Working out details with respect to elements of my book.  I think the situation with Cohen's copyrights, Jeff Chase, and Mary Martin is accurately addressed in this manner:  When Cohen was represented by Mary Martin,he signed away his publishing rights to three songs:  Suzanne, Master Song, and Dress Rehearsal Rag.  Mary Martin thought Jeff Chase, a music publisher, could enhance the songs.  He worked with Cohen to put together a demo tape for publishing.  Cohen signed the documents giving Chase the rights to the three songs.  They were not, as Cohen has publicly alleged, stolen from him.  In exchange, Chase would represent Cohen.  Cohen was contractually bound and has no respect for contractual obligations.  When Cohen pulled out of the deal, Chase retained the publishing rights.  Stranger Music, a music publishing company, was partly owned by Mary Martin.  Cohen had become disenchanted with her.  He sought the advice of Marty Machat who, at the time, was Columbia producer Bob Johnston's lawyer.  Marty soon represented Cohen and worked out a deal whereby Mary Martin was bought out.  And, as we know, there is a letter whereby Marty transmits $30,000 to Carter/Irving Trust as final paymenet for his and Bob Johnston's share of Stranger Music.  In 1987, Peter Shukat and I negotiated with Jeff Chase to buy back the three songs.  Chase had contacted Barry Wexler, who was a friend of Cohen's at the time (and someone I know quite well), and told him that Cohen should have te rights to these songs and he was open to offer.  Cohen has a highly embellished version of this story, of course.  He likes to fashion himself as the victim when, in fact, he has a lifelong pattern of defrauding people.

Hi Francisco,

Gianelli continues to lie about me. Of course we filed the substituion with the appellate division and the City Attorney was served as well.  This man is dangerously unstable and targeted everyone in my family, etc.  I would assume there are serious legal issues that involve a lawyer I don't know writing you, my lawyer, about my appeal.  In any event, Investigator Frayeh/DA's office told me he probably found a sympathetic ear with Spector prosecutor Alan Jackson about me and he's definitely aligned with Leonard Cohen.  His M.O. from what I can tell is infiltration and sabotage.  That's why I believe he contacted the IRS and Agent Sopko/'Treasury about me.  He wants to know what they have in mind with respect to Leonard Cohen.  As you understand, my trial is nothing other than a tax case that the IRS needs to investigate.  This lunatic lawyer also contacted Phil Spector's trial lawyer about me; the FBI and lied to them; and it just goes on and on.  My sister hired a lawyer to advise him to cease and desist but he is unstoppable.  His entire blog is devoted to me and Phil Spector.  

 If the appellate division refuses to abandon my appeal, do I have any recourse?  I do not want to deal with these liars and the prosecutor's retaliation against me during the appeal is unconscionable.  The City Attorney is concealing exculpatory evidence; Cohen has committed perjury; lied extensively on the stand; the prosecutor lied; the situation was coordinated with the DA's office who had an investigator there hanging out and lunching with Cohen.  It's definitely LA Confidential.

In any event, Gianelli doesn't like the fact that I asked the IRS and FBI to investigate him for witness intimidation, witness tampering, etc.  He thinks it's a game.

Gianelli continues to lie about me.  Of course, I filed a substitution of attorney that Francisco prepared.  It was returned as it was the wrong form. In any event, the man's obsession with me continues and he continues to lie about me. I absolutely instructed my attorney to abandon the appeal.  The prosecutorial misconduct is outrageous, as we noted in the document filed with the appellate division; there is obstruction of justice with respect to the retaliation on the part of the prosecutor; exculpatory evidence is being concealed; and I have had it with the liars in LA Confidential.  Perhaps Gianelli was the individual reading about himself on my Blog, as I noted to you.  It's really quite creepy particularly given the fact that this man has absolutely engaged in criminal witness tampering, witness intimidation, etc.  That is definitely my opinion and I have spoken with lawyers about it also.  That includes Francisco who Gianelli wrote about my appeal, etc.  The man is an outrage.

A lot of water over the dam here since the last comment. Lynch never filed a motion to strike the brief. No, after publishing that she filed a substitution of attorneys form firing her attorney and representing herself, did she do that either.

