THE SENTENCING OF KELLEY LYNCH
I am grateful, Your Honor, for this opportunity to speak.
I want to thank the Court, in the person of Your Honor, for the cordial, even-handed and elegant manner with which these proceedings have unfolded. It was a privilege and an education to testify in this courtroom.
Leonard Cohen, in particular, wants to thank the court for permitting him to lie on the stand, commit perjury, conceal evidence, and turn the “intent to annoy” trial into a Stalinesque Show Trial where he - once again - lies about Phil Spector.
I want to thank the City Prosecutor, Ms. Sandra Jo Streeter for her unflinching commitment to the case, for her wise, honest and straightforward method of uncovering the truth, and for her life-long devotion to the People’s cause.
Cohen wants to thank Streeter for lying through her teeth about Lynch; eliciting perjured and false testimony; concealing evidence; and generally making a buffoon out of herself by lying that I actually have the IRS required 1099 form. The taxpayers should be overwhelmed by this lunatic’s search for the truth. In fact, Streeter simply had an opportunity to gush over a celebrity, skip out of court to tell Cohen that the LA Times would take one still photograph, break the podium, lie to two judges, etc.
I want to thank the members of the jury for their patience and discernment and for their gracious acceptance of the interruption of their lives. It is much appreciated.
God knows what the jurors were thinking - and God cares.
I want to thank the Public Defenders for their restraint in presenting only a portion of the material that they knew was untrue.
Leonard Cohen who confessed to lying under oath has a lot of nerve insulting my public defenders. This man wouldn’t know the word overkill if he fell over it.
I want to thank the Defendant Ms. Kelley Lynch for insisting on a Jury Trial, thus exposing to the light of day her massive depletion of my retirement savings and yearly earnings, and allowing the Court to observe her profoundly unwholesome, obscene and relentless strategies to escape the consequences of her wrongdoing. The eight-year ordeal of harassment of my family, friends, my associates and myself, was designed specifically to avoid or postpone the inevitable day of reckoning with the IRS, the day when she will be bound to account for the taxes she neglected to pay on the stolen monies she received and failed to report.
I didn’t insist on a Jury Trial. My public defenders didn’t tell me there was a plea deal until I asked and the trial was underway. Leonard Cohen borrowed millions from his so-called retirement account and refused to repay those loans at 6% interest within three years. His loans were dangerous to the structure of this entity, as his financial adviser and tax lawyer started noting. There was nothing obscene about me but the man who likes to write poems about 15 year old girls, have me call my attorney brother-in-law about statutes involving sex with a 15 year old in Canada and Freda Guttman/Ann Diamond’s conversation/allegations that Lorca Cohen said her father molested her, and someone who looked at people defecating on one another on the internet in my presence, and also watching a video of his adult daughter jumping naked on a bed and explaining that he thinks it’s a cutting edge music video, really should seek the psychiatric care he obviously needs.
I didn’t neglect to pay taxes. I reported Leonard Cohen’s egregious and probably criminal tax fraud to the IRS. Canada’s National Treasure cannot live in Canada because he has tax/residence issues there as well. I didn’t steal or misappropriate any monies so the IRS might see right through this insanity, particularly as I have given them an abundance of evidence [including the concealed corporate books, records, stock certificate, memoranda, attorney/client privileged documents, my Indemnity Agreement, etc.) to prove that Leonard Cohen committed criminal tax fraud because - as he told me ad nauseum, he cannot stand “ordinary income taxes.” There was no harassment. Just a liar with motive, greed, arrogance, and stupidity.
Immediately upon a forensic analysis of the theft by Moss Adams, a highly respected accounting firm, we submitted a theft loss amendment to the IRS and this was the considered basis for the refund to me, a refund for the taxes I had paid on the stolen monies that I did not receive.
Kevin Prins/Moss Adams flew to San Francisco to meet with my accountant. He advised him that he did not have the corporate books and records, etc., and could not properly prepare the analysis. This is a fraudulent expense ledger; conceals my corporate ownership interests as well as my 15% ownership interest in Cohen’s intellectual property for my work over the years. Cohen similarly stole from Steven and Marty Machat. The IRS just advised me to file fraud form 3949a with respect to the outrageous refund revealed during my “intent to annoy”trial. I have done that and emailed a copy to the IRS Commissioner’s Staff. I tend to doubt Cohen paid monies on anything that wasn’t misappropriated or stolen but the man cannot stop lying. Leonard Cohen owes me millions and withheld commissions he owes me. He has not, as yet, provided me with the IRS required 1099 for the year 2004. He, Kory, and Streeter all lied about this. I phoned my former lawyer, Dianne DiMascio, to discuss this and to let her know that I am waiving attorney/client privilege for the IRS, FBI, DOJ, Treasury, and FTB to speak to them directly.
Ms. Lynch herself, her former tax attorneys (whom she fired), her accountant (who resigned), the IRS and two courts of law, one in California, the other in Colorado, have long been in possession of these very same and very public forensic reports which the Public Defenders dare to assert we withheld, and offer this fictional withholding as justification for Lynch’s daily obscenities, death threats, and menacing fantasies of revenge. Ms. Lynch is in full possession of the of the forensic analysis. She just doesn’t like it, and she has gone to unacceptable lengths to ignore, discredit, threaten and vilify any person who, or institution that has affirmed it.
