Judge Hess would merely concede this point but that is not my nature.  I also will not tolerate lying lawyers and rotten tactics.  This matter will be appealed and it will go to the U.S. Supreme Court if necessary.  Perhaps they can address Hazel Atlas.  I understand it's Rice's position that California does not affirm Hazel-Atlas.  It clearly affirms fraud upon the court.  

I will also file a motion to vacate the fraud domestic violence order.  I'll provide the Family Court with my emails with the Chief Justice's office (California Supreme Court) and Judicial Council so you cannot argue that I'm "mad" at Michelle Rice.  The notion is positively absurd and laughable.  I also intend to address the unlawful sealing of documents - including those available on PACER; attached to Greenberg's lawsuit; and/or available through the SDNY.  I did not have attorney/client privilege with Leonard Cohen's lawyers and definitely do not with his current lawyers.  The notion is obscene.

This harassment should cease and desist.

The judge, whose demeanor was reprehensible,
 denied the motion.  He evidently didn't read the
documents or declarations and argued that I might
 have had a  co-occupant.  That's not what Cohen 
argued.  I intend  to appeal immediately.  I am going
 to the U.S. Supreme  Court over this if necessary.

I will now file my motion to vacate the fraud
domestic violence order; object to the seal; 
respond to the  Motion for Sanctions (left at
 Paulette's while we were  at court and handed 
to me by Robert Kory); and, the  appeal.

The court said I did not prove extrinsic fraud. 

He refused to address the fraud and perjury used to obtain
the default and his January 2014 order.  He did not address
the declarations or clarify the ambiguous judgment. 

It's my burden to prove that Cohen had him seal publicly
available documents.

The judge acknowledged that he does not have
jurisdiction over federal tax matters but he's hearing
one.  He said his seal relates to the public and not Tax
Court.  

As Paulette just noted - "Why are we here  since
 he didn't bother reading anything?" and "LA works
 beautifully for the criminal."   That's factual.

The judge said I chose to represent myself.  In
any event, the man's conduct is appalling and 
this will  be appealed.  They do not like to admit
 their own screw ups  either.  Their procedural
 problems are evidently my  issue.  When I 
mentioned that he was violating my rights to
due process, the judge said I tell everyone that.
  How  would he know?  I don't know this man.

Hi Senate Judiciary,

Cohen is attempting to conceal reality.  LA Superior Court has evidence submitted to Tax Court under seal and continues to expose me to slander, criminal harassment, etc.  I didn't have attorney/client privilege particularly as I was defrauded by what appears to be a gang of criminals.  Let me quote Ed Dean again:  The IRS Commissioner HIMSELF should come in after Cohen and his representatives.  He represented Cohen and I didn't know him.  I told him what was happening in 2005.  Ken Cleveland, Cohen's former accountant, thinks IRS should prosecute this matter in a jurisdiction used to handling celebrities.  Kory, Cohen's lawyer, just lied about Ken Cleveland on the stand.  The man cannot stand Robert Kory.  He thinks this looks like ENRON.  LA Superior Court works beautifully for the criminals.  In fact, Cohen perjured himself (many times), acknowledged that he changed his testimony, and that was that.  I wonder what Barry Bonds would think.  He just couldn't answer a rather nebulous question.  One question.  Every word in Cohen's complaint and every legal document, including declarations, is a lie, perjured statement, fabricated evidence, or fabricated narrative.  I've sent you the evidence as well so please review the 1977 Tax Memorandum.  That belongs to Machat & Machat.  The judge has Machat & Machat's evidence under seal.  They add insult to injury.

The malicious tactics continue.  I was in touch with the IRS Chief Trial Counsel's office today.  I explained that Cohen's attempting to conceal and seal evidence and addressed the fraud upon the Tax Court re. Docket No. 7024-02.  Did Bergman or Rice contact you directly for the limited powers of attorney re. the declarations?  I've received advice from numerous lawyers and Bergman and Rice are lying.  More fraud upon the court. And now what - the celebrity (who Boies Schiller called a celebrity fraud) wants special attention here.  He wants the Supervising Judge to stop everything and review my documents.  There is nothing else to file.  I'm moving onto federal court.  LA Superior Court permits people to perjure themselves.  Cohen confessed to that on the witness stand.  The prosecutor lied about federal tax matters.  There is no domestic violence order.  My former attorney/employer, who has practiced in federal court for 50 years, understands that I have a right to go into federal court about the Colorado order that was issued without an evidentiary hearing.  Is the custody matter at issue?  That's interesting.  The Treasury agents wanted to discuss that.  These people are criminals.  Leonard Cohen cannot live in Canada because of tax and residence problems but feels completely comfortable with his unconscionable conduct.  He's a celebrity and entitled.  He can summons LAPD's TMU and lie to them.  We cannot.  We're waiting for Kevin Huvane and Bryan Lourd to sign us so we can seek the same celebrity justice problem Cohen feels entitled to.  I have never seen so many liars in my entire life.  We're going to be battling out their intent to violate my rights to due process over this fee waiver issue in federal court.  

Is my blog an issue?  Cohen's press releases lying about me aren't.  How fascinating.  I suppose they're only at issue when he's not manipulating an awe inspired journalist like Brian Johnson of MacLean's.

There appears to fraud upon the Tax Court as well with respect to Docket No. 7024-02.

Leonard Cohen is lying to the Court about your declarations now.  As you know, you granted me limited powers of attorney to conform your signatures.  Paulette, you signed your own declaration.  My mother had a stroke and was unable to mail her original declaration but had already authorized you to sign, Paulette.  I will attend tomorrow's hearing but then intend to attack this situation as the fraud that it is.

