Pursuant to your suggestion of the other day, I enclose herewith the Motion for Terminating Sanctions, Motion Exhibits, three exhibits related to my declaration, Proposed Order, and Request for Judicial Notice.  

Paulette Brandt will send you a separate email confirming your receipt of these documents.  She is listed on the proof of service.  

I have not attached most exhibits referred to in my declaration and will begin scanning them now.  I will also scan the conformed cover sheet for both the motion and request for judicial notice as well as signature pages for all documents.  Additionally, Paulette Brandt's declaration has a handwritten final paragraph which she approved as she was with me at Los Angeles Superior Court.  These exhibits should be fully scanned later tonight.

I have enclosed, for your reference an exhibit index (which I placed behind the notice of motion/memorandum, Volume Covers (a total of four volumes were filed with the Court but we removed the first cover and simply left the Notice of Motion per the Court's instructions).  All declarations were properly signed this time.

The hearing is scheduled for June 23, 2015.  I have brought Gianelli and Walsh's ongoing harassment to the attention of Judge Hess.  That would include with respect to my witnesses.  Paulette Brandt is a witness and has provided me with numerous declarations.

Until Judge Hess rules in this matter, I will continue to address all legal issues that Gianelli writes me about with you, the attorney of record in this case, as he has not entered a formal notice of appearance in this case.  It does seem as though he is moonlighting but that doesn't explain Cohen's fan, Susanne Walsh.  I have also addressed these harassing emails (and witness intimidation/tampering) in the Proposed Order.

Finally, I included the documents you filed with Judge Hess without requesting judicial notice in my Request for Judicial Notice.

If you have a copy of a formal agreement with me (and any Cohen representative) relating to service by email (for which there are more formal rules when an individual is pro per), please email that to me.  I agreed to no such request and no such request was made.  Finally, I am appalled that your co-counsel, Michelle Rice, would provide the District Court in Colorado with incorrect contact information for me.  She doesn't know me; does not represent me; had no authority to provide the court with any information; and I did not enter an appearance due to concerns about an attempt to cover up criminal tax fraud and obstruct justice.  I brought these concerns to the attention of Judge Lewis Babcock.  These tactics are unconscionable.

I noticed, while at Court, that you flied something on January 28, 2014.  I was not served that document and was not here at the time.

You may phone Brenda in Judge Hess' department and confirm the hearing date scheduled for June 23, 2015.  Paulette has had car troubles and just picked her car up last night.  We will file this motion today, drop a copy off for Agent Tejeda (as I've advised Judge Hess in the document), and serve you.  I have also asked Judge Hess to order you to advise Gianelli and Walsh to cease and desist harassing me over this case and Leonard Cohen matters.  We shall see what unfolds.  I didn't argue against the "drunken slut" accusations because that matter is not before Judge Hess.  Paulette Brandt is also being slandered and she, Investigator Frayeh, and "Swanigan" were copied on this email.  It's actually irrelevant what Hess does.  I want to see how much fraud and perjury is acceptable before LA Superior Court before filing a federal lawsuit.  The federal tax matters have not been adjudicated.  I've also asked Hess to clarify the judgment and explain how it subverts IRS reporting and filing requirements.  Also, whether it is retroactive and, if so, to what date.

If Cohen wants to argue that the tax returns filed are fraudulent, I find that rather mind boggling.  Westin worked for him and I had nothing whatsoever to do with tax matters, accounting, corporate matters, legal documents, loan documents, etc.  See the February 2002 email thread between me, Cohen, and Westin.  Transaction fees were not at issue at that time.  Cohen had authorized them, and signed the authorization himself, immediately following the close of the deal.  Does Leonard Cohen think he's entitled to an extinguished annuity obligation, loans totaling approximately $6.7 million, and another $4.7 million in payments?  That's not the agreement, Jeffrey.  I am aware that Cohen has benefited from his wrongdoing.  

If there are any more shenanigans, I will file another motion, ask for a hearing, and have Hess order that all communications are handled through the Court.  There's no lawsuit here, Jeffrey.  Just tactics.  That would include the outrageous situation whereby Rice gave the wrong information to the District Court in Colorado about me.  She had no authority to do so and I didn't enter an appearance.  I advised Judge Babcock that I viewed the lawsuit as an attempt to obstruct justice and cover up criminal tax fraud.  I've asked Hess to remove Rice from this case as she is conflicted and now serves as a lawyer and paid witness.  You can read the documents later tonight.

Hi IRS,

Reviewing Michelle Rice's January 4, 2014 declaration (attached to Cohen's January 2014 Opposition doc - declarations were replete with perjured statements).  It appears that Rice, who has made partner targeting and lying about me, informed the Court that I was pro per and advised them to send my mail to Phil Spector.  Rice wanted a California address and I was clear that I resided in Colorado and no longer had a California address.  Phil Spector no longer used that P.O.Box and the Court appears (based on the documents I've downloaded from PACER) to have continued to send my mail to my former Brentwood address.  Who is Rice to advise a court anything about me?  I do not know this woman.  I advised the Colorado Court NOTHING having to do with my self-representation, address, or my email account (that was targeted by Gianelli and Blaine, I might note).  I spoke to Judge Babcock personally.  I advised him that, due to my concerns about obstruction of justice and an attempt to cover up Cohen's criminal tax fraud, I would not participate in this lawsuit.  Furthermore, Boies Schiller was convinced Cohen's position as alter ego would help prove that he personally engaged in criminal tax fraud.