Actually, I didn’t fire Mike Taitelman, Bert Deixler, or Zia Modabber. Dale Burgess didn’t resign. He finished his work and my taxes were paid in full through 2003. I fired Ken Cleveland in the fall of 2004 when I hired Dale Burgess. The illegal K-1s Cohen issued me, transmitted to the State of Kentucky and IRS, totally undermine this fraudulent expense ledger. I see Cohen’s mad at my public defenders for telling the truth about his outrageous attempts to blame his wrongdoings on me while engaging in serious revenge fantasies. There were NO death threats. Cohen himself testified that when I used the phrase “take you down,” I frequently said “legally.” The phrase itself is nebulous in any event but this man has a major tax hit on the horizon and his lawyer was clear in his letter to Agent LuisTejeda/IRS - Agent Kelly Sopko’s email advising me to report Cohen’s tax fraud to Agent Tejeda/IRS was a game changer. I don’t like fraudulent expense ledgers that conceal corporate ownership interests, assets, equity, and liabilities - including Cohen’s millions in loans owed to Traditional Holdings. He clearly views himself as the alter ego who engaged in self-dealing. Cohen doesn't like his own words coming back to haunt him - he should recall that, after being interviewed by Mikal Gimore (whose brother was executed in the United States) he began telling me that this is how he would like to die and even said he would enjoy one final cigarettte. Perhaps the tone was menacing as the liar testified on the stand. God knows this man cannot stand anyone who disagrees with him. It infuriates him. He becomes consumed with rage and anger.
This is, as Prosecutor Sandra Jo Streeter sharply observed, “nothing but the unraveling of a con.”
I think Streeter was talking about herself. I suppose that’s why people are now referring to her as a psychopath.
It gives me no pleasure to see my one-time friend shackled to a chair in a court of law, her considerable gifts bent to the service of darkness, deceit, and revenge. I fear that her obsessive commitment to these activities will resume as soon as Ms. Lynch is released, therefore I will be grateful for whatever respite the court will allow my children, my grandchildren, my friends and associates, and myself.
Leonard Cohen thinks I would contact him again? Well, as my friend - a psychiatric nurse - noted: his long time publicly documented drug abuse has clearly taken it’s toll and he appears to have borderline personality disorder and worse. I’m sure his toddler grandchildren are deeply concerned. They should be - they have a grandfather who has, for years, dabbled in darkness, deceit, and revenge. In fact, he once told me that while meditating I was the only person he didn’t feel revenge towards. I found that astounding.
I must confess, Sir, that Ms. Lynch’s contempt for every court order and every legal restraint that we have obtained in the past, her defiance of the law, and her pledge of unrelenting warfare, do not produce confident feelings of relief or optimism.
Every order, judgment, and verdict Cohen has obtained was based on fraud, perjury, concealment, and lies, and has one intent - to obstruct justice. Unrelenting warfare? The wordsmith really likes to drive his insanity home. Some awe-inspired journalists actually fall for this. Perhaps he should stick to his embellished stories about wanting to join the Israeli military during the Yom Kippur War, escaping Cuba as the Bay of Pigs was unfolding, and other revolutionary tales.
Finally, Your Honor, I would like to read into the public record my gratitude to my attorney Ms. Michelle Rice. Without her meticulous attention to a staggering volume of material [thousands of emails, dozens and dozens of vile messages] we would not be here today, and the full extent of Ms. Lynch’s deliberate cruelties and evasions would not be known. It is through Ms. Rice’s pain-staking management of these toxic details through multiple courts, and before eminent judges, that we were able to present the case to the City Prosecutor, Ms. Sandra Jo Streeter, who then so skillfully and steadfastly argued it in the name of justice before this court and this jury.
As I’ve advised the IRS, FBI, DOJ, Treasury, and FTB, Cohen’s lawyers - Rice and Kory - should also be charged, arrested, and prosecuted. As Cohen’s former lawyer, Ed Dean, said: if the IRS Commissioner thinks this is fraud and not negligence, he should or will come in after the advisers, lawyers, accountants … The eminent judges should enjoy Leonard Cohen. They really seem to tolerate his perjury and they tolerate Streeter lying to them and eliciting perjured and false testimony. That’s their problem.
Your Honor, I am deeply grateful to all who have helped me end this vicious intrusion into my life and the lives of my family, friends, and associates, even if it temporary. I am grateful to the taxpayers who have funded these proceedings, and I am grateful to the LAPD, in the person of Detective Jose Viramontes, who arranged and executed the arrest of the Defendant, and I thank Mr. Steve Stevens for his invaluable consultations.
The taxpayers should be outraged. This man has defrauded the U.S. government and State governments of millions of dollars; abused taxpayer dollars when he fraudulently registered the civil harassment order I requested as a domestic violence order, and proceeded to perjure himself - yet again - in another court of law. Detective Viramontes/LAPD has been entirely professional with me and that is utterly refreshing and I wish him well. As for Steve Stevens, he’s laughable. Anything for a buck and a celebrity fraud, evidently.
It is my prayer that Ms. Lynch will take refuge in the wisdom of her religion, that a spirit of understanding will convert her heart from hatred to remorse, from anger to kindness, from the deadly intoxication of revenge to the lowly practices of self-reform.
I think it’s time to quote His Holiness Kusum Lingpa - who knew Cohen and saw right through him: He’s an asshole who is going to hell. Cohen’s deadly intoxication has led to his near legendary three versions of his Phil Spector gun stories before LA Superior Court. Clearly, two must be perjured. The low practices of self reform - Cohen will never be able to penetrate that concept. He’ll have to study it in the same manner he studied various serious murderers; specifically Jeffrey Dahmer on remorse. I have no hatred in my heart. I could care less about Leonard Cohen. Anyone that thinks otherwise is clearly a sycophant.
