Cohen is taking the position that my ownership interest in the intellectual property was an oral agreement and yet I have provided the IRS with the evidence. It is shocking. Do not underestimate Leonard Cohen's greed. Gianelli is obviously insane. Who would permit this man to represent them? I heard talk, as is now being publicly confirmed by a man aligned with Cohen, that the IRS might look at these corporate structures.”

She also says:

“Perhaps because Gianelli has pubilcly (sic) noted that he's leaving the country, he feels comfortable lying about me publicly and transmitting fraud to the IRS about me. Why would I go to the IRS if I felt I did something wrong?”

1. We do not now, nor have we EVER spoken for Leonard Cohen. Cohen is well represented by able counsel and in any event he has already secured a $7.9M embezzlement judgment against Lynch and the IRS has honored his corresponding theft-loss deduction and the audit period has expired. Any opportunity for Kelley Lynch to have sued Cohen affirmatively for ANYTING ended when the default was entered and she let the statute of limitations expire. There are no legal “positions” that Cohen needs to take. It’s over. He prevailed. 

Gianelli has been clear about hearing from Cohen's representatives in 2009.  He has relentlesly targeted me since that time and is arguing Leonard Cohen's case.  I suppose if you think two lawyers willing to take the stand, perjure themselves and lie - including about the IRS and judges, then Cohen has able counsel.  Cohen has secured nothing.  My appellate attorneys (and others) is well aware of the fact that I was not served the Complaint in Leonard Cohen's fraudulent and retaliatory lawsuit. It is perjured.  I had NO FEMALE CO-OCCUPANT in August 2005.  I was not served or notified of the default judgment.  I was homeless in May 2006. I embezzled nothing but Cohen has concealed corporate books and records, etc.  This fact does not interest Gianelli who obviously has motive.  Leonard Cohen declared that he is the sole beneficial owner of TH and BMT and that these entities were held in trust for him. That's a bald faced lie and there are no trusts.  Furthermore, LA Superior Court cannot  have jurisdiction over me or either of these entities due to the fact that I wasn't served and they weren't named as parties.  My ownership interests were simply stolen from me; wrongfully conveyed to Cohen; and the fraudulent default judgment (based on perjury and concealment) wrongfully altered my federal and state tax returns which is a very serious legal issue.  It's  not over.  I just discovered the refund during my trial and am suing Leonard Cohen over that issue.  I am also suing him over the illegal K-1s, wrongfully altering my tax returns, etc.  The IRS evidently didn't honor the refund since the IRS just advised me to file a fraud form 3949a with respect to that matter.  Fraud tolls the statute and I just discovered this fraud during my trial.  I see they had a plan however.  The State of Kentucky didn't think the audit period expired going back to the late 60s or early 70s with respect to Leonard Cohen and his tax fraud.

Leonard Cohen cannot stop stealing.  His greed is inconceivable.  

2. Kelley Lynch has such a burning desire reargue her dispute with Cohen that she insists on attributing everything this blog says by way of unmasking the absurdity of her nonsense claims to Cohen that is clear. But Blogonaut speaks for Blogonaut and only Blogonaut. 

Blogonaut is simply engaged in an ad hominem attack on my character and is aligned with Cohen.  That's obvious.  He's also an arrogant idiot with obvious motive.

3. If Kelley Lynch has a written contract governing her past business relationship with Leonard Cohen she should produce it. But she cannot, because all agreements were oral and not written. But even if they were written, Kelley Lynch has been claiming publicly that Leonard Cohen owes her money since at least 2007 and she consulted with Bois Schiller in aid of suing Cohen before then. Therefore, even if Lynch had a written contract with Cohen, she had no more than 4 years from leaving his employ in 2004 to file suit. It is now 2013, more than 8 years later. The limitations period for fraud is three years from the date of discovery. Lynch has been accusing Cohen of fraud since at least 2007. That statute of limitations expired long ago as well. Any suit against Cohen is also barred by the default judgment in Cohen’s favor that with interest now exceeds $10M.

