To the FBI,

I've advised the lawyer handling my progress hearings that there are
dangerously unstable people targeting me.  That's a fact.  I have very
intelligent people witnessing and watching this situation.
Jihad Gianelli thinks it's amusing that I'm in touch with the FBI but
he is aware of that.  I did speak to Viramontes/LAPD and he called
Agent Tejeda/IRS.  He also advised me that he was updating his report,
after taking my statement, and would fax a copy to Agent Tejeda/IRS
and email a copy to Agent Sopko/Treasury.  He has taken the legal
position that Cohen's restraining order prevents me from obtaining
information I need from my state and federal tax returns.  He is clear
that I need to file those returns, so automatic returns based on
incorrect information are not filed, although I do not owe taxes.
Cohen lied when he testified that I failed to file returns.  I have
spoken to Doug Davis/FTB about this matter which is why he removed the
"wage garnishment."  He also knows I was concerned about guessing on
my returns.  So Viramontes/LAPD has advised me, and said he would
discuss this with Agent Tejeda/IRS, that the restraining order
prohibits me from obtaining information for my tax returns.  I have,
of course, asked the IRS Commissioner's Staff for a legal position on
a state order that would apply to my state and federal tax returns.
LAPD was clear in their report - the alleged emails generally relate
to requests for tax information.  Viramontes and I discussed the lies
in his report,.  I asked if LAPD prosecutes people for lying to the
police.  His answer was - YES.  We also discussed the situation with
Phil Spector.  He asked me if I knew where Cohen was.  I said I could
care less - he's probably out promoting his career using me and Phil
Spector.

Please check out the two latest "articles" and posts on Jihad
Gianelli's law blog.  They have to do with me, Phil Spector, and
Leonard Cohen.  I n fact, in the posts re. Phil Spector's civil suit,
Jihad Gianelli refers to my sentence.  That will be addressed on
appeal - particularly as a lieutenant with LASD told me has never
heard of any such thing in his entire 26 years in law enforcement.  He
also went on other blogs, police chief blogs, etc. to read information
that IRS agents were posting.  That's what he told me and a deputy and
I discussed the fact that the men and women of the education
department downtown were all researching my matters.  Not everyone's a
liar with motive.

Blogonaut has learned that Wall of Sound creator, musical genius, and
California Prison inmate Phillip Spector has sued the California
Department of Corrections (CDC) in Kings County Superior Court for
alleged violations of the incarcerated producer’s civil rights under
federal law and under theories of negligence and medical malpractice.

The suit filed on August 29, 2012 –which was removed to federal
district court by the California Attorney General’s Office by petition
filed September 5, 2012, alleges that Spector, who up until now has
been allowed to visit his private dentist in Burbank, California for
treatment of a serious gum condition requiring implants and other
surgical procedures, has been prevented by the CDC from completing his
course of treatment with Dr. Jerry Albus, DDS, under new regulations
implemented by the CDC in August of 2010.

The suit alleges that prior to that date the CDC had been transporting
Spector to Dr. Albus’ office in Burbank for the treatments –which have
been at Spector’s personal expense “of over $10,000.00”, but that the
2010 office visit was cancelled by CDC pursuant to new procedures
providing that the CDC would no longer incur any expense for inmates’
dental implant treatment, even though the producer was funding the
treatments himself.

The suit further alleges that the CDC then undertook to complete
Spector’s dental implant treatment itself with in-house dentists, even
though it was “ill-equipped” to do so, causing the music legend to
suffer “excruciating pain and suffering” , that Spector is “losing his
teeth”, and suffers excruciating pain when eating.

The suit requests damages for violating Spector’s civil rights of $1
million, emotional distress damages of $500,000.00, pain and suffering
for improper dental care of $125,000.00, damages for “improper medical
care and treatment associated with a bowel obstruction” of
$125,000.00, future dental treatment of $125,000, and for injunctive
relief and attorney’s fees.

The glue used to affix all those capped teeth must have seeped
upwards. The Dept of Corrections should NEVER had a previous policy
that allowed priveledged characters like this one to go hither and yon
to private dentists, etc. What's next, trips for face lifts and lipo?
Let him throw in the towel and get dentures..........

The Complaint is premised in part on the theory that Spector relied on
the preexisting policy and had half of the work done, so he should be
allowed to have his private dentist finish the job, since the CDC
dentists don't have the proper facilities.
It does remind one of Jr. Soprano's visits to his doctor though - if
you followed the HBO series.
In any event we could see how even the proverbial trip to the dentist
would be a welcome respite from a small prision cell.

