Stephen Gianelli Goes The Mile For Leonard Cohen, Steve Cooley, Alan Jackson, & Sandra Jo Streeter

Gianelli continues with his attempts to infiltrate my defense and I just received a letter from one of my lawyers advising me that he continues to email him.  Clearly the IRS and FBI should investigate this matter.

To the IRS and FBI,

Gianelli's obsession with me continues.  He now appears to be arguing Streeter's case.  He actually thinks he is speaking to me.  I view this man as dangerously unstable and this is entirely creepy and frightening.  And now, he has decided to target Francisco Suarez.  The Boulder Court told me this order expired.  Having said that, you cannot register a civil harassment order as a domestic violence order and LA Superior Court has been very clear about that.  Furthermore, I had to be served the new California registered order and LA Superior Court has been clear with me about that.  The fact that I thought the order expired is supported in my email to Rice (which Streeter concealed from the court and jurors - although addressed the one where Rice lied, copying in the IRS and FBI, advising me that the order was registered in California on February 14, 2011), and voicemails which cannot be dated, as LAPD has noted in their report.  Cohen did not have a date or time stamp.  He also has bias, motive, and has trapped himself in perjury and many lies.

Actually, who knows what was going on with the jurors.  In debriefing, a number of them were interested in the IRS matters here; one relied on Streeter's lie about the $150,000 assets (although Cohen personally impeached her on this when he admitted purchasing hones for his girlfriend, son, etc.); etc.  And, of course, one of my PDs thought there was a prosecution plant which I have brought to the attention of Judge Vanderet and will raise in my Writ.  I happen to think he should speak directly to that PD on this issue.  Finally, the judge did not properly instruct the jurors on the elements of "intent to annoy."  It's right there in the transcripts and it's interesting that my lawyers didn't notice.

Gianelli is out of control and his attempts to infiltrate my defense should be investigated as well.

All the best,
Kelley

On Kelley Lynch’s blog, she quotes her testimony on direct examination at her harassment trial. What part of “permanent” did you not understand Ms. Lynch?

Q: Did you ever see any declarations that were written regarding that 2008 order?

A: The restraining order?

Q: In 2008, yes.

A: After I asked the judge to make that permanent, I went back to the court because I had been shocked to hear from Judge Enichen that Leonard Cohen actually flew into Boulder for this. Because I didn’t even know he was on tour,.

But after admitting that SHE asked the Colorado court to make Cohen’s restraining order “permanent” she then claims she thought the order had “expired”:

Q: Okay. Did you -- you said that you had requested that the order be permanent. What did you mean by permanent?

A: Well, I mean, I understand two aspects of a restraining order. Now, when someone gets a restraining order it goes into the preliminary hearing, which is what you said Leonard Cohen was at and I wasn’t; that’s a temporary restraining order. , And then once you go into the hearing -- I didn’t go to the hearing in 2005. I thought when I was served the TRO, that I was already under a restraining order. I wasn’t represented.

Then, that become permanent for a couple or a few years. That was my understanding.

Q: Okay. Did you believe that the order in Colorado had expired?

A: Yes, I did.

Uh, no Ms. Lynch, “permanent” means permanent as in forever – as the copy of the order that you signed as received in open court in 2008 clearly states.

Which is, of course, one of the reasons why the jury rejected your testimony and convicted you of violating the restraining order on multiple occasions.