Phil Spector's wife is none of Gianelli's business.  Neither are my contacts with Phil Spector.  Gianelli is clearly moonlighting for Spector's prosecution, aligned with Blaine and others, and assisting with Cohen's defense although he has not entered a formal entry of appearance.  He also engages in criminal witness tampering, witness intimidation, slanders me, offers legal opinions, and is on someone's payroll.

He's obsessed with me, my family and friends, and blog.  All matters he raises relate to Cohen, IRS, and Phil Spector.  Gianelli's not making any points to me so I'm missing no point - including the criminal tactics used against me.

As usual you miss the point.

First, it makes absolutely no sense that an attorney for another party would – out of the blue – inform the Colorado district court in the Agile litigation that your mailing address was C/O Phil Spector at his Pasadena office address. And the court would not list you as pro se – at that address – unless you so notified the court.

But more to the point is the fact that your “dear friend” Phil Spector simply sent all of your mail back to the sender as “undeliverable”.

Setting aside the fact that you don’t even have his wife’s contact information, and have not even tried to visit Spector in the last six years of his incarceration.

Cohen's lawyer evidently gave the Colorado Court Phil Spector's address.  She knew I didn't live in California and it is merely

evidence of further abusive litigation tactics.  

Gary Spector has aligned himself (and I've studied the online cyber-campaign) with Michelle Blaine and Gianelli.  It is truly appalling.  Phil Spector has a wonderful relationship with Nicole who testified on his behalf.  These three men appear to be opportunists.  Their conduct is unconscionable.  I didn't impute financial motive.  I said Gary Spector, having trashed his father online, probably thinks he should be in Phillip's Last Will and Testament.  I've noticed that Gary Spector and his brothers are relatively obsessed with Rachelle Spector who has been demonized using the same 3rd grade girl "drunken slut' argument.

I don't need to create an impression that I am close with Phil Spector.  He is one of my dearest friends.  Paulette is extremely close with Phil Spector.  However, Gianelli (who may be moonlighting for Cooley and Alan Jackson while aligned with Cohen) doesn't know us so it's none of his business.

This man's obsession with me and my family is obscene.  

I wouldn't attend Phil Spector's railroading if you paid me.  Paulette did and was extremely upset and felt the judge had pre-determined that Phillip was guilty.  PS introduced her, and they had lunch, as one of the most important people in his life.

Gianelli was on Pacer again.  Maybe he received a bonus.  This man is a criminal who belongs in prison.  I can assure you that he's talking to himself.  I don't care if he copies GOD in on his emails trashing me.

Clearly, you have always wanted to convey the impression that you were close to Phillip Spector, but – obviously, your behavior (including your failure to attend his trial or visit him in jail) and in this instance his behavior in returning your mail as undeliverable, tells a far different story.

Moreover, you have a lot of nerve imputing a financial motive to Phillip Spector’s son Gary, in view of your attempts to sell the idea of Phil Spector on essentially funding your desired lawsuit against the City of Los Angles and Leonard Cohen by among other things Spector loaning you his “legal team”.  Moreover, Gary Spector has not exactly been sucking up to his father as one would expect a son seeking to protect his expectation of an inheritance would – unlike you, who panders to Phil Spector at every opportunity. Which opportunities are limited, because Spector will never see you, and you don’t even have his wife’s email address – because if you did you would not need to pester Spector’s appellate counsel with your incessant personal emails. Not that she would let you anywhere near her husband now or ever.

I've studied the internet.  I know what's going on.  I see Gianelli and Blaine's M.O.  Escobar's also.  Evidently you have to be a moron to be against Phil Spector.  That's a constant theme.  I want Gary Spector to understand that I don't want to see his email address.  I think what he and his brothers have done to Phil Spector is a disgrace.  They never called him when I worked for him.  Paulette said they were not close with him at all.  Suddenly, they are opportunists.  I'll bet they want to be in Phillip's Will.  Where there's a Will there's a relative.  This is the sleaziest situation I have ever seen.  Decent people do not believe this unconscionable situation.

Hello FBI,

The Moonlighting Stalker appears desperate.  

I think FBI should review any potential video footage of Lana Clarkson in a training video dancing around with a gun in her mouth.  That would probably have Cooley, Jackson, et al. gravely concerned,  FBI is not prohibited from talking to Baby Doll Gibson either.  That was just Judge Larry Fidler's bizarre ruling where he demanded that Phil Spector take the stand if Gibson testified.  That is a disturbing issue.

He’s awarded a huge settlement…

US music producer Phil Spector has settled an embezzlement claim which will see him rewarded $900,000 in damages.