Instead, Lynch has instructed her laywer (the same lawyer) to abandon her pending appeal.

Since the record on appeal has been filed already the Court may or may nt dismiss the appeal.

NOTE; Stephen Gianelli has not posted an article on his so-called law blog since targeting me in December. Due to the outrageous prosecutorial misconduct, retlaiatory activity with respect to the prosecutor (that one of my lawyers has advised me is criminal obstruction of justice), concealment of exculpatory evidence, and the extensive lies, I have asked my attorney to abandon the appeal.  The appellate division has been apprised of the reasons I am abandoning this appeal.  Actually, Francisco Suarez, the appellate division, and I all know that we did file a substitution of attorney.  There was a problem with the form.  Who cares what the appellate court does.  The trial court tolerated a bunch of liars; the prosecutor elicited perjured and false testimony; Cohen confessed to lying on the stand; and there are now three versions of his highly embellished bogus Phil Spector gun stories before LA Superior Court.  Gianelli can read my book.  The appeal will be abandoned.  Make no mistake about that.  I have had it with LA Confidential and their rotten liars.

You're one hell of a journalist - not even bothering to contact me.  I would assume you have your own motive for that.  If you have any questions about Cohen's tax fraud do contact the IRS Commissioner's Staff directly.  The penalties and itnerest on three entities alone, as of 2004, were approximately $30 million.  Enough to lie about me and destroy me.  Cohen offered me 50% community property to lie for him.  I declined the offer.  This man has no problems lying in court, in legal documents, on the stand, etc.  That's why he's now nailed in his lies about Phil Spector and this time it is absolutely perjury.  

Does hypnosis work? Well, perhaps Cohen used it on you then.  My book will be far more honest and I know everyone involved and am also a student of Roshi's.  I helped raise his daughter and managed his son.  The man retaliated over the IRS.  I will once again write your publishers.

Sylvie Simmons,

I am advising you to cease and desist.  Regurgitating Leonard Cohen's lies is not a defense to slander.  Leonard Cohen retaliated against me for reporting his probable criminal tax fraud to the Internal Revenue Service.  He has stolen millions from me and I have the corporate books, records, stock certificates, notarized documents, etc. to prove it.  I saw in your book that you read Ann Diamond's draft article so I am now assuming you are simply a groupie who was attempting to please Leonard Cohen.  

I was not served Leonard Cohen's lawsuit or the default judgment and he has concealed a tremendous amount of evidence from LA Superior Court.  He now has three versions of his Phil Spector embellished gun stories before LA Superior Court and clearly two are perjured.  This man cannot stop lying and if you fell for his bag of tricks, that is your problem.  I know all the characters in your book.  I have lived through this and archived his body of work that you are so delighted with.  

Leonard Cohen has also stolen from Steven and Marty Machat.  This man's greed got the best of him.  He cannot live in Canada because he has tax and residence problems there as well.  I intend to litigate this situation with Cohen particualrly as I found out not too long ago that this man had the audacity to file for a fraudulent refund using me as the basis for that.  

I am delighted that Phil Spector refused to entertain your preposterous request for an interview.  What Leonard Cohen has done to Phil Spector is unconscionable.  

I am advising you to cease and desist and have contacted your publisher as well.

I'm going to be that annoying author and say, 'It's all in the book', because it is, and it's too long to summarise, other than with a glib oversimplification. First of all, I take issue with it being karmic justice for Leonard's bad behaviour. I have no evidence that he hurt or used people any more than the average human being, and I'd say much less than the average artist/poet/musician/ celebrity. You cannot be an artist without some sort of self-absorption, and the laws of Karma, if they are just laws, would know that. My contention is that the laws of Karma worked in Leonard's favour, and far more efficiently in the courts of law, in getting his money back. As I wrote in the book, somewhat tongue-in-cheek but not entirely, if it were a bible and not a biography, Kelley Lynch (the manager who emptied his accounts) would have the Judas role – yes she betrayed him for money, but at the same time her betrayal led to the resurrection of his career as a performing artist and to this mass, worldwide adoration ever since.