The prisons in California have become so overcrowded that they are now
under a Federal court mandate to reduce overcrowding. It has been
reported that because of this severe overcrowding, inmates are not
getting the medical services they need and if I remember correctly it
was referred to as cruel and unusual punishment. Mr. Spector is paying
his own way to protect his health.

Aloha,
Everything you say is true.
The State of California has been under a federal injunction to build
more medical facilities for years, but California citizens are
notorious for voting for harsher, longer sentencing (e.g., "three
strikes") but not the funds to build more prison facilities.
Finally, a receiver was appointed by the federal district court who
was poised to simply take the $billions needed for construction from
the general fund and get it done.

In response, the California legislature passed a law euphemistically
called "prison realignment", meaning, that 1/3 of California's prison
population has simply been dumped back on the county jail systems
where the inmates were sentenced.

Therefore, people like, say Kelley Lynch - who received an 18 month
jail sentence for harassing singer-songwriter Leonard Cohen for over
five years in violation of a restraining order and who also left a
dozen death threats on his home answering machine - are released from
jail after serving only a few months.

Of course, this Band-Aid did not address the underlying problem of the
state's crumbling prison infrastructure and underfunded, inadequate
system of medical treatment for its inmate population.
While it is true that Mr. Spector has been paying for his own dental
treatment, we suspect the fiscal issue relates to the number of
corrections personnel that are required to be exclusively assigned to
transport and supervise the producer during his visits to Burbank,
California to sit in the dentist chair, multiplied by he number of
similarly situated inmates whose families are willing to pay for
private dental treatment.
Under Spector's unique circumstances, given that he has already
commenced a procedure that the CDC lacks the resources to finish
competently -indeed that the CDC regulations now PROHIBIT it from
completing (dental implants), he has a strong argument.
The larger issue is that the cost of healthcare is a staggering burden
for society as a whole. Many employers have dropped or sharply scaled
back dental coverage for their employees. And it is difficult to
persuade voters to pay to provide to sentenced prison inmates that
which is not being provided to their own families.
It is all well and good to say "lock them up and throw away the key",
no one thinks about the cost of housing, feeding, and providing basic
medical coverage to an aging prison population doing life under some
very harsh sentencing laws.
This problem is a lot bigger than whether Phil Spector can get his
implant bone and tooth implant procedures done.

God help us all. Have any victims of this serial harasser heard from
her since her release? I can't believe Leonard Cohen wasn't notified
of her impending release. And if Cohen wasn't notified, what are the
odds her children were notified? Once again, my heart breaks for her
kids--they deserved a mother who was capable of loving them;
unfortunately, they were dealt a shitty hand at birth and are saddled
with a creature who has 2 favorite words (and topics/subjects): I, I,
I... and ME, ME, ME....

We are hanging at our home in Greece for the next month but decided to
check our Gmail account and sure enough KL has resumed her email
activites as if she had not gone to jail at all - no lessons learned,
no improvement in her pathological thought processes, still writing
the FBI and phoning LA detectives with the same crazy nonsense.
Contrary to the official transcript of the oral proceedings at KL's
sentencing hearing - wherein KL was ordered to undergoe a mental
health evaluation - KL insists we are "slandering" her and that no
such order was made. (The transcript was posted on Scribed.com and
speaks for itself.)
KL's latest spin on her criminal conviction is that the jury was
"interested" in hearing about the IRS angle but the judge would not
delay the trial to wait for Agent Kelly Skopko to return defense
counsel's call. Ha! That would have been a long delay - like untill
hell freezes over.
We predict that either KL will not appear in court on November 9, 2012
as required or will not be able to demonstrate the required AA
attendance, mental health counseling, and mental health evaluation -
nor could she receive a clean mental health bill if she did.
In any event, we do not intend to further check our Gmail account
until our return to the US in 30 days.
Perhaps in the interim the loon will be 5150'd by the Berkkeley PD.

Interesting. No sooner did we post the link to Lynch's blog posts
denying that the sentending judge in People vs. Kelley Lynch ordered
Lynch to undergoe a mental health evaluation as a part of her
probation, Kelley Lynch deleted the post.
Apparenty Lynch now realizes that her protestations notwithstanding,
she must submit to a mental health evaluation.
Whether she does or not remains to be seen.
Our bet is that she does not.

Yep, the crazy, manic, disjointed, and conspiracy theory posts about
Cohen, this author, the LAPD, and many others continue - scores now
since her release from jail in Los Angeles. (See recent posts on her
blog, including those of today.)
This woman will never get the psychiatric help she badly needs.
Therefore, she is in violation of the terms of her probtion.
We'll see where this leads....probably back to jail.
