Hello IRS,

I am working on my declaration and the evidence that will be attached to my motion.  I want to review this set of facts with you while it's somewhat fresh in my mind.  I am reviewing a letter dated December 6, 1999 addressing the "items" Sony is interested in purchasing.  At this time, Sony had paid Cohen the $1 million which he never transferred to Traditional Holdings, LLC or Blue Mist Touring Company, Inc. which owns the assets.  CAK was still interested in pursuing a deal and Cohen addressed this in his declaration that he's now referring to as "hearsay" in the CAK litigation matter.  Hence, there was a possibility that LC Investments, LLC might be used to pursue the CAK litigation matter.  In the end, the deal was not pursued using that entity.  There was an oral agreement that LCI could continue to collect certain royalties - specifically the SOCAN income - related to assets belonging to BMT.  Nothing was assigned to LCI.

The following items were assigned.  And, the book publishing on Cohen's first 11 books were assigned to BMT because Cohen was interested in selling those writes (potential buyers wanted to set his literary works to music) and Destin Publishing in particular was interested in those items.  Destin Publishing ultimately placed a very solid offer.

I was compensated with my interest in BMT in late 1999.  This had nothing to do with my commissions being treated as cap gains.  That is simply a fraudulent and fabricated narrative.  Westin suggested the various tax plans and I nixed all of them - including the use of the Ekajati Corporation for cap gains tax on my commission.  It didn't sound right.  I have provided you with the evidence that Westin created that entity for me to use and it was not used. 

The Complaint, I believe, states that Sony did not want to use BMT.  That's a bald faced lie and there is no evidence to support that.  Westin and Cleveland spoke and Westin told me Cleveland was concerned about "collapsible corporations."  I didn't handle those types of matters and they, together with Cohen and possibly other representatives, decided not to use Blue Mist Touring Company, Inc.  Cohen not only assured me that I would be paid for my ownership interest in the IP assets in Blue Mist Touring should another entity be used to sell those assets.

The new entity was Traditional Holdings, LLC.  Cohen did not want his children listed as beneficiaries, understood this entity bypassed his estate, and did not want his children involved in any corporation related to him.  He's just pretending that he doesn't know any of this because he has to defend himself against the allegations that he committed criminal tax fraud and Kory's the self-proclaimed "tax jock."  His accountant, Mike Mesnick, worked for IRS (from what I was told) and evidently helped come up with an entirely psychotic argument.  It worked beautifully for LA Superior Court - particularly as I was not served.

At the end of the day, I believe all these entities are shams and definitely agree with Machat:  Cohen uses corporations to evade taxes.  I also happen to believe that he does not live in Canada due to tax and residence problems.  I discussed this matter at length with Cohen and my former brother-in-law.  That's when Cohen decided to reapply for a green card.  And he personally told me that IRS asks where you paid taxes the prior year while Canada does not.  He was dealing personally with those matters with his lawyer, Herschel Weinberg, and that's not something I know.  I still don't know if that's true.  I know one thing - when I spoke to Revenue Canada, they wanted to know what type of income Cohen had each year.  Evidently they don't have a statute of limitations.  That probably informs Cohen's decision to destroy my life and attempt to blame his own insanity on me.  He's very fortunate Los Angeles is running a celebrity justice program that is vile and absolutely unconstitutional.