The producer is currently on trial in the US on suspicion of murdering b-movie star, Lana Clarkson, in 2003.

Spector said that his former assistant Michelle Blaine had removed $425,000 from his pension and had failed to repay a $635,000 loan.

Ms Blaine had claimed that the pension funds were going towards a film to help boost the 66 year old producer’s image, and that the loan was a gift. She has also dropped a counter-claim of sexual harassment as part of the deal.

Spector has famously worked with artists including The Beatles and Cher.

Good Morning Mr. Riordan,

How are you?  I'm finishing up my Tables of Authorities.  Stephen Gianelli, who obviously works in tandem with Michelle Blaine, has decided to threaten me and Paulette Brandt.

No, we are not "asserting" that Blaine placed a body on Spector's floor.  I think the individual who placed the body on the floor was Lana Clarkson who shot herself.  Frankly, I find the discussion about why she shot herself rather superfluous.  People should not play with guns when they are high on vicodin and tequilla.  That seems like a very obvious conclusion.

Cohen's judgment is then used against me.  That's quite rich given the fact that he is the thief who stole from me, Machat & Machat, and Phil Spector.  This is an ongoing 10-plus year conspiracy on Cohen's part to conceal his role in criminal tax fraud and obstruct justice.  His refund is simply astounding.  The man has benefited form his wrongdoing.  Leonard Cohen's greed got the best of him.

The Moonlighting Stalker has attempted to argue that Blaine received loans from Phillip.  Where are the loan documents?  Why should anyone believe her?  I have corporate books, records, stock certificates, signed agreements, non-revocable assignments, was included on federal tax returns, etc.  You will have an opportunity to review the evidence when I file my motion on Monday.  I have, in any event, provided this evidence to Phillip personally.  Steven Machat had me copy it as well.  

Michelle Blaine, a woman who stole $1 million from Phil Spector, would like to sue me for libel?  These people are certifiably insane.  Perhaps these people and their conduct is embraced in some hell realm.  Gianelli is defending Michelle Blaine.  He worked with Kelly Green of the Darwin Exception.  It was Gianelli's  posting buddy so I think that sums things up.  The man clearly argues the prosecution case and has targeted people relentlessly.  He engages in criminal witness tampering, witness intimidation, stalking, harassment, etc.  He, Blaine, and Escobar have similar tactics:  SLANDER.  

I think Phil Spector knows whether or not this woman stole from him or not.  Bruce Cutler, Gianelli's pal, called Blaine a bald-faced liar and a thief.  

I hid nothing from Leonard Cohen.  He has embezzled approximately $6.7 million from the so-called "retirement" account.  Cohen doesn't want to address that fact.  I wasn't served Leonard Cohen's lawsuit and LA Superior Court appears willing to condone this man's extensive fraud and perjury which is why I plan to file a lawsuit in federal court.  Well, at least Blaine paid her ill gotten monies back.  Cohen's a master mind.

I do wonder if, when Cohen met with the DA in 2005, they played a role in his decision to pursue a "default judgment."  It's worth pursuing as a "theory."  

I don't have an unpaid judgment because LA Superior Court is NOT extorting money from me and that will be a federal court issue:  extortion.  Paulette Brandt is not bitter.  Gianellil does not know her but Blaine is inconceivably hostile, vindictive, and vulgar..  Blaine appears to have moved in and isolated Phillip while getting rid of Paulette, Jay Romaine, and Morgan Martin.  Why would she replace Morgan Martin with DeSouza?  That's a question worth pondering.  How did Blaine come to know DeSouza.  There's more to this story than meets the eye.

The alleged deposit slip, which is not in my handwriting, relates to an "Alliance" check.  I do want Neal Greenberg to provide me with copies of all authorizations Leonard Cohen signed.  For instance, Cohen's gift of $100,000.  Why would Greenberg make checks out to me with f/b/o Leonard Cohen?  Because it involves some type of shenanigans.  I need all the royalty statements, etc. to prepare a proper accounting.  I stole nothing from Cohen and corporate accounts, such as Traditional Holdings, LLC, are not this alter ego's personal piggy bank.

Gianelli ends by confirming that he and Blaine targeted my Phil Spector is Innocent blog.  Why?  Did it bother Cooley and Jackson?  Cohen?  Whose payroll is Gianelli on?

Gianelli, Blaine, Walsh, et al. have engaged in cyber-terrorism and this Criminal Stalker continues to engage in his antics.  This matter is being brought to the attention of Judge Hess and I will work on State Bar Complaints next.  I have attached my State Bar Complaints against Cooley to my motion as well as the State Bar's response.  It relates to the Complaint I filed with Cooley's Major Fraud Unit which I believe was headed by Alan Jackson.  Cohen appears to have a role in the Spector matter and I think Cooley's joining forces with Cohen publicly (while Streeter elicited testimony about Phil Spector) is about as blatant as one can get.

Gianelli is amused and copying DOJ and FBI in on his emails.  They should, of course, arrest him.
