Hi IRS,

I continue to be criminally harassed over federal and corporate tax matters.  I don't know what a Cohen related entity is but I have thoughts about the matter.  So does Steven Machat.  The City Attorney and LAPD are unaware that state laws must yield when in conflict.  Fascinating.  I suppose that's why I have an LAPD report that clearly states that my alleged emails were generally requests for tax information but proceeded to forward it to the City Attorney's "domestic violence" unit although there's no domestic violence and I was not Cohen's "intimate" dating partner.  The government is not assigning me a relationship with a man who exposed himself, reviewed vile pornographic images in my presence, or sexually harassed me for years.  The City Attorney must have a fascinating work environment, no?

In any event, I think a federal court will understand these issues.  I will also attach the lawsuit proving that Cooley, who aligned himself with Cohen, retaliates.  It looks like LA Confidential might be out of control again.

Overview

Another federal tax matter.  This relates to Old Ideas, LLC which was not mentioned in Cohen's Complaint or named in the default judgment which is entirely ambiguous because the IRS doesn't have any category called "Cohen related entity."  Perhaps LA Superior Court has that but a federal court will have to clarify this if Judge Hess does not.  I don't know what a "Cohen related entity" could possibly be.  I have my thoughts on that matter and have shared them with IRS.

I'm reviewing evidence and have emails where it is confirmed that Old Ideas, LLC was formed in Delaware as a partnership on June 30, 2004.  Richard Westin wrote that he understood I had a 15% interest in the intellectual property that was being assigned there.  That IP is addressed in the liner notes for "Dear Heather" and it is copyrighted as being owned by Old Ideas, LLC.  See below.  I don't see any of this on the ledger although Cohen testified that "Dear Heather" was addressed on the ledger.

Another issue relates to IRS and "income tax."  Westin wrote that it is a partnership for "income tax" purposes.  However, this entity was not registered to do business in California until 2011.  Therefore, it cannot be part of the judgment and Traditional Holdings, LLC most certainly cannot.  

What happened with this entity?  Was I removed?  Are we just ignoring this?  Were these fraudulent misrepresentations?  Is it another "mistake" that Westin rectified.  I have no idea but I need to know since I have income tax concerns that relate to 2004 and 2005, primarily for now.

I have another question related to the corporate entity, Traditional Holdings, LLC.  Judge Babcock's order was based on the fraudulently obtained void judgment in the referenced case.  The interpleader amounts addressed in Babcock's order totaled approximately $154,000.  Greenberg's lawsuit was filed in early June 2005.  However, there is a discrepancy that I am trying to resolve.  I have in my possession Greenberg's statements noting the value of the assets in the TH account at $3,707,382 as of June 30, 2005.  Judge Babcock's order doesn't explain how he wanted the balance of the assets handled.  He specifically addresses the interpleader claim in the amount of $154,000 so there's no ambiguity with respect to the discrepancy.  I would like to note that Streeter advised the jury that the TH account assets were $150,000.  Greenberg's statements prove she lied.  In debriefing, one juror confirmed that he relied on her statements to find me guilty.  That raises many issues - including juror misconduct that was not addressed with the court. Vanderet was clear:  statements made by attorneys are not evidence.  I don't know what they are when they are lies about IRS, federal tax matters, corporate account balances, etc.  

I don't believe this TH account balance/value includes Cohen's transaction fees.  

Do you have any idea what is included in that account valuation?  I would appreciate any insights you might have.  And, I will refer you to the Annuity Agreement where Cohen acknowledges that he is entitled to take loans/advances but must repay them.  I relied on his agreements and obligations as well as the advice of his representatives.  Cohen's representatives did not work for me and I think that's fairly obvious.

I have found a handful of emails from myself to Cohen and Kory (before the lawsuit was filed) proving that the lawsuit is retaliation and they understood I had reported the tax fraud to Agent Betzer and was discussing the "Criminal Division."  If you have any concrete evidence from IRS confirming Kory's statements regarding IRS matters, I would appreciate copies.  

It is entirely clear that this lawsuit is nothing other than an attempt to obstruct justice and cover up criminal tax fraud.  I've been very clear about that from the beginning.  The criminally harassing emails I am receiving will not change that fact.  I don't want to be copied in on emails from a stalker that are now being sent to the City Attorney's office.  I have filed a claim against that office and do not want to communicate with them at all except in federal court with a federal judge monitoring the situation.

I have another question.  I have many questions regarding the corporations and federal tax returns.  I would like to note that corporations not registered in California, and one's that forfeited their status, do not have standing to obtain injunctions, judgments, etc.