Cohen doesn't like the fact that the process server relied on a description of me that didn't fit me as of August 2005.  I wasn't served Cohen's lawsuit and he used his fraudulent, fabricated complaint to file tax returns and obtain fraudulent tax refunds.  I have challenged those refunds as fraud.  Ray's father's custody lawyer evidently doesn't want the coordinated custody matter raised as an issue although it is an issue.  I personally think the judge should hold a separate hearing to take testimony from each of you about these declarations and these limited powers of attorney.

They are saying the declarations are "fabricated' which is blatant fraud.  Someone in possession of a power of attorney, limited or otherwise, may sign legal documents.  Many lawyers have already weighed in on this situation.  Leonard Cohen is desperate.  They are arguing that these declarations do not comply with CCP 1008.  I didn't file a motion for reconsideration and Cohen continues to lie about this fact.  Fraud upon the court is not a motion for reconsideration.  My own declaration should be denied.

Another fraudulent assertion is that I had attorney/client privilege.  I think the judge should continue the hearing and permit me to subpoena the attorney from Hochman, Rettig who Westin advised that I had no a/c privilege.  I think the fact that I was an independent contractor, who was not wrapped in a/c privilege with Cohen-Greenberg-Westin, is obvious.

How can the declarations be fabricated when Cohen is also arguing that I have now submitted the original signature pages?  I will bring the limited powers of attorney to court tomorrow.  I think there should be a hearing where the witnesses are permitted to testify.  Cohen is objecting to live testimony.  

Cohen has two law firms arguing that they do not have time to reply to my Reply to their Opposition  How farcical.  "Notably," I failed to produce the limited powers of attorney.  I only "disclosed the limited POA rationale for the obviously fabricated signatures on three of the declarations in her June 16, 2015 Reply only after Plaintiffs brought it to the Court's attention in their Opposition."  I have had limited power of attorney since I conformed the signatures so this is a blatant lie and further fraud.

They don't want Jules Zalon's letter admitted.  He didn't provide the court with an original signature.  

Paulette Brandt "materially" changed her testimony because she explained what it meant to keep "in touch" with me when my phones were shut down.  I did not provide the Court with a declaration from Chad Knaak due to the ongoing criminal witness tampering that now involves the endless creation of fraudulent, alter ego emails by a Bay Area lawyer who is obviously an unofficial member of Cohen's legal team and appears to be moonlighting for the Spector prosecution.  

They have objected to Ann Diamond's declaration.  It's not relevant although she has addressed the fact that Cohen falsely accuses people of things and uses operatives to target them.

The declarations were signed and I have the powers of attorney and had them since I was legally authorized to conform the signatures.  They're upset that Paulette dyed my hair a nearly dark brown.  That's because I wasn't served and the process server relied on a description given to him.  Furthermore, it's obvious that the individual did not come to my house at all.

Although Cohen hired my younger son's father's custody matter, who destroyed my sons' lives, they object to statements about the coordinated custody matter.  Although Cohen's three gun stories before LA Superior Court are evidence of his pattern of lying (including under oath), that is irrelevant.  My State Bar Complaint, from 2007, regarding former DA Steve Cooley is irrelevant. It is all highly relevant and material.  

They continue to lie about a/c privilege.  These are corporate documents and my business files.  I haven't seen any mention of the fact that many of these documents are available on PACER, through the courts themselves, and elsewhere.

I intend to sue over this issue.

I see someone flunked certain classes related to Powers of Attorney in law school.  Perhaps that's why you're now moonlighting as a criminal and people generally believe you belong in prison.  

How desperate are the LA Confidential prosecutors?  They seemed fairly desperate and pathetic while lying about me in court.  They can respond to my federal lawsuit. 

As for the September 3rd hearing, an attorney for Hochman, Rettig, Mr. Holtz (IRS Chief Trial Counsel's Office), and Agent Luis Tejeda will receive subpoenas.  Cohen's now lying about my documents being his and a/c privilege.  

Cohen will probably get lucky.  All you need, from my perspective, at LA Superior Court is a checkbook and rotten logic.

You affixed the witnesses signatures to several declarations filed in support of your March motion to vacate. then you submitted them to the court, without informing the court that the signatures were not genuine.

 

When cohen's attorneys noted in their opposition that several of the declaration signatures resembled your own signature, and that your son Rutger's declaration signature did not match the signaure on his 2013 declaration, you responded with a blog posted email claiming that the declarations were "prepared and  sent to you" and that "the signatures are genuine". If you had powers of attorney that would have been the time to say so, but instead you lied and said the signatures were "genuine". Genuine means the witnesses affixed the signatures with their own hands.

 

But you admitted in your reply that YOU took a pen and affixed all witnesses signatures to the declarations and that the signatures are not "genuine". You also claimed for the first time that you had "signed" powers of attorney from all witnesses who provided (unsigned) letters addressed to the judge.

 

But you did not attach the alleged powers of attorney to your reply.

 

Even if you did have POAs (which it is pretty clear you did not) the declarations were invalid, because they were not physically signed with the hand of the witnesses. But you tried to pass these declarations that YOU signed the witnesses signatures to off as "genuine". The three declarations recite under penalty of perjury that THE WITNESSSES SIGNED THEM. That was a false statement. The signatures were false. The declarations were fabricated, and submitted with the intent to mislead.

 

Penal Code section 132 and 134 are felony violations of STATE law, not federal law. The FBI/IRS/DOJ has zero say about whether you will be charged based on the facts you admit that constitute violations of these penal statutes.

 

That decision will be made by the prosecutors in the county where the offenses occurred, Los Angles.

 

Who knows, maybe you will get lucky and not be charged. Maybe not.
