Hello IRS,

Reviewing evidence.  I am finalizing the motions I will file next week.  One motion will be filed with Judge Robert Hess asking him to refer Leonard Cohen for a perjury prosecution.  The other motion will address the fraudulently registered "domestic violence order."  I have no idea why Stephen Gianelli decided to pick up with harassment over these issues today.  There are legitimate issues between me and Leonard Cohen although clearly Cohen doesn't want to address them.  In any event, please note that Gianelli has also picked up the harassment of my sons, sister, and Paulette Brandt.

Neal Greenberg's IRS warnings to Leonard Cohen contained the following statements.  Leonard Cohen has borrowed/expended approximately $6.3 million of assets belonging to Tradtional Holdings, LLC.  His lawyer, Richard Westin, was obliged to prepare promissory notes.  His investment and financial adviser, who spoke to Westin and referred Cohen to him, had all the necessary financial information.

Cohen's Objection document, that I have provided you with, states clearly that I have no expertise re. tax matters.  They have taken the position that I cannot even discuss tax fraud.  I was told Leonard Cohen committed criminal tax fraud.  I reported that to IRS on April 15, 2005.  He and his representatives continue to lie about this fact to LA Superior Court.  I have no idea why LA Superior Court is all over federal tax matters and would like a formal IRS opinion on that.

LA Superior Court does not have jurisdiction over me or two entities inserted into the default judgment.  That will be addressed in my federal lawsuit.  Illegal interest continues to accrue.

An investigation into this situation, including the roles played by the Los Angeles City Attorney's office and the Los Angeles District Attorney's office (who aligned themselves with Cohen) is clearly warranted.

All the best,
Kelley

Excerpt of Neal Greenberg "IRS Warning" letter to Leonard Cohen dated January 16, 2004.

"By borrowing so much money, there is an argument, perhaps remote, that the IRS may question the original transaction.  If the loans have been documented, there is a better case.  There would be millions of dollars of back taxes if the IRS successfully challenges the original transaction."

Excerpt of Neal Greenberg "IRS Warning" letter to Leonard Cohen dated June 25, 2004.

"IRS Dangers.  Two Issues.  a.  The first issue is that Traditional Holdings is being run without all the formalities required of a business.  The IRS might find it easier to recharacterize the original transaction (the sale of a private annuity) .  The fact that our monthly email to you shows that Traditional Holdings treats the loan as an asset is good.  If you pay the loans back, that is good too.  b,  A second issue can arise.  Insofar as you have been taking loans from an operating business, the IRS might classify them as disguised salary.  If so, there are huge back taxes to pay.  Once again, our monthly email shows you treating the assets as loans effectively (by treating total assets as including the loan balances) probably only helps a little bit.  Paying back the loans will indeed help,"