In any event, I have a question about the alleged annuity obligation.  Cohen borrowed or caused to be expended approximately $6.7 million from TH alone.  He signed the Annuity Agreement acknowledging that loans/advances could be made to him but they had to be repaid within 3 years with interest.  The agreed upon interest was 6%.  That amount now totals approximately $10 million.  I have Greenberg statements from as late as July 2005 (well after Cohen and I parted ways) showing TH account balances at nearly $4 million.  That doesn't really jive with the statements Streeter made re. the $150,000 left which a juror relied on to find me guilty.  That came out in debriefing, is juror misconduct, and the court appointed lawyers failed to raise that issue with the judge.  I've raised it with IRS and DOJ.  The annuity obligation, according to my lawyers and accountant, was extinguished from the federal tax returns in 2003.  How do you explain the arguments re. TH or the fact that LCI and LC collected royalties re. assets belonging to BMT?  I'd like to hear an explanation and have asked to examine the corporate books and records as well as the tax returns.

On another note, Gianelli continues to criminally harass me (and others) and is now lying that I have bcc'd him.  I have evidence proving otherwise.  I've copied Mike Feuer in because he's lying to them about my forwarding him emails, etc.  I am aware, due to his statements, that Gianelli worked with them on two occasions to have me arrested.  That now means that Leonard, Steve Cooley, the City Attorney, and Gianelli all aligned themselves against me to have me falsely arrested.  Gianelli is making up a narrative as he goes along.

Did I lay this all out for the IRS Criminal Division in 2007?  In any event, the issues I am being harassed over involve IRS, Leonard Cohen, tax fraud, the fraud default judgment and fraud accounting, and now the City Attorney.  I repeat:  calling me a drunken slut will not be a viable legal defense.  Leonard Cohen is the individual with a long publicly documented history of psychiatric problems, alcoholism, drug abuse, etc.  He also appears to have a long history of using corporations to evade taxes; falsely accusing his advisers of ripping him off to breach contracts; and theft.

I am sitting here with non-revocable assignments; minutes signed by Cohen (language re. compensation dictated by Cohen), etc.  I don't think the narrative, which doesn't seem to include evidence (other than some excerpts of documents not attached, not authenticated, etc.) replaces the actual corporate documents.  Cohen understood, and testified about this, that his lawyer handled the corporate matters.  I did not and most certainly would never request the preparation of minutes.  I might convey information from one representative to another but I would NOT make a request re. corporate matters on my own.  

These issues are not resolved and Rice was in no position to advise my otherwise or to advise me that I have to participate in discovery re. IRS required tax or corporate information.  

While the Complaint notes that BMT was formed in Delaware in March 1993, that is a fraudulent statement.  It was formed in 1985 as LC Productions, Inc. and registered to do business in California in 1993 - at which point it changed its name.  I handled none of this and Cohen personally worked with his friend/lawyer, Herschel Weinberg, on this, Stranger Music, Inc. and other matters after Marty Machat's death in 1988. 

I have check the State of California's website today and Blue Mist Touring Company, Inc. continues to list its business address as my former POB and I continue to be listed as the Registered Agent at an address I haven't used in 10 years or so.  Is there a reason why Cohen would go to such lengths, provide the Court with a fraudulent narrative and obtain a fraudulent default judgment, and continue to list me as the registered agent of this entity and my former PO Box as the business entity address.  The status of this entity continues to be listed as "forfeited."  Evidently, the FTB has not received corporate tax returns.  

If you think I will sit here and permit Cohen to commit tax fraud, use me egregiously, and do nothing because I am being slandered, maligned, criminally harassed, and called a drunken slut, you should rethink your legal positions.  I am attaching a copy of my motions to IRS Form 3949(a) with the evidence that will be attached to my motions.  

I would like this entity to remove my name as Registered Agent since your client obtained a judgment illegally converting my property to himself - including my ownership interests in BMT and TH.  For some reason, Old Ideas, LLC was not raised in the Complaint so I do wonder how LA Superior Court obtained jurisdiction over that entity.  I, of course, have asked IRS to investigate all of this and believe they are the appropriate third party to handle the "accounting."  The ledger is nothing other than evidence of financial fraud and Cohen's refunds from IRS and FTB have been challenged as fraud.  This was concealed from Judge Hess.  At least, the IRS refund because I did not learn of the FTB refund until December 2013 or January 2014 when you filed your reply documents.
