Derrick Sanders,

I can assure you that I am not difficult to contact per the document Cohen and his legal team submitted to the Court the other day.  Lascher has had no difficulty contacting me or people cc'd on these emails documenting everything that has unfolded since I reported allegations that Cohen committed criminal tax fraud to IRS.  Furthermore, their co-conspirator, Stephen Gianelli, continues to blatantly harass me, Paulette Brandt, and others over this appeal, IRS, federal tax matters, and so forth.

I take great offense at the ongoing lies being submitted to this Court.  I informed Lascher and her so-called colleagues that I would not sign the last Stipulation due to their conduct.  The Court can deal with these absolutely unprofessional individuals who seem incapable of telling the truth.

Have a nice day.

Wendy Lascher,

I am in receipt of your Applicatoin for Extension of Time to File Brief.  I would like to address another lie you have now submitted to the Second Appellate District.  Please see #4:  "Total extension time will exceed 60 days and opposing party difficult to contact."  This is a blatant lie and you have previously contacted me (and others) and heard promptly back.  The reason you didn't ask me to stipulate is probably due to the fact that with respect to the last stipulation I refused to sign the document because you and your colleagues willfully and knowingly altered the trial court order that you then submitted to the Appellate Court.  Regardless of the Court's tolerance of this conduct - in a fraud upon the court case, no less - I have no such tolerance for this ongoing misconduct and deceit.

As professionals, attorneys are held to a higher standard when making representations to the court. In fact, under the California Rules of Professional Conduct, Rule 5-200 provides, "in presenting a matter to a tribunal, a member:
(A) Shall employ, for the purpose of maintaining the causes confided to the member such means only as are consistent with truth;
(B) Shall not seek to mislead the judge, judicial officer, or jury by an artifice or false statement of fact or law;
(C) Shall not intentionally misquote to a tribunal the language of a book, statute, or decision;
(D) Shall not, knowing its invalidity, cite as authority a decision that has been overruled or a statute that has been repealed or declared unconstitutional; and
(E) Shall not assert personal knowledge of the facts at issue, except when testifying as a witness."
Further, California Business and Professions Code, section 6068(d) instructs attorneys to "employ, for the purpose of maintaining the causes confided to him or her those means only as are consistent with truth, andnever to seek to mislead the judge or any judicial officer by an artifice or false statement of fact or law."