I have written contracts and corporate records governing the agreement between me and Cohen where I was compensated with 15% of all intelletual property dating back to 1967.  That includes non-revocable assignments and minutes dictated by Leonard Cohen.  I've produced them for the IRS, FBI, DOJ, Treasury, and Phil Spector.  There's no statute with respect to my ownership interest of intellectual property whether or not Cohen has attempted to defraud me.  Furthermore, I wasn't served his rotten fraudulent and retaliatory lawsuit  or the default judgment.  A suit regarding the illegal refund will be filed in federal court.  The judgment followed the refund and is a holding on nothing.  Literally.  The judge  has no jurisdiction over me.  LA Superior Court has a serious problem with these issues.  I'm speaking with other people in similar positions who have also had fraudulent restraining orders used against them, including a woman who was inserted into  one that now involves the City Attorney with respect to someone she doesn't know at all.  She, of course, wasn't served or notified either.  I think it's a scam that demands an investigation.  I didn't consult Boies Schiller.  They represented Greenberg and we were in constant contact for months.  They advised me on various matters.  They referred me to lawyers - Bert Deixler and Zia Modabber.  And Boies Schiller understood this - Leonard Cohen is a Hollywood fraud, someone who owes me millions, has attempted to blame his wrongdoing on me, and he and Kory attempted to engage me in criminal conduct.  That's why they advised me to go wired to my meetings with Cohen/Kory and informed me in writing that it would not be a legal set up.  They also had legal opinions on the custody matter, Cohen's attempts to crush and destroy me (that email was sent to the Denver FBI and others), Cohen's tax fraud, the custody matter, and other issues.  

4. We are not “aligned” with Cohen in any way shape or form. We have never spoken with him. We do not know how he feels about Lynch at this point. WE believe she should go back to jail for violating her probation until she is indicted for tax evasion, which day is coming. If Lynch says otherwise, she is just whistling in the graveyard.

I haven't committed tax evasion and haven't violated my probation at all.  Streeter retaliated against me re. an email I sent the FBI as an example of the type of false accusation she engages in and she then lied to LAPD.  My lawyer views that as criminal obstruction of justice and retaliation which is why we have attempted to abandon the appeal.  I haven't evaded taxes but Gianelli is simply falsing accusing me and has transmitted fraud to the IRS which I believe is criminal.  I am now gathering evidence from people privately that the City Attorney's office lies about people threatening them and handing it over to the DOJ together with evidence of other tactics.  As someone noted this morning, in an email I sent to the DOJ, it's scandalous and demands an investigation.  

5. Why did she go to the IRS? PRECISELY, because she knew she herself was exposed to tax evasion charges. Her allegations against Cohen – which went nowhere (no tax case against Cohen was ever filed, per Pacer) – were nothing more than a smokescreen to hide her own tax fraud exposure from the IRS and a feeble attempt to ingratiate to the IRS hoping it would take her side and not prosecute her. In a similar way she transparently tries to ingratiate herself with Phil Spector – who will have nothing to do with her – by spamming Dennis Riordan (and before that Bruce Cutler), who is not even reading her daily diatribes. This is because a Buddhist holy man told her at the height of her troubles that she “needed powerful protectors”, so she tried to glom onto Spector and the IRS. Its all so ineffectual it’s pathetic, really. 

I see Leonard Cohen has come up with a fictional narrative here.  Leonard Cohen committed egregious tax fraud that I - and others - view as criminal.  That's why I went to the IRS and reported this and he used me horrendously and continues to lie including with respect to matters where there is tremendous evidence.  I didn't commit tax fraud or evade taxes.  I don't owe the IRS taxes but have paid taxes on TH although Cohen lied to the IRS when he said he was the sole beneficial owner of that entity.  I did NOT make a charitable donation to the IRS re. TH on Leonard Cohen's behalf.  That is absurd.  I don't have to ingratiate myself with Phil Spector.  I know Phil Spector, am very close with Phil Spector, and heard from him immediately after I advised of Cutler's disgraceful conduct and what was unfolding with respect to Leonard Cohen, his highly embellished gun stories, and the DA's office re. my intent to annoy Leonard Cohen insane trial.  Dennis Riordan has never advised anyone that I am spamming him.  My public defender called Dennis Riordan.  No Buddhist lama told me I needed the IRS or Dennis Riordan to protect me.  And, in any event, I haven't been protected.  I've had my life destroyed.  The notion is laughable.  My teachers have made offerings to the dharmapalas on my behalf and Gianelli did target the 14th Sharmapa and has a dog that shits or vomits religious pujas on his carpet.  The man is sickening.  

6. We feel free to say these things because – as Kelley Lynch posted on her blog – these issues are of public importance and because they are true. And no, we do not fear suit by Lynch.

Every word about me is a lie.  He doesn't fear that the IRS or FBI will prosecute him for criminal witness tampering or criminal witness intimidation either but kept raising that as a very serious issue and his motive for filing a fraudulent IRS form about me.  As people are noting - Stephen Gianelli is a psychopath and a sick and vile man.
